{"id":3264,"date":"2008-05-22T13:00:00","date_gmt":"2008-05-22T19:00:00","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/2008\/05\/guv-applauds-decision-to-disallow-casino-near-cruces\/"},"modified":"2008-05-22T13:00:00","modified_gmt":"2008-05-22T19:00:00","slug":"guv-applauds-decision-to-disallow-casino-near-cruces","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2008\/05\/guv-applauds-decision-to-disallow-casino-near-cruces\/","title":{"rendered":"Guv applauds decision to disallow casino near Cruces"},"content":{"rendered":"<p><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/4.bp.blogspot.com\/_IabUCQmoheQ\/SDNDsYyZvAI\/AAAAAAAAFzU\/D1uqDStngK8\/s1600-h\/Richardson,+Bill.jpg\"><img decoding=\"async\" style=\"margin: 0pt 10px 10px 0pt; float: left; cursor: pointer;\" src=\"http:\/\/4.bp.blogspot.com\/_IabUCQmoheQ\/SDNDsYyZvAI\/AAAAAAAAFzU\/D1uqDStngK8\/s200\/Richardson,+Bill.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5202576424390212610\" border=\"0\" \/><\/a><\/p>\n<p class=\"MsoNormal\">The <a href=\"http:\/\/www.nigc.gov\/\" target=\"_blank\">National Indian Gaming Commission<\/a> has concluded than an Oklahoma Indian tribe can\u2019t legally operate a casino on trust land it owns between Deming and <st1:city st=\"on\"><st1:place st=\"on\">Las Cruces<\/st1:place><\/st1:city> &#8212; a decision Gov. <a href=\"http:\/\/governor.state.nm.us\/\" target=\"_blank\">Bill Richardson<\/a> is applauding.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cThis federal decision is clear and unambiguous \u2013 and it is a victory for the people of <st1:state st=\"on\">New Mexico<\/st1:state>, who are opposed to an expansion of gaming beyond what has already been negotiated,\u201d <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city> said in a news release. \u201cThe Fort Sill Apaches will violate federal law if they move forward with an illegal casino in southern <st1:state st=\"on\"><st1:place st=\"on\">New Mexico<\/st1:place><\/st1:state>. I have directed the state police and the Gaming Control Board to remain vigilant and block access if they attempt to open a casino.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The <a href=\"http:\/\/fortsillapache.com\/\" target=\"_blank\">Fort Sill Apache Tribe<\/a> planned earlier this year to open a bingo parlor on land near Akela Flats that was taken into federal trust in 2002 with the condition that it not be used for gaming. Though the tribe said it now meets the requirements for an off-reservation casino exemption, <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city> disagreed and ordered the state police to block public access to the facility in February. At the time, the gaming commission wrote <a href=\"http:\/\/www.haussamen.com\/FtSillLetter.pdf\" target=\"_blank\">a letter<\/a> to the tribe stating that it should not open the casino because it had preliminarily concluded that gaming would not be allowed on the land.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">This week, the commission made that decision final.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><st1:city st=\"on\">Richardson<\/st1:city> was backed by both of <st1:state st=\"on\">New Mexico<\/st1:state>\u2019s <st1:country-region st=\"on\"><st1:place st=\"on\">U.S.<\/st1:place><\/st1:country-region> senators and the state attorney general when he fought the opening of the bingo parlor earlier this year. On Tuesday, the commission agreed with the governor\u2019s assertion that the tribe failed to meet any exception that would allow it to operate a gaming facility on the land.<\/p>\n<p class=\"MsoNormal\">\n<p class=\"MsoNormal\">When the land was taken into federal trust for the tribe in June 2002, it was done with the explicit condition that it was not to be used for gaming purposes. Former Gov.
