{"id":2370,"date":"2007-10-11T14:55:00","date_gmt":"2007-10-11T20:55:00","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/2007\/10\/four-legislators-sign-letter-to-ag-on-nmsu-foundation\/"},"modified":"2007-10-11T14:55:00","modified_gmt":"2007-10-11T20:55:00","slug":"four-legislators-sign-letter-to-ag-on-nmsu-foundation","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2007\/10\/four-legislators-sign-letter-to-ag-on-nmsu-foundation\/","title":{"rendered":"Four legislators sign letter to AG on NMSU Foundation"},"content":{"rendered":"<p><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/4.bp.blogspot.com\/_IabUCQmoheQ\/Rw6OCis9MKI\/AAAAAAAADq8\/8DZOESoNPhg\/s1600-h\/NMSU.jpg\"><img decoding=\"async\" style=\"margin: 0pt 0pt 10px 10px; float: right; cursor: pointer;\" src=\"http:\/\/4.bp.blogspot.com\/_IabUCQmoheQ\/Rw6OCis9MKI\/AAAAAAAADq8\/8DZOESoNPhg\/s200\/NMSU.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5120186000693080226\" border=\"0\" \/><\/a>Four state lawmakers have made good on their pledge to ask the attorney general for an opinion on whether the <a href=\"http:\/\/giving.nmsu.edu\/\" target=\"_blank\">New Mexico State University Foundation <\/a>can legally keep information about its donors secret.  <\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Reps. <a href=\"http:\/\/legis.state.nm.us\/lcs\/legdetails.asp?Name=323&amp;Submit=Search\" target=\"_blank\">Nate Cote<\/a>, <a href=\"http:\/\/legis.state.nm.us\/lcs\/legdetails.asp?Name=191&amp;Submit=Search\" target=\"_blank\">Mary Helen Garcia<\/a> and <a href=\"http:\/\/legis.state.nm.us\/lcs\/legdetails.asp?Name=321&amp;Submit=Search\" target=\"_blank\">Jeff Steinborn<\/a> and Sen. <a href=\"http:\/\/legis.state.nm.us\/lcs\/legdetails.asp?Name=277&amp;Submit=Search\" target=\"_blank\">Mary Kay Papen<\/a>, all from Las Cruces, signed the letter seeking a legal opinion, which was sent to the attorney general several days ago.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">You can read the entire letter by clicking <a href=\"http:\/\/www.haussamen.com\/LegislatorsLetter.pdf\" target=\"_blank\">here<\/a>.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The lawmakers don\u2019t take a stand in the letter on whether the records should be public, but point out that there has been some concern about the foundation\u2019s refusal to release such records and that the question has been raised in a number of states, with some courts determining that such records are public and others determining that they are not.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cIn such states as New Mexico, where neither the Legislature nor the courts have determined the applicability of open records laws to university foundations, attorneys general in at least nine states have issued opinions on the public status of their universities\u2019 affiliated foundations,\u201d the letter states. \u201c\u2026 We respectfully request a full exploration of whether or not the NMSU Foundation is subject to (the Inspection of Public Records Act) or the Open Meetings Act.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">You may recall that I asked the legislators to write the letter a couple of months ago after the university began using money from secret donors to boost the compensation of its president and former men\u2019s basketball coach. The university denied my request for information about the donors.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">In anticipation of the request, and because of a separate request I made, the attorney general\u2019s office has already begun consideration of the issue, and is also looking into whether the university violated government transparency laws in its handling of records requests and in the holding of a regents meeting that wasn\u2019t properly noticed.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Let me take this opportunity to thank <st1:place st=\"on\">Cote<\/st1:place>, Garcia, Papen and Steinborn for signing the letter.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Four state lawmakers have made good on their pledge to ask the attorney general for an opinion on whether the New Mexico State University Foundation can legally keep information about its donors secret.
