{"id":26789,"date":"2011-03-03T16:56:46","date_gmt":"2011-03-03T23:56:46","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/?p=26789"},"modified":"2011-03-04T10:36:20","modified_gmt":"2011-03-04T17:36:20","slug":"duran-says-martinez-ads-didn%e2%80%99t-violate-law","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2011\/03\/duran-says-martinez-ads-didn%e2%80%99t-violate-law\/","title":{"rendered":"Duran says Martinez ads didn\u2019t violate law"},"content":{"rendered":"<div id=\"attachment_22027\"  class=\"wp-caption module image alignright\" style=\"max-width: 250px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-22027\" title=\"Duran, Dianna\" src=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2010\/09\/Duran-Dianna.jpg\" alt=\"\" width=\"250\" height=\"231\" \/><\/a><p class=\"wp-caption-text\">Secretary of State Dianna Duran<\/p><\/div>\n<p>Secretary of State <a href=\"http:\/\/www.sos.state.nm.us\/sos-SecBio.html\" target=\"_blank\">Dianna Duran<\/a> ruled today that Gov. <a href=\"http:\/\/www.governor.state.nm.us\" target=\"_blank\">Susana Martinez<\/a> didn\u2019t violate state law by using campaign funds to pay for radio ads pushing lawmakers to approve legislation would make it illegal for undocumented immigrants to obtain driver\u2019s licenses.<\/p>\n<p>\u201cI have no reasonable belief that the Susana Martinez for Governor Committee committed any violation of the Campaign Reporting Act, and I do not intend to refer this matter to the Attorney General or district attorney,\u201d Duran wrote in a letter to Somos Un Pueblo Unido, one of two groups that complained about the ads.<\/p>\n<p>Read the letter <a href=\"http:\/\/nmpolitics.net\/Documents\/DuranLetterOnMartinez.PDF\" target=\"_blank\">here<\/a>.<\/p>\n<p>Duran said the Martinez campaign argued that the ads \u201cpromote the governor\u2019s issues and ideas, and that the promotion of such issues and ideas are a standard campaign activity.\u201d<\/p>\n<p>Martinez fit the definition of a candidate in the law, Duran wrote.<!--more--><\/p>\n<p>Martinez\u00a0has <a href=\"http:\/\/www.nmpolitics.net\/index\/2011\/02\/martinez-puts-full-weight-behind-driver%E2%80%99s-license-bill\/\" target=\"_blank\">put her full weight behind<\/a> legislation that would repeal the bill that allows undocumented immigrants to obtain driver\u2019s licenses. That included the radio ads paid for by her campaign urging people to call their lawmakers to lobby for repeal of the law (listen\u00a0<a href=\"http:\/\/www.youtube.com\/watch?v=OLIeX09buM0\" target=\"_blank\">here<\/a>) and robocalls from the state GOP.<\/p>\n<p>Common Cause was the other group to complain about the ads. In a news release sent late last week, Common Cause Executive Director Steven Robert Allen said the Campaign Reporting Act \u201cplaces strict limitations on how campaign funds can be used.\u201d<\/p>\n<p>\u201cFunding this kind of lobbying advertisement seems to be a clear violation of this statute,\u201d he said.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Secretary of State Dianna Duran ruled today that Gov.
