{"id":2860,"date":"2008-02-12T08:54:00","date_gmt":"2008-02-12T14:54:00","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/2008\/02\/ag-says-denishs-acceptance-of-funding-bills-was-valid\/"},"modified":"2008-02-12T08:54:00","modified_gmt":"2008-02-12T14:54:00","slug":"ag-says-denishs-acceptance-of-funding-bills-was-valid","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2008\/02\/ag-says-denishs-acceptance-of-funding-bills-was-valid\/","title":{"rendered":"AG says Denish&#8217;s acceptance of funding bills was valid"},"content":{"rendered":"<p><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/4.bp.blogspot.com\/_IabUCQmoheQ\/R7Gzl3rNjGI\/AAAAAAAAE6o\/cM2u-khX-0g\/s1600-h\/King,+Gary.jpg\"><img decoding=\"async\" style=\"margin: 0pt 0pt 10px 10px; float: right; cursor: pointer;\" src=\"http:\/\/4.bp.blogspot.com\/_IabUCQmoheQ\/R7Gzl3rNjGI\/AAAAAAAAE6o\/cM2u-khX-0g\/s200\/King,+Gary.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5166107710752394338\" border=\"0\" \/><\/a>Attorney General <a href=\"http:\/\/www.nmag.gov\/office\/Divisions\/EO\/kingbio.aspx\" target=\"_blank\">Gary King<\/a> said late Monday that the lieutenant governor\u2019s Saturday acceptance of funding bills on behalf of the governor was valid and did start the clock on the time the governor has to act on them.  <\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">King was responding to a <a href=\"http:\/\/www.haussamen.com\/AG_Denish_bill_acceptance2.pdf\" target=\"_blank\">request for an opinion<\/a> from Paula Tackett, director of the Legislative Council Service.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cMy attorneys have been working on this question and have found nothing in state law or these circumstances that would prohibit the lieutenant governor from accepting legislation on behalf of the governor and starting the clock on the time that the governor has to consider it,\u201d King said in a news release.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">You can read the AG\u2019s letter, written by Assistant Attorney General Elizabeth Glenn, by clicking <a href=\"http:\/\/haussamen.com\/AG_Denish_bill_acceptance.pdf\" target=\"_blank\">here<\/a>. Gov. <a href=\"http:\/\/governor.state.nm.us\/\" target=\"_blank\">Bill Richardson\u2019s<\/a> office did not immediately respond to an after-hours request for comment.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Lt. Gov. <a href=\"http:\/\/www.ltgovernor.state.nm.us\/\" target=\"_blank\">Diane Denish<\/a> on Saturday accepted the <a href=\"http:\/\/legis.state.nm.us\/lcs\/_session.asp?chamber=S&amp;type=++&amp;number=165&amp;Submit=Search&amp;year=08\" target=\"_blank\">junior budget<\/a> and <a href=\"http:\/\/legis.state.nm.us\/lcs\/_session.asp?chamber=H&amp;type=++&amp;number=43&amp;Submit=Search&amp;year=08\" target=\"_blank\">capital outlay<\/a> bills at about 6 p.m. on behalf of the governor. The bills received final legislative approval earlier in the afternoon. Attempts by legislative staffers to contact the governor\u2019s office between 4:30 p.m. and 5:30 p.m. were unsuccessful even though \u201cthe Senate was still on the floor and legislative staff had informed the governor\u2019s office, as part of their normal routine, that bills would be presented on Saturday afternoon or evening,\u201d Tackett wrote in her letter to King.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The attempts were unsuccessful because <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city>\u2019s office had closed and staffers could not be reached.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The New Mexico Constitution gives <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city> three days, excluding Sundays, to act on any bill sent to him before the third-to-last day of the session. If there\u2019s no action, the bill goes into law without his signature. Denish\u2019s action, if valid, would give <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city> until 6 p.m. Wednesday to act.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">But <st1:city st=\"on\">Richardson<\/st1:city>\u2019s chief of staff, James Jimenez, sent a letter to the Senate on Saturday stating that Denish did not have authority to accept the bills because she is not a member of <st1:city st=\"on\">Richardson<\/st1:city>\u2019s staff and <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city> was in the state on Saturday, so she did not have the authority to act as governor.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">With the session ending at noon Thursday, the dispute is important because the 6 p.m. Wednesday deadline would give lawmakers time to analyze the governor\u2019s line-item vetoes \u2013 if he makes any \u2013 and attempt to override some or all of them.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\n<p class=\"MsoNormal\">Glenn wrote that it\u2019s not clear whether the constitution requires the governor to keep his office open or make himself available at all times during the session to accept bills, but the governor cannot intentionally evade the Legislature\u2019s attempts to present bills \u2013 which is what several senators are accusing him of doing in this instance. Jimenez told me Sunday that the office was closed because several senators had told a <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city> staffer they were going home.<\/p>\n<p class=\"MsoNormal\">\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Senators threatened to quit passing other bills and go home on Saturday in an attempt to push the house to act on the junior budget bill.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Glenn also wrote that, because <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city> had not previously notified the Legislature that Denish was not authorized to accept bills on his behalf, it was reasonable for the Legislature to assume that she could accept the bills.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Sen. <a href=\"http:\/\/legis.state.nm.us\/lcs\/legdetails.asp?Name=288&amp;Submit=Search\" target=\"_blank\">John Arthur Smith<\/a>, D-Deming and chair of the Senate Finance Committee, has said Senate leaders will take <st1:place st=\"on\"><st1:city st=\"on\">Richardson<\/st1:city><\/st1:place> to court if he attempts to act on the bills after 6 p.m. on Wednesday.<\/p>\n<p class=\"MsoNormal\">\n<p style=\"font-style: italic;\" class=\"MsoNormal\">\n<p style=\"font-style: italic;\" class=\"MsoNormal\">\n<p style=\"font-style: italic;\" class=\"MsoNormal\">A prior version of this posting incorrectly cited a New Mexico Supreme Court ruling in stating that the AG believes <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:City> can\u2019t intentionally evade acceptance of the bills.
