Susana Martinez<\/p><\/div>\n<h4>\u2018If you\u2019re setting the ethical bar based on the Richardson administration, you are setting it way too low,\u2019 Journal reporter writes<\/h4>\n<p>The Albuquerque Journal is expressing serious concerns about the Martinez administration\u2019s awarding of a 25-year lease for the racino at the state fair grounds.<\/p>\n<p>Over the weekend, the Journal explained in a commentary from one reporter and a separate newspaper editorial why it\u2019s concerned about the awarding of the lease by Gov. <a href=\"http:\/\/governor.state.nm.us\/\" target=\"_blank\">Susana Martinez\u2019s<\/a> administration to the Downs at Albuquerque.<\/p>\n<p>From <a href=\"http:\/\/www.abqjournal.com\/main\/2011\/11\/26\/upfront\/downs-deal-smells-of-money.html\" target=\"_blank\">Thomas Cole\u2019s weekend commentary<\/a>:<\/p>\n<blockquote><p>\u201cIndividuals and a company connected to the Downs at Albuquerque racetrack and casino gave at least $70,000 to Martinez\u2019s campaign last year. (Martinez opponent Diane Denish got $50,000.) The State Fair Commission this week approved a Martinez administration deal to give the Downs a new 25-year lease at Expo New Mexico.<\/p>\n<p>\u201cThe question is whether the deal serves our interests or the interests of the Downs and Martinez. Maybe it\u2019s in everybody\u2019s interests. Who knows? One thing is certain: The administration didn\u2019t do enough to build public confidence in the new lease.\u201d<\/p><\/blockquote>\n<p>Why not? As Cole points out, the administration is quick to defend the process by noting that it put the lease out to bid, while the Richardson administration \u201csimply wanted to give it to the Downs without bidding.\u201d<\/p>\n<p>\u201cBut if you\u2019re setting the ethical bar based on the Richardson administration, you are setting it way too low,\u201d Cole wrote.<\/p>\n<p>Among the issues:<!--more--><\/p>\n<ul>\n<li>Expo New Mexico, which runs the property, issued a request for proposals without input from the State Fair Commission, even though the commission had to approve the lease.<\/li>\n<li>Given 30 days to submit proposals, only two companies bid on the lease. According to Cole, \u201cRFPs are supposed to spur competition, and when they don\u2019t, it\u2019s the job of government managers to figure out why. The administration should have examined the RFP for reasons why it didn\u2019t attract more interest, made any needed changes, then reissued it. That is standard practice in government when an RFP doesn\u2019t attract expected interest.\u201d<\/li>\n<\/ul>\n<p>Cole asserts that there should have been more interest in the lease, given that it was for a casino in the middle of Albuquerque. He asks why national gaming companies didn\u2019t submit bids.<\/p>\n<p>\u201cMakes you wonder whether the administration wanted others to submit proposals,\u201d Cole wrote.<\/p>\n<p>In <a href=\"http:\/\/www.abqjournal.com\/main\/2011\/11\/28\/opinion\/new-lease-for-downs-wasnt-a-horse-race.html\" target=\"_blank\">its editorial<\/a>, the Journal wrote that the lease deal has \u201cbeen hotly contested by members of the New Mexico State Fair Commission, state lawmakers, the Legislative Finance Committee and fairgrounds neighbors as creepily secretive, rushed and exclusionary to all but administration insiders.\u201d And it wrote that the State Fair Commission \u201cfed that criticism\u201d last week when it \u201cworked some procedural magic and voted on the lease even though the meeting initially was set up as a discussion workshop and the vote initially planned for Dec. 1.\u201d<\/p>\n<p>Actually, the vote to approve the lease was initially set for the commission\u2019s Nov. 9 meeting but was delayed, the Journal wrote, \u201cbecause it looked as though it was going to fail.\u201d Then the proposal \u201cwas reintroduced via some procedural jockeying last Monday.\u201d<\/p>\n<p>The process, according to the Journal, \u201csmacks of discounting any discussion in favor of stacking the deck for an insider.\u201d<\/p>\n<p>What now?
