{"id":20418,"date":"2010-08-12T15:18:56","date_gmt":"2010-08-12T21:18:56","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/?p=20418"},"modified":"2010-08-12T18:02:10","modified_gmt":"2010-08-13T00:02:10","slug":"head-of-da-association-worked-for-martinez-got-bonuses","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2010\/08\/head-of-da-association-worked-for-martinez-got-bonuses\/","title":{"rendered":"Head of DA association worked for Martinez, got pay increases"},"content":{"rendered":"<div id=\"attachment_20419\"  class=\"wp-caption module image alignright\" style=\"max-width: 120px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-20419\" title=\"Kuenstler, Kelly\" src=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2010\/08\/Kuenstler-Kelly.jpg\" alt=\"\" width=\"120\" height=\"160\" \/><\/a><p class=\"wp-caption-text\">Kelly Kuenstler<\/p><\/div>\n<p>When the Albuquerque Journal quoted the head of the state District Attorney\u2019s Association earlier this week in <a href=\"http:\/\/www.abqjournal.com\/news\/state\/0915411state08-09-10.htm\">an article<\/a> about <a href=\"http:\/\/www.susanamartinez2010.com\/\">Susana Martinez<\/a> giving employees large \u201cout-of-cycle\u201d salary increases, the newspaper didn\u2019t mention that the agency\u2019s head used to work for Martinez and received the pay increases she was speaking about.<\/p>\n<p>Here\u2019s what the Journal wrote about <a href=\"http:\/\/www.da.state.nm.us\/aoda.html\">Kelly Kuenstler<\/a>:<\/p>\n<blockquote><p>\u201cKelly Kuenstler, director of the Administrative Office of the District Attorneys in Albuquerque, said the payouts or increases are sometimes funded by savings from vacant positions in the office that are budgeted but not filled or from recurring savings that occur when a highly paid member of the office leaves and is replaced by someone making less money.<\/p>\n<p>\u201cMany of the out-of-cycle payments are made using federal or nonprofit grants, Kuenstler said.\u201d<\/p><\/blockquote>\n<p>It\u2019s the second time I\u2019ve seen a media outlet quote Kuenstler about an issue that\u2019s under scrutiny because of Martinez\u2019s run for governor without mentioning that Kuenstler used to work for Martinez. FactCheck.org. <a href=\"http:\/\/www.factcheck.org\/2010\/06\/nm-governors-race-denish-distorts-das-record\/\">did it a couple of months ago<\/a>.<\/p>\n<p>So I figured it was time to write an article disclosing the link between Kuenstler and Martinez.<\/p>\n<p>I asked Kuenstler if she had disclosed to the Journal her former employment in the Third Judicial District Attorney\u2019s Office and the fact that she received some of the pay increases the article was about. She replied in an e-mail that her name, \u201cas a former employee and as a recipient of these funds, was provided to both the\u00a0Associated Press\u00a0and the\u00a0Albuquerque Journal\u00a0in the reports that my office gave them\u201d in response to records requests.<!--more--><\/p>\n<p>Kuenstler also pointed out that the Journal has previously reported that she used to work for Martinez\u2019s office. Though she thought it happened as recently as in the spring of this year, the only article I found on the Journal\u2019s Web site that made the connection was published in <a href=\"http:\/\/www.abqjournal.com\/news\/metro\/3123726799newsmetro07-31-09.htm\">July of 2009<\/a>.<\/p>\n<p>Regardless, Kuenstler said she assumed that her former employment in Martinez\u2019s office was \u201cwell known being that an article revealed this months ago and that the reports clearly had my name on them.\u201d<\/p>\n<p>Fair enough. But, for the record, here are the details relevant to the article about the salary increases:<\/p>\n<p>Kuenstler worked in Martinez\u2019s office for 12 years as the office manager. She received three one-time, out-of-cycle salary increases of approximately 15 percent each in fiscal years 2006, 2007 and 2008. Those three increases added up to $33,164.97.<\/p>\n<p>Overall, between fiscal years 2006 and 2010, Martinez gave about $477,000 in out-of-cycle increases \u2013 some permanent raises and others one-time increases \u2013 to employees of her office.
