Not ethics reform. Even though legislative leaders have said they will allow deliberation on four ethics-reform issues \u2013 campaign contribution limits, an ethics commission, additional funding for the Secretary of State\u2019s online reporting system and funding for a study on creation of an election commission \u2013 the proposals are getting a late start in a 30-day session that will be largely consumed by funding bills and health-care reform.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">It\u2019s no secret that many lawmakers are resistant to ethics reform. There\u2019s an additional factor at play this year.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cThe leadership doesn\u2019t want any ethics bills to fail in a highly public way and in an election year,\u201d one lawmaker told me.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The majority of lawmakers agreed last year to place limits on contributions to individuals, but they couldn\u2019t agree on whether to also place limits on contributions to political action committees and political parties, so the proposal died.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The same debate will bog down the proposal this year. It will take determination to get that bill approved.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The ethics commission proposal promises to be even more contentious. Though Gov. <a href=\"http:\/\/governor.state.nm.us\/\" target=\"_blank\">Bill Richardson\u2019s<\/a> ethics task force has worked to address the concerns of senators who don\u2019t want the governor extending his reach any further into their territory, the proposal will be viewed in that chamber with skepticism by some and disdain by many.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The House approved the commission last year but didn\u2019t fund it.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">There is, on the other hand, widespread support for increasing funding for the Secretary of State\u2019s campaign finance reporting and disclosure system. This is one proposal that should pass and allow the creation of an online database that is easily accessible, user-friendly and searchable.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The other proposals will have a much more difficult time. Some lawmakers I spoke with think the Legislature may approve limits on contributions to individuals, but they are less certain about the chances for placing limits on contributions to PACs and political parties. I\u2019ve spoken to none who are optimistic about approval of an ethics commission.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p style=\"font-weight: bold;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">Proposals that aren\u2019t gaining traction<\/span><\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">A proposal to expand the state\u2019s system for public financing of campaigns isn\u2019t gaining any traction. Though the governor\u2019s task force endorsed an expansion of the system, legislative leaders don\u2019t plan to consider the issue this year.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">And <st1:city st=\"on\">Richardson<\/st1:city> doesn\u2019t appear to be pushing that hard, despite the fact that he called for public financing frequently when he was on the presidential campaign trail and told caucus goers in <st1:city st=\"on\">Dubuque County<\/st1:city>, <st1:state st=\"on\">Iowa<\/st1:state> <a href=\"http:\/\/www.haussamen.com\/GuvLetter.jpg\" target=\"_blank\">in a Dec. 17 letter<\/a> that he would seek expanded public financing in <st1:state st=\"on\"><st1:place st=\"on\">New Mexico<\/st1:place><\/st1:state> during this legislative session.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The proposal to open legislative conference committees to the public \u2013 which twice died by one vote in the Senate in 2007 \u2013 is another that legislative leaders won\u2019t allow deliberation on this year. It\u2019s one whose death always gains a lot of attention from the media.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Many lawmakers would like to avoid that attention in an election year.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p style=\"font-weight: bold;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">Election-year pressure<\/span><\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">There are a number of incumbents in both parties with serious challengers this election year, including two in <st1:city st=\"on\">Las  Cruces<\/st1:city>, two in <st1:city st=\"on\">Roswell<\/st1:city> and two in <st1:city st=\"on\"><st1:place st=\"on\">Albuquerque<\/st1:place><\/st1:city>. There is always pressure during election years for the Legislature to avoid major policy issues so it doesn\u2019t give ammunition to challengers.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Perhaps that\u2019s why the state Constitution puts 30-day sessions in election years and 60-day sessions in off years. Most policy changes are deliberated in the longer sessions.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Still, it remains true that the vast majority of New Mexicans want significant ethics reform. Several polls have confirmed this. There\u2019s always a chance that voters will lash out at lawmakers in June and November for avoiding ethics reform during the session.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">There are efforts to place further pressure on lawmakers. Steven Allen, the director of <a href=\"http:\/\/www.commoncause.org\/site\/pp.asp?c=dkLNK1MQIwG&amp;b=1687807\" target=\"_blank\">New Mexico Common Cause<\/a>, will appear Sunday at 10 a.m. on <a href=\"http:\/\/kob.com\/article\/10106\/\" target=\"_blank\">Eye on New Mexico<\/a>, a television program that airs on KOB-TV in <st1:city st=\"on\"><st1:place st=\"on\">Albuquerque<\/st1:place><\/st1:city> (channel 4), to promote public financing, contribution limits and an ethics commission during a panel discussion with others.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The first step is going to be getting lawmakers to introduce the ethics-reform bills.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Proponents of ethics reform have reason to hope the Legislature might approve a couple of proposals during the current session, but those who are hoping for significant, widespread change are likely to be disappointed when the House and Senate adjourn on Feb. 14.
