{"id":2924,"date":"2008-02-28T15:34:00","date_gmt":"2008-02-28T21:34:00","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/2008\/02\/feds-tell-tribe-it-shouldnt-open-akela-flats-casino\/"},"modified":"2008-02-28T15:34:00","modified_gmt":"2008-02-28T21:34:00","slug":"feds-tell-tribe-it-shouldnt-open-akela-flats-casino","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2008\/02\/feds-tell-tribe-it-shouldnt-open-akela-flats-casino\/","title":{"rendered":"Feds tell tribe it shouldn&#8217;t open Akela Flats casino"},"content":{"rendered":"<p class=\"MsoNormal\">The <a href=\"http:\/\/www.nigc.gov\/\" target=\"_blank\">National Indian Gaming Commission<\/a> has informed to <a href=\"http:\/\/fortsillapache.com\/\" target=\"_blank\">Fort Sill Apache Tribe<\/a> that it should not open its planned casino at Akela Flats.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The action comes a day after Gov. <a href=\"http:\/\/governor.state.nm.us\/\" target=\"_blank\">Bill Richardson<\/a> ordered state police to block public access to the planned high-stakes bingo parlor because the federal government had not ruled on its plans and <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city> had information that the tribe planned to open the facility as early as today.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">You can read the commission\u2019s letter to the tribe by clicking <a href=\"http:\/\/www.haussamen.com\/FtSillLetter.pdf\" target=\"_blank\">here<\/a>. It states that the commission has not made a final determination but has preliminarily concluded that gaming will not be allowed on the land.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The tribe plans to open a bingo parlor on land that was taken into federal trust in 2002 with the condition that it was not to be used for gaming. The state disagrees with the tribe\u2019s assertion that it now meets the requirements for an exemption to allow an off-reservation casino.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The commission, a least preliminarily, agrees with the state.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201c\u2026 the tribe may violate the Indian Gaming Regulatory Act (IGRA) if it opens a gaming operation on the <st1:place st=\"on\"><st1:placename st=\"on\">Luna<\/st1:placename> <st1:placetype st=\"on\">County<\/st1:placetype><\/st1:place> lands,\u201d the letter states.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city>, in a news release, praised the commission\u2019s action.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cToday\u2019s ruling is crucial, because it is our understanding that the Fort Sill Apaches were going to attempt to open the facility for a few hours today in an attempt to the legitimize the operation,\u201d he said. \u201cThe gaming commission\u2019s letter makes it clear that federal officials will not recognize that move, and it will be considered illegal.\u201d<\/p>\n<p class=\"MsoNormal\">\n<p class=\"MsoNormal\"><st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city> ordered state police to block access to the casino Wednesday after receiving no assurances from the federal government that it would either approve or reject the tribe\u2019s plans to open the facility.<\/p>\n<p class=\"MsoNormal\">\n<p class=\"MsoNormal\">\u201cI am pleased that the federal government took our warnings seriously \u2013 the people of <st1:state st=\"on\">New Mexico<\/st1:state> will not tolerate an illegal gaming enterprise,\u201d <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city> said. \u201cThe Fort Sill Apaches erected a facility with high-stakes gaming machines and hired employees with the clear intent to operate this illegal gaming enterprise.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The tribe, in a <a href=\"http:\/\/www.fortsillapache.com\/content\/view\/6\/1\/\" target=\"_blank\">news release<\/a>, accused <st1:place st=\"on\"><st1:city st=\"on\">Richardson<\/st1:city><\/st1:place> of a \u201cblatant violation of the United States Constitution\u2019s Interstate Commerce and Supremacy clauses. In a shocking and threatening manner, workers, tribal employees and tribal members were forced off federal Indian trust property by the Richardson Administration in a manner that smacked of Jim Crow oppression in the south and Governor Wallace blocking the school house door at the <st1:place st=\"on\"><st1:placetype st=\"on\">University<\/st1:placetype> of <st1:placename st=\"on\">Alabama<\/st1:placename><\/st1:place> in the 1960s.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><st1:country-region st=\"on\">U.S.<\/st1:country-region> Sens. <a href=\"http:\/\/bingaman.senate.gov\/\" target=\"_blank\">Jeff Bingaman<\/a> and <a href=\"http:\/\/domenici.senate.gov\/\" target=\"_blank\">Pete Domenici<\/a> supported <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city>\u2019s efforts.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cI am ready if necessary to propose federal legislation to remedy this situation. It is just not right for the Fort Sill Apaches to open a gaming operation on lands in New Mexico that were never intended for such use,\u201d Domenici said in a statement released before the commission\u2019s letter was announced publicly. \u201cThe Indian Gaming Commission should expedite its review of this case and affirm that there never was any intent for this trust property to be used as a gaming site. I think Governor Richardson has every right to take action to stop this activity.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cI fully support Gov. Richardson\u2019s action,\u201d Bingaman said. \u201cI believe the state has the right to insist that any gaming that occurs in <st1:state st=\"on\"><st1:place st=\"on\">New Mexico<\/st1:place><\/st1:state> be done in accordance with our state laws.
