{"id":2932,"date":"2008-02-29T17:09:00","date_gmt":"2008-02-29T23:09:00","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/2008\/02\/lyons-disputes-ag-opinion-on-cruces-land-deal\/"},"modified":"2008-02-29T17:09:00","modified_gmt":"2008-02-29T23:09:00","slug":"lyons-disputes-ag-opinion-on-cruces-land-deal","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2008\/02\/lyons-disputes-ag-opinion-on-cruces-land-deal\/","title":{"rendered":"Lyons disputes AG opinion on Cruces land deal"},"content":{"rendered":"<p><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/1.bp.blogspot.com\/_IabUCQmoheQ\/R8iQ32Oj3vI\/AAAAAAAAFHo\/BKKRVNI2QJo\/s1600-h\/Lyons,+Pat.jpg\"><img decoding=\"async\" style=\"margin: 0pt 0pt 10px 10px; float: right; cursor: pointer;\" src=\"http:\/\/1.bp.blogspot.com\/_IabUCQmoheQ\/R8iQ32Oj3vI\/AAAAAAAAFHo\/BKKRVNI2QJo\/s200\/Lyons,+Pat.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5172543461158805234\" border=\"0\" \/><\/a>State Land Commissioner <a href=\"http:\/\/www.nmstatelands.org\/default.aspx?PageID=2\" target=\"_blank\">Pat Lyons<\/a> is disputing a legal opinion the attorney general released this week that found fault with a Las Cruces land deal between the State Land Office and developer Philip Philippou.  <\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><st1:city st=\"on\"><st1:place st=\"on\">Lyons<\/st1:place><\/st1:city>\u2019 legal staff, according to a news release, believes that, unless there is a specific law prohibiting an action by the land commissioner, he is \u201cvested with discretion in the exercise of his duties to generate revenue for public education.\u201d That includes the discretion to determine how to market, lease or sell trust lands, the release states.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cWhile I appreciate the attorney general\u2019s input, this opinion attempts to constrain my authority and ability to perform my constitutional duties,\u201d <st1:city st=\"on\"><st1:place st=\"on\">Lyons<\/st1:place><\/st1:city> said in the release. \u201cConsequently, I will continue to perform and execute my duties to the best of my ability, consistent with my oath of office, which is to generate revenue for public schools and universities. The lease in question stands to earn hundreds of millions of dollars for <st1:state st=\"on\"><st1:place st=\"on\">New Mexico<\/st1:place><\/st1:state>\u2019s school children.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Attorney General <a href=\"http:\/\/www.nmag.gov\/office\/Divisions\/EO\/kingbio.aspx\" target=\"_blank\">Gary King\u2019s<\/a> office has said he has no plans to try to enforce the opinion in court, but has said another party with legal standing could sue. The <a href=\"http:\/\/www.las-cruces.org\/council\/\" target=\"_blank\">Las Cruces City Council<\/a> is expected to discuss the possibility, but whether it would have legal standing isn\u2019t clear.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">King\u2019s <a href=\"http:\/\/www.haussamen.com\/AGOpinionOnSoloLandDeal.pdf\" target=\"_blank\">long-awaited opinion<\/a> states that the <a href=\"http:\/\/www.haussamen.com\/LandOfficeAgreement.pdf\" target=\"_blank\">lease agreement\u2019s<\/a> method of compensating Philippou\u2019s <a href=\"http:\/\/www.nmprc.state.nm.us\/cgi-bin\/prcdtl.cgi?2439107+SOLO+INVESTMENTS+LLC\" target=\"_blank\">Solo Investments<\/a> for developing The Vistas at Presidio is \u201cnot comprehended by and in conflict with\u201d a statute that allows developers who improve land for the state to be compensated only for the appraised value of the improvements. In the lease, the land office also agrees to compensate Philippou for other project costs and 40 percent of the change in value of the land as a result of the improvements.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">While King said portions of the compensation provision in the lease agreement are not authorized by state law, he didn\u2019t use the word illegal to describe the agreement, saying the issue of whether it is enforceable should be determined by the courts.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p style=\"font-weight: bold;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">Conflicting views<\/span><\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The AG opinion, authored by Assistant Attorney General Andrea Buzzard, argues that the New Mexico Constitution gives the land commissioner authority over public lands \u201cunder the provisions of the acts of congress relating thereto and such regulations as may be provided by law.\u201d The opinion states that <st1:city st=\"on\"><st1:place st=\"on\">Lyons<\/st1:place><\/st1:city> \u201chas no authority to promulgate rules or regulations that are inconsistent with legislative enactments.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The opinion also states that state law only allows compensation to lessees for the appraised value of improvements to the land, not the other compensation <st1:city st=\"on\"><st1:place st=\"on\">Lyons<\/st1:place><\/st1:city> agreed to in the lease with Philippou.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">But <st1:city st=\"on\">Lyons<\/st1:city> cited a 1991 AG opinion stated that \u201c<st1:state st=\"on\"><st1:place st=\"on\">New Mexico<\/st1:place><\/st1:state>\u2019s courts have generally concluded that the commissioner has complete dominion over public lands limited only by the explicit restrictions in the state constitution, the Enabling Act and the statutes.\u201d King\u2019s opinion, the <st1:city st=\"on\"><st1:place st=\"on\">Lyons<\/st1:place><\/st1:city> release says, does not cite any statute or court decision that prohibits the relevant lease provisions.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The AG opinion does cite the <a href=\"http:\/\/www.conwaygreene.com\/nmsu\/lpext.dll?f=FifLink&amp;t=document-frame.htm&amp;l=query&amp;iid=3079d651.7afce11c.0.0&amp;q=%5BGroup%20%2719-7-14%27%5D\" target=\"_blank\">state statute<\/a> that says a purchaser of state land shall pay the lessee for the improvements, which the AG says are defined to include water rights and tangible improvements but not intangible improvements or other costs.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The bottom line: The AG says the provisions in the lease agreement are not authorized by and in conflict with state law but has not called the lease illegal or unenforceable. <st1:city st=\"on\"><st1:place st=\"on\">Lyons<\/st1:place><\/st1:city> claims that if the statute doesn\u2019t explicitly prohibit the terms of the lease, they are allowable.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p style=\"font-weight: bold;\" class=\"MsoNormal\">\n<p style=\"font-weight: bold;\" class=\"MsoNormal\"><span style=\"font-size:130%;\"><st1:city st=\"on\"><st1:place st=\"on\">Lyons<\/st1:place><\/st1:city> selling land in another Philippou development<\/span><\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><st1:place st=\"on\"><st1:city st=\"on\">Lyons<\/st1:city><\/st1:place> also pointed out in the news release that the land office\u2019s planning and development leases allow master-planned communities on state land that wouldn\u2019t otherwise be developed because the land office doesn\u2019t have its own budget for such projects. In exchange, <st1:city st=\"on\"><st1:place st=\"on\">Lyons<\/st1:place><\/st1:city> has agreed to share an \u201cimprovement value credit\u201d with the developers.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">In the case of The Vistas at Presidio, that means Philippou gets 40 percent of the change in value of the land because of the improvements he makes to the land. After the lessee finishes improvements, the land is put up for sale, and the lessee has to compete with other developers to buy it.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Such is currently the case with another development Philippou is creating in <st1:city st=\"on\"><st1:place st=\"on\">Las Cruces<\/st1:place><\/st1:city> for the land office, the Sierra Norte project north of Highway 70 and east of the Las Colinas subdivision. <st1:city st=\"on\"><st1:place st=\"on\">Lyons<\/st1:place><\/st1:city> is in the process of soliciting bids for 323 acres of land in that development along <st1:street st=\"on\"><st1:address st=\"on\">Sonoma Ranch Boulevard<\/st1:address><\/st1:street>.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">I\u2019ve requested, but not yet received, a copy of the lease agreement between the land office and Philippou for that development.
