{"id":2055,"date":"2007-08-02T15:30:00","date_gmt":"2007-08-02T21:30:00","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/2007\/08\/sun-news-also-asks-ag-for-help-on-nmsu-issues\/"},"modified":"2007-08-02T15:30:00","modified_gmt":"2007-08-02T21:30:00","slug":"sun-news-also-asks-ag-for-help-on-nmsu-issues","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2007\/08\/sun-news-also-asks-ag-for-help-on-nmsu-issues\/","title":{"rendered":"Sun-News also asks AG for help on NMSU issues"},"content":{"rendered":"<p><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/3.bp.blogspot.com\/_IabUCQmoheQ\/RrJNLUuF31I\/AAAAAAAADBQ\/TbN6A3xKZY4\/s1600-h\/NMSU.jpg\"><img decoding=\"async\" style=\"margin: 0pt 0pt 10px 10px; float: right; cursor: pointer;\" src=\"http:\/\/3.bp.blogspot.com\/_IabUCQmoheQ\/RrJNLUuF31I\/AAAAAAAADBQ\/TbN6A3xKZY4\/s200\/NMSU.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5094218985445384018\" border=\"0\" \/><\/a>The <a href=\"http:\/\/www.lcsun-news.com\/\" target=\"_blank\">Las Cruces Sun-News<\/a> has also asked the <a href=\"http:\/\/www.ago.state.nm.us\/\" target=\"_blank\">Attorney General\u2019s Office<\/a> to weigh in on whether e-mail records requests are valid under state law and whether documents that have been discussed and approved in open meetings are public records.  <\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The questions arose last week after <a href=\"http:\/\/www.nmsu.edu\/\" target=\"_blank\">New Mexico State University<\/a> told both the Sun-News and me that requests we made for a copy of a new agreement with the <a href=\"http:\/\/giving.nmsu.edu\/\" target=\"_blank\">NMSU Foundation<\/a> weren\u2019t valid because they were sent via e-mail and, even if they had been valid, the document wouldn\u2019t be released because, though it had been discussed and approved publicly by the <a href=\"http:\/\/www.nmsu.edu\/Administration\/regents.html\" target=\"_blank\">Board of Regents<\/a>, it hadn\u2019t yet been signed by all parties.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">I contend the later is a flagrant violation of the state\u2019s <a href=\"http:\/\/www.ago.state.nm.us\/divs\/civil\/ipra_fourth_edition_final07.pdf\" target=\"_blank\">Inspection of Public Records Act<\/a> and that the first might be as well. I asked the attorney general last week to investigate, and his office is doing that. NMSU eventually backed down under pressure from me and the Sun-News and released the document before all parties had signed it, but the university still contends that e-mail requests aren\u2019t valid.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The attorney general\u2019s Web site contains a section on <a href=\"http:\/\/www.ago.state.nm.us\/divs\/civil\/civil_oma-ipra_complaints.htm\" target=\"_blank\">pending complaints<\/a> of violations of the public records act and the <a href=\"http:\/\/www.ago.state.nm.us\/divs\/civil\/oma_fifth_edition_final07.pdf\" target=\"_blank\">Open Meetings Act<\/a>.
