Susana Martinez issued a\u00a0formal declaration on Friday that a special session of the Legislature will begin May 24\u00a0to address the state&#8217;s budget standoff.<\/p>\n<p>The <a href=\"http:\/\/www.governor.state.nm.us\/uploads\/PressRelease\/191a415014634aa89604e0b4790e4768\/Governor_Susana_Martinez_Issues_Proclamation_for_Special_Session_2.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">proclamation<\/a> that formalized the special session came two days after Martinez announced a budget &#8220;agreement&#8221; that <a href=\"http:\/\/nmpolitics.net\/index\/2017\/05\/governors-new-budget-agreement-lacks-agreement\/\" target=\"_blank\" rel=\"noopener noreferrer\">lacked the agreement<\/a>\u00a0from House Democrats or Republicans and Democrats in the Senate.<\/p>\n<p>Democratic legislative leaders responded to the news with yawns.<\/p>\n<p>&#8220;<span class=\"m_3169500609550220323m5410806099021397195gmail-im\">I remain very disappointed that the governor has not put forward any details of her proposal,&#8221; said House Speaker Brian Egolf, D-Santa Fe. &#8220;Until she shows the details to the people of the state and the Legislature, it isn\u2019t possible to know whether there can be an agreement<\/span>.<!--more--><\/p>\n<p>&#8220;The governor knows, because House and Senate leadership have been clear from the beginning, that cuts to education, health care, behavioral health and important economic development initiatives will not be accepted during a special session,&#8221; Egolf said.<\/p>\n<p>That&#8217;s partly because they&#8217;re still not seeing a plan from the governor to balance the budget for the fiscal year that begins July 1. The legislation the governor specified to be considered during the upcoming session &#8212; which includes using capital outlay money and legislative retirement funds to plug a budget hole and reform of the state&#8217;s gross receipts tax &#8212; doesn&#8217;t fully plug the hole.<\/p>\n<p>&#8220;The scarce details provided by Governor Martinez in the proclamation do not add up,&#8221; said Senate Majority Leader Peter Wirth, D-Santa Fe. &#8220;New Mexico cannot afford the additional cuts the governor seems intent on making a reality.&#8221;<\/p>\n<p>It&#8217;s also because the Legislative Council is <a href=\"http:\/\/nmpolitics.net\/index\/2017\/04\/legislative-council-asks-supreme-court-to-invalidate-guvs-vetoes\/\" target=\"_blank\" rel=\"noopener noreferrer\">suing the governor<\/a> to try to undo <a href=\"http:\/\/nmpolitics.net\/index\/2017\/04\/martinez-vetoes-tax-hikes-funding-for-higher-education-and-legislature\/\" target=\"_blank\" rel=\"noopener noreferrer\">her recent vetoes<\/a> of legislative and higher education funding, arguing that she can&#8217;t eliminate constitutionally mandated agencies. The N.M. Supreme Court is scheduled to hear arguments in that case on May 15, nine days before the session begins.<\/p>\n<p>&#8220;We should all keep in mind that the agenda and need for a special session will not be fully known until the Supreme Court makes a decision after the <span class=\"aBn\" data-term=\"goog_824481334\"><span class=\"aQJ\">May 15<\/span><\/span> hearing,&#8221; Egolf said.<\/p>\n<p>Martinez also vetoed a $350 million tax-hike bill lawmakers approved in their recent session, so even if the Legislative Council is successful in court there would be a budget shortfall still\u00a0unaddressed.<\/p>\n<p>The governor filed <a href=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2017\/05\/Response-by-Governor-in-Veto-Case.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">her response<\/a> to the lawsuit with the Supreme Court on Friday. In it, she argued that\u00a0the Legislature hasn&#8217;t met the requirements for a hearing before the high court and that she has the authority to issue the vetoes.<\/p>\n<p>&#8220;The governor never stated that she is abolishing the Legislature or any state education institutions,&#8221; the brief states, noting the upcoming special session. &#8220;Neither the legislative agencies nor the educational institutions have run out of funds, and there is still time to appropriate funds for the next fiscal year.&#8221;<\/p>\n<p>Meanwhile,\u00a0Martinez\u2019s\u00a0veto has put the state\u2019s colleges and universities in the difficult position of not being able to plan for the fiscal year that begins in a few weeks \u2014 and come at a time when high-school seniors are deciding whether to attend college in state or out of state. Several <a href=\"http:\/\/nmpolitics.net\/index\/2017\/04\/higher-education-must-receive-its-state-funding\/\" target=\"_blank\" rel=\"noopener noreferrer\">university presidents<\/a> and <a href=\"http:\/\/nmpolitics.net\/index\/2017\/04\/student-body-presidents-decry-politics-plead-for-university-funding\/\" target=\"_blank\" rel=\"noopener noreferrer\">student body presidents<\/a>\u00a0from around New Mexico\u00a0have spoken out <a href=\"http:\/\/nmpolitics.net\/index\/2017\/04\/former-gov-carruthers-pushes-back-against-higher-education-veto\/\" target=\"_blank\" rel=\"noopener noreferrer\">against the veto<\/a>.
