{"id":2179,"date":"2007-08-30T16:53:00","date_gmt":"2007-08-30T22:53:00","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/2007\/08\/truly-independent-probe-of-dot-situation-is-needed\/"},"modified":"2007-08-30T16:53:00","modified_gmt":"2007-08-30T22:53:00","slug":"truly-independent-probe-of-dot-situation-is-needed","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2007\/08\/truly-independent-probe-of-dot-situation-is-needed\/","title":{"rendered":"Truly independent probe of DOT situation is needed"},"content":{"rendered":"<p><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/1.bp.blogspot.com\/_IabUCQmoheQ\/RtdKkoBJ6vI\/AAAAAAAADQs\/ROuXza01DwY\/s1600-h\/Richardson,+Bill.jpg\"><img decoding=\"async\" style=\"margin: 0pt 10px 10px 0pt; float: left; cursor: pointer;\" src=\"http:\/\/1.bp.blogspot.com\/_IabUCQmoheQ\/RtdKkoBJ6vI\/AAAAAAAADQs\/ROuXza01DwY\/s200\/Richardson,+Bill.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5104630695725755122\" border=\"0\" \/><\/a>Gov. <a href=\"http:\/\/governor.state.nm.us\/\" target=\"_blank\">Bill Richardson<\/a> said at a news conference today in Santa Fe that there was \u201cno impropriety\u201d in his acceptance of campaign contributions from two developers picked for separate multimillion dollar contracts with the Department of Transportation, the <a href=\"http:\/\/www.abqjournal.com\/news\/apnoimp08-30-07.htm\" target=\"_blank\">Associated Press<\/a> is reporting.  <\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">He said there is \u201cno connection\u201d between contributions and decisions made in state government. He said he doesn\u2019t get involved in such projects and often doesn\u2019t even know who contributes to his campaign.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The statements came with the not-surprising news that the attorney <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city> has hired to conduct an \u201cindependent\u201d review of the controversial DOT projects won\u2019t look into the governor\u2019s involvement, but will only look at other aspects of the situation.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">There may not be any involvement. But <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city>\u2019s attempt to convince the public that his potential involvement doesn\u2019t warrant consideration is ludicrous.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Here\u2019s the situation: One of Richardson\u2019s biggest financial supporters, Gerald Peters, bid on the DOT headquarters project. He was awarded the contract. Because he was the only bidder, complaints led the DOT to seek new bids on the project. After he was awarded the contract a second time, but while he was still in negotiations with DOT, Peters and his wife each gave $2,300 \u2013 the maximum allowed by state law \u2013 to the governor\u2019s presidential campaign. Peters then hosted a fundraiser for <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city>\u2019s campaign at his home.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Meanwhile, at some point, DOT made a major change to the scope of the project, one that was not announced publicly. Instead of having to build a 300,000 square-foot building for DOT in exchange for the right to develop the rest of 25 acres of state land near downtown Santa Fe, the successful bidder would only have to build a public facility that\u2019s about half that size \u2013 significantly cutting the cost on the public facility and increasing the amount of land available for the selected bidder \u2013 Peters \u2013 to develop for his own profit.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">On the second, smaller project, the contract was also awarded to a <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city> donor, but it was later cancelled after an agreement could not be reached. Meanwhile, men indicted in the <st1:street st=\"on\"><st1:address st=\"on\">Bernalillo   County Metro Court<\/st1:address><\/st1:street> scandal were involved in the early stages of both DOT projects, furthering the reasons for suspicion.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">There are two possible scenarios here.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The first is that Richardson really wasn\u2019t involved in the DOT projects, that he wasn\u2019t consulted on who to select, that state employees who did award the contracts didn\u2019t consider at all whether the bidders were donors to their bosses\u2019 presidential campaign. Under this scenario, the change in the size of the DOT building would have been the result of a really big mistake \u2013 a realization late in the process that DOT hadn\u2019t done a needs assessment and, once one was complete, a second realization that combining several buildings into one would require less hallway space and, overall, the size of the building could be cut.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The other potential scenario is that <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city> wanted to make sure a donor to his campaign was rewarded, first by getting the contract and later by getting an even sweeter deal by shrinking the public building and making more land available for private development.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Which is the truth? Either is possible. When it\u2019s convenient, like when they\u2019re addressing concerns that he\u2019s out of the state campaigning most of the time, <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city>\u2019s people assert that the governor is still intimately involved in the day-to-day operations of state government. When it\u2019s convenient, as it was today, they assert he\u2019s not all that involved.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">What I know is this: A truly independent investigation, one that will consider <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city>\u2019s involvement, is needed. There\u2019s a reason state law prohibits prospective contractors from donating to elected officials during procurement processes: There\u2019s the potential for the contributions to affect the selection of a contractor or the terms of an eventual contract. The fact that the state law probably doesn\u2019t apply to <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city>\u2019s federal campaign doesn\u2019t change the fact that the appearance of impropriety exists.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">State law acknowledges it. The fact that <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city> will not is disingenuous.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gov.
