{"id":2171,"date":"2007-08-29T15:10:00","date_gmt":"2007-08-29T21:10:00","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/2007\/08\/showdown-over-medical-marijuana-may-be-coming\/"},"modified":"2007-08-29T15:10:00","modified_gmt":"2007-08-29T21:10:00","slug":"showdown-over-medical-marijuana-may-be-coming","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2007\/08\/showdown-over-medical-marijuana-may-be-coming\/","title":{"rendered":"Showdown over medical marijuana may be coming"},"content":{"rendered":"<p class=\"MsoNormal\">State and federal officials may be headed to a showdown over <st1:state st=\"on\"><st1:place st=\"on\">New Mexico<\/st1:place><\/st1:state>\u2019s new law that legalizes marijuana for medical use, which is contrary to federal laws on possession and distribution of the drug.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">On Tuesday, members of a regional drug task force that works with the U.S. Drug Enforcement Administration put out a news release after seizing marijuana plants from the southeastern <st1:state st=\"on\"><st1:place st=\"on\">New Mexico<\/st1:place><\/st1:state> home of a wheelchair-bound man who was licensed by the state to possess and smoke marijuana. The news release states that \u201cfederal charges are expected.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cCitizens of New Mexico need to be aware that they can still be prosecuted on the federal level even though New Mexico has a law permitting marijuana for medical use,\u201d the release states.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Agents didn\u2019t have a search warrant, and were actually allowed by Leonard French to enter his home in <st1:place st=\"on\"><st1:placename st=\"on\">Eddy<\/st1:placename> <st1:placename st=\"on\">County<\/st1:placename><\/st1:place>, the <a href=\"http:\/\/www.abqjournal.com\/news\/state\/590011nm08-29-07.htm\" target=\"_blank\">Albuquerque Journal<\/a> reported, because he thought he was doing nothing wrong.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">French, one of 38 New Mexicans approved so far for the new state program, lost use of his legs 20 years ago in a motorcycle accident and suffers from chronic pain and muscle spasms, the Journal reported.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cI\u2019m kind of stuck between a rock and a hard place,\u201d French told <st1:city st=\"on\"><st1:place st=\"on\">Albuquerque<\/st1:place><\/st1:city> television station <a href=\"http:\/\/kob.com\/article\/stories\/S179565.shtml?cat=500\" target=\"_blank\">KOB-TV<\/a>. \u201cIt makes me feel like the state says, \u2018Here you go. Here\u2019s your license to drive,\u2019 and the first time I left the driveway, they took my car away.\u201d<\/p>\n<p class=\"MsoNormal\">The new law took effect July 1. Several weeks later, the state attorney general cautioned that he can\u2019t legally defend state employees against criminal charges if the federal government goes after them for producing and distributing marijuana, which the state\u2019s new law called for them to do.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Then Gov. <a href=\"http:\/\/governor.state.nm.us\/\" target=\"_blank\">Bill Richardson\u2019s<\/a> administration announced it would continue to issue permits for possession and smoking of marijuana for medical reasons, but would not produce or distribute the drug for the time being. <st1:city st=\"on\"><st1:place st=\"on\">Richardson<\/st1:place><\/st1:city> sent <a href=\"http:\/\/governor.state.nm.us\/press\/2007\/august\/081707_02.pdf\" target=\"_blank\">a letter to President Bush<\/a> stating that, \u201c<span style=\"color:black;\">At a time when the scourge of meth is coming across the border, and cocaine and heroin use continues to ravage our communities, the federal government should be cracking down on real criminals \u2013 not people who are trying to help those in pain.\u201d<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"color:black;\"><o:p> <\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"\"><span style=\"color:black;\">He urged Bush to \u201cleave a legacy of compassion by adding an exemption in federal law for states that enact medical marijuana and be an ally instead of an adversary in assisting critically ill people.\u201d<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"\"><span style=\"color:black;\"><o:p> <\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"\"><st1:city st=\"on\"><st1:place st=\"on\"><span style=\"color:black;\">Richardson<\/span><\/st1:place><\/st1:city><span style=\"color:black;\"> also directed the state to continue planning to produce and distribute the drug \u201conce the legal hurdles, imposed by the federal government, are cleared,\u201d a news release stated.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"\"><span style=\"color:black;\"><o:p> <\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"\"><span style=\"color:black;\">All was quiet until Tuesday\u2019s events. Agents apparently didn\u2019t know French had a state permit for the plants that were seized until after they took them, but issued the news release after learning about the permit.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"\"><span style=\"color:black;\"><o:p> <\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"\"><span style=\"color:black;\">Interestingly, the federal government does have its own <a href=\"http:\/\/www.nida.nih.gov\/about\/organization\/nacda\/marijuanastatement.html\" target=\"_blank\">medical marijuana research program<\/a>. It was started in 1968, and began giving marijuana to patients in 1978. At its height, the program had about two dozen patients, but the federal government stopped accepting new applications under the previous President Bush, and there are now five patients enrolled. When they die, the federal government will likely end the program.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"\"><span style=\"color:black;\"><o:p> <\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"\"><span style=\"color:black;\">It\u2019s also notable that, in the handful of other states where medical marijuana is legal, the federal government hasn\u2019t pushed the issue with criminal charges.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"\"><span style=\"color:black;\"><o:p> <\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"\"><span style=\"color:black;\">But the threat made Tuesday looms large in <st1:state st=\"on\"><st1:place st=\"on\">New Mexico<\/st1:place><\/st1:state>. In the fight that\u2019s brewing, the <a href=\"http:\/\/www.abqtrib.com\/news\/2007\/aug\/27\/editorial-feds-should-ok-medicinal-marijuana-use\/\" target=\"_blank\">Albuquerque Tribune<\/a> sided with the governor in a recent editorial, calling it \u201ccriminal\u201d that \u201csick New Mexicans remain collateral damage\u201d in the war on drugs.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"\"><span style=\"color:black;\"><o:p> <\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"\"><span style=\"color:black;\">I\u2019m guessing French would agree.<o:p><\/o:p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>State and federal officials may be headed to a showdown over New Mexico\u2019s new law that legalizes marijuana for medical use, which is contrary to federal laws on possession and distribution of the drug.
