If violations exist, they will be dealt with accordingly.\u201d You might recall that, because of the ordinance, state Land Commissioner Pat Lyons was <a href=\"http:\/\/haussamen.blogspot.com\/2006\/07\/city-says-lyons-campaign-signs-must.html\">ordered by the city<\/a> to take down several signs that were put up on private property more than 90 days before the 2006 general election.<\/p>\n<p class=\"MsoNormal\">\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">At the time, the Secretary of State\u2019s Office said local ordinances do apply to private property unless the ordinances specifically exempt private property.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Teague campaign spokesman Steve Fitzer said the campaign will take the signs down until next week if that is required, but he is waiting to hear back from the city\u2019s codes enforcement department.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cOf course it is interesting that a community would choose to limit an individual\u2019s free-speech rights on their own property,\u201d Fitzer said. \u201cWe researched most of the cities in this district and they do not do that.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The only other city I know of in the Second District that limits the time that campaign signs can be displayed on private property is Ruidoso. In <st1:city st=\"on\"><st1:place st=\"on\">Las Cruces<\/st1:place><\/st1:city>, codes officers can remove signs if they impede traffic, but otherwise will issue citations to property owners who don\u2019t take them down. The maximum fine is $500.<\/p>\n<p class=\"MsoNormal\">\n<p style=\"font-weight: bold;\" class=\"MsoNormal\">Update, 5 p.m.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Moore forwarded an e-mail from the city\u2019s legal department confirming that there is a violation of the sign ordinance. The e-mail states that the city will \u201cseek compliance\u201d with the ordinance on Tuesday.<\/p>\n<p class=\"MsoNormal\">\n<p style=\"font-weight: bold;\" class=\"MsoNormal\">Update, 5:25 p.m.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Fitzer said the signs are coming down and will stay down until March 5.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Second Congressional District candidate Harry Teague\u2019s campaign began putting up large signs around Las Cruces this weekend, but that appears to violate a city ordinance and the signs may have to be taken down for a few days.
