Supreme Court Chief Justice Charles W. Daniels<\/p><\/div>\n<p>A statement in a law enforcement report might imply that the chief justice of the N.M. Supreme Court may have paid a bribe in exchange for his judgeship, but <a href=\"http:\/\/nmsupremecourt.nmcourts.gov\/bios\/daniels.htm\" target=\"_blank\">Charles W. Daniels<\/a> says he did no such thing.<\/p>\n<p>\u201cI did not buy this position,\u201d Daniels told NMPolitics.net. \u201cNo one ever asked me to, and I never would have entertained the idea.\u201d<\/p>\n<p>The implication about Daniels comes from a statement attributed to Third Judicial District Judge Mike Murphy, who was <a href=\"http:\/\/www.nmpolitics.net\/index\/2011\/05\/murphy-charged-with-bribery-other-felonies\/\" target=\"_blank\">indicted earlier this month<\/a> on bribery charges stemming from <a href=\"http:\/\/www.nmpolitics.net\/index\/2011\/05\/report-details-allegations-against-murphy\/\" target=\"_blank\">allegations of widespread judicial bribery<\/a>. Murphy was allegedly talking with Norm Osborn, the Third Judicial District Court\u2019s staff attorney, when he said this:<\/p>\n<p>\u201cJudge Murphy also stated that if he was guilty of buying a judgeship, then what does that make Chief Justice (Charlie) Daniels.\u201d<\/p>\n<p>The statement is included in <a href=\"http:\/\/nmpolitics.net\/Documents\/MurphyIndictmentReport.pdf\" target=\"_blank\">a public incident report<\/a> detailing the allegations against Murphy. There\u2019s no context for the statement or any other clues about what Murphy might believe Daniels did.<\/p>\n<p>While cautioning that it would be inappropriate for him to comment on the case against Murphy because he has a role in reviewing the judicial process \u2013 he\u2019s already twice appointed judges to oversee the case \u2013 Daniels rejected any notion that he did or would pay a bribe for a judicial appointment.<\/p>\n<p>\u201cI don\u2019t know who said what in all these multiple hearsay layers of he-said, she-said,\u201d Daniels told NMPolitics.net. \u201cBut I do know if anybody claims I bought my position, they don\u2019t know what they\u2019re talking about, they don\u2019t know my qualifications for this job, and they certainly don\u2019t know my character.\u201d<!--more--><\/p>\n<p>Law enforcement reports allege that <a href=\"http:\/\/www.nmpolitics.net\/index\/wp-admin\/Law%20enforcement%20reports%20quote%20Murphy%20as%20allegedly%20saying%20he%20paid%20money%20in%20exchange%20for%20his%20appointment%20from%20former%20Gov.%20Bill%20Richardson%20in%202006,%20and%20that%20he%20told%20another%20potential%20judicial%20applicant%20that%20she%20had%20to%20do%20the%20same.%20The%20money%20allegedly%20went%20to%20Las%20Cruces%20politico%20Edgar%20Lopez,%20who%20Murphy%20said%20gave%20it%20to%20Richardson.%20It%25E2%2580%2599s%20worth%20noting%20that%20Murphy%20is%20charged%20with%20soliciting%20a%20bribe%20from%20the%20potential%20applicant%20but%20not%20with%20paying%20a%20bribe%20for%20his%20position.\" target=\"_blank\">Murphy said he paid money<\/a> in exchange for his appointment from former Gov. <a href=\"http:\/\/en.wikipedia.org\/wiki\/Bill_Richardson\" target=\"_blank\">Bill Richardson<\/a> in 2006, and that he told another potential judicial applicant that she had to do the same. The money allegedly went to Las Cruces politico Edgar Lopez, who Murphy said gave it to Richardson. It\u2019s worth noting that Murphy is charged with soliciting a bribe from the potential applicant but not with paying a bribe for his position.<\/p>\n<p>Though Murphy allegedly said he gave $4,000 to Richardson in exchange for his appointment, NMPolitics.net has been able to locate only $410 in campaign contributions from Murphy and his wife.<\/p>\n<p>Witness statements aren\u2019t clear about whether Murphy\u2019s alleged bribe was a campaign contribution or simply a cash payment.<\/p>\n<p>No one besides Murphy has been charged or received notice that they may be indicted, but the investigation is ongoing. The <a href=\"http:\/\/www.abqjournal.com\/news\/state\/21031599516newsstate05-21-11.htm\" target=\"_blank\">Albuquerque Journal<\/a> quoted special prosecutor <a href=\"http:\/\/www.da.state.nm.us\/districts\/ninth\/index.html\" target=\"_blank\">Matt Chandler<\/a> last week as saying that the \u201cboundaries\u201d of the investigation \u201chave expanded,\u201d but he wouldn\u2019t explain how.<\/p>\n<p>Richardson appointed Daniels in 2007 after Daniels was among a handful of candidates recommended by a bipartisan nominating commission. Daniels has been a lawyer for 38 years in the Albuquerque area and has taught at the University of New Mexico School of Law.<\/p>\n<p>According to <a href=\"http:\/\/www.followthemoney.org\/\" target=\"_blank\">FollowTheMoney.org<\/a>, Daniels gave $200 to Richardson\u2019s gubernatorial re-election campaign in 2006. His wife, attorney Randi McGinn, gave $3,000 to Richardson in 2002 and $5,000 to Richardson in 2006.<\/p>\n<h3>Update, 10:15 a.m.<\/h3>\n<p>McGinn also gave $2,300 to Richardson\u2019s presidential campaign in February 2007, according to <a href=\"http:\/\/www.opensecrets.org\/\" target=\"_blank\">OpenSecrets.org<\/a>.<\/p>\n<p><em>A prior version of this article incorrectly stated that Murphy is charged with paying a bribe for his position.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>UPDATED: A statement in a law enforcement report might imply that the N.M.
