{"id":2302,"date":"2007-10-01T11:52:00","date_gmt":"2007-10-01T17:52:00","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/2007\/10\/transportation-commissioners-tied-to-tainted-projects\/"},"modified":"2007-10-01T11:52:00","modified_gmt":"2007-10-01T17:52:00","slug":"transportation-commissioners-tied-to-tainted-projects","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2007\/10\/transportation-commissioners-tied-to-tainted-projects\/","title":{"rendered":"Transportation commissioners tied to tainted projects"},"content":{"rendered":"<p><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/4.bp.blogspot.com\/_IabUCQmoheQ\/RwE0yyAds_I\/AAAAAAAADg0\/qD-h1Y_KX3I\/s1600-h\/Cope,+Johnny.jpg\"><img decoding=\"async\" style=\"margin: 0pt 10px 10px 0pt; float: left; cursor: pointer;\" src=\"http:\/\/4.bp.blogspot.com\/_IabUCQmoheQ\/RwE0yyAds_I\/AAAAAAAADg0\/qD-h1Y_KX3I\/s200\/Cope,+Johnny.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5116428698691417074\" border=\"0\" \/><\/a>The number of suspicious circumstances surrounding two <a href=\"http:\/\/www.nmshtd.state.nm.us\/\" target=\"_blank\">Department of Transportation<\/a><\/p>\n<p class=\"MsoNormal\"> building projects keeps growing.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The <a href=\"http:\/\/www.abqjournal.com\/news\/metro\/598629metro09-30-07.htm\" target=\"_blank\">Albuquerque Journal<\/a> reported this weekend on another tie between one of the defendants in the <st1:street st=\"on\"><st1:address st=\"on\">Bernalillo County Metro   Court<\/st1:address><\/st1:street> scandal and the DOT projects \u2013 this one involving two governor appointees to the state <a href=\"http:\/\/www.nmshtd.state.nm.us\/main.asp?secid=11395\" target=\"_blank\">Transportation Commission<\/a>.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/4.bp.blogspot.com\/_IabUCQmoheQ\/RwE0yyAdtAI\/AAAAAAAADg8\/Gome45EZvV8\/s1600-h\/Franken,+Jim.jpg\"><img decoding=\"async\" style=\"margin: 0pt 10px 10px 0pt; float: left; cursor: pointer;\" src=\"http:\/\/4.bp.blogspot.com\/_IabUCQmoheQ\/RwE0yyAdtAI\/AAAAAAAADg8\/Gome45EZvV8\/s200\/Franken,+Jim.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5116428698691417090\" border=\"0\" \/><\/a>Apparently, two commissioners \u2013 Johnny Cope of <st1:city st=\"on\">Hobbs<\/st1:city> and Jim Franken of <st1:city st=\"on\">Las Vegas<\/st1:city> \u2013 had the department call in a consultant to work on the redevelopment of its statewide headquarters in <st1:city st=\"on\">Santa Fe<\/st1:city> and another project, the redevelopment of a district office also located in <st1:city st=\"on\"><st1:place st=\"on\">Santa Fe<\/st1:place><\/st1:city>.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">That consultant was Michael Murphy, one of five defendants in the <st1:street st=\"on\"><st1:address st=\"on\">Metro Court<\/st1:address><\/st1:street> case.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Murphy acted as a right-hand man for former Court Administrator Toby Martinez, prosecutors allege. Prosecutors say the group bilked taxpayers out of a combined $4.2 million by inflating and falsifying invoices on the project. Three have pleaded guilty for their roles and five others, including <st1:city st=\"on\"><st1:place st=\"on\">Martinez<\/st1:place><\/st1:city> and former Senate President Manny Aragon, are facing felony charges including conspiracy, mail fraud and money laundering.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Prosecutors alleged in indicting Murphy several weeks ago that defendants tried to extend their scheme to a DOT project, but didn\u2019t specify which project. Transportation Secretary <a href=\"http:\/\/www.nmshtd.state.nm.us\/main.asp?secid=11380\" target=\"_blank\">Rhonda Faught<\/a> says it was the district office in <st1:city st=\"on\"><st1:place st=\"on\">Santa   Fe<\/st1:place><\/st1:city>.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Regardless, defendants in the metro court case had ties to both DOT projects. That and other circumstances have tainted the projects. Here\u2019s what we know:<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u2022 <st1:city st=\"on\"><st1:place st=\"on\">Martinez<\/st1:place><\/st1:city> was, for a time in 2005, project manager for the redevelopment of the DOT headquarters.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u2022 <st1:city st=\"on\">Martinez<\/st1:city> and a subcontractor who is under indictment in the metro court case, Raul Parra, flew, at the state\u2019s expense, with Faught to <st1:city st=\"on\"><st1:place st=\"on\">Dallas<\/st1:place><\/st1:city> in 2005 for a meeting on the project. That was done even though, according to the state, Parra was not officially involved in the project.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u2022 Murphy, at the suggestion of Cope and Franken, was given confidential bid documents in the spring of 2006 even though he never signed a contract to do work for DOT. When DOT learned later of Murphy\u2019s alleged role in the metro court scandal, it asked for the documents back, but Murphy refused to return them.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Murphy, the Journal reported, is a contributor to Gov. <a href=\"http:\/\/governor.state.nm.us\/\" target=\"_blank\">Bill Richardson<\/a>, having given $8,500 to his re-election campaign last year.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/1.bp.blogspot.com\/_IabUCQmoheQ\/RwE0zCAdtCI\/AAAAAAAADhM\/ob_EtNS5pqA\/s1600-h\/Peters,+Gerald.jpg\"><img decoding=\"async\" style=\"margin: 0pt 10px 10px 0pt; float: left; cursor: pointer;\" src=\"http:\/\/1.bp.blogspot.com\/_IabUCQmoheQ\/RwE0zCAdtCI\/AAAAAAAADhM\/ob_EtNS5pqA\/s200\/Peters,+Gerald.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5116428702986384418\" border=\"0\" \/><\/a>He\u2019s not the only contributor whose ties to a DOT project have raised eyebrows. The bidder originally selected for the headquarters project was Gerald Peters, a longtime financial supporter of the governor who donated to and held a fundraiser for the governor\u2019s presidential campaign while the negotiations were ongoing. Were <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city> running in a state race, such contributions would be illegal.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Peters has not been directly tied to the metro court defendants. You can read Peters\u2019 comments about the project by clicking <a href=\"http:\/\/haussamen.blogspot.com\/2007\/09\/dot-bid-has-integrity-but-new-process.html\">here<\/a>.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p style=\"font-weight: bold;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">Situation needs investigation, not damage control<\/span><\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/1.bp.blogspot.com\/_IabUCQmoheQ\/RwE0zCAdtBI\/AAAAAAAADhE\/lVQ4xOGISOc\/s1600-h\/Richardson,+Bill.jpg\"><img decoding=\"async\" style=\"margin: 0pt 10px 10px 0pt; float: left; cursor: pointer;\" src=\"http:\/\/1.bp.blogspot.com\/_IabUCQmoheQ\/RwE0zCAdtBI\/AAAAAAAADhE\/lVQ4xOGISOc\/s200\/Richardson,+Bill.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5116428702986384402\" border=\"0\" \/><\/a>The newest revelations mean <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city> is now tied to the scandalous projects both through donors and appointees. It\u2019s possible, if the situation worsens, that Faught will take the fall. She made some pretty strong comments to the Journal this weekend admitting that DOT screwed up in giving Murphy the documents before he signed a contract.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cThis was premature&#8230; It was improper,\u201d the Journal quoted her as saying.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">She was also asked about the fact that Murphy later submitted a $2.2 million bid to oversee the headquarters redevelopment project \u2013 a contractor has not yet been selected \u2013 and said this:<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cNo way in hell would I hire him. Why would I hire someone who refused to give us proposals back?\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Richardson has also done some damage control, ordering two reviews of the DOT headquarters project to ensure there was no wrongdoing and ordering that the contract be re-bid, a move Peters supported. The other project was cancelled.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">But here\u2019s the reality: <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city> appointees and contributors have their fingerprints all over two DOT projects dogged by controversy in part because of the ties to men indicted in a separate case for allegedly stealing millions of dollars from taxpayers. This situation epitomizes the term \u201cappearance of impropriety.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\n<p class=\"MsoNormal\">But that\u2019s not proof of actual impropriety. Fair or not, there is a cloud hanging over the heads of Peters, Cope, Franken and the governor. Because of the involvement of people close to <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:City>, the reviews ordered by the governor won\u2019t be enough to allay concerns. We can only hope the <st1:country-region st=\"on\"><st1:place st=\"on\">U.S.<\/st1:place><\/st1:country-region> attorney\u2019s office gives this situation a thorough look as it continues its probe of the metro court scandal.<\/p>\n<p class=\"MsoNormal\">\n","protected":false},"excerpt":{"rendered":"<p>The number of suspicious circumstances surrounding two Department of Transportation building projects keeps growing.
