{"id":200374,"date":"2016-10-24T09:52:24","date_gmt":"2016-10-24T15:52:24","guid":{"rendered":"http:\/\/nmpolitics.net\/index\/?p=200374"},"modified":"2016-10-24T09:54:42","modified_gmt":"2016-10-24T15:54:42","slug":"state-auditors-findings-in-hobbs-align-with-my-concerns","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2016\/10\/state-auditors-findings-in-hobbs-align-with-my-concerns\/","title":{"rendered":"State auditor&#8217;s findings in Hobbs align with my concerns"},"content":{"rendered":"<p><strong>COMMENTARY:\u00a0<\/strong>The State Auditors Office&#8217;s <a href=\"http:\/\/nmpolitics.net\/index\/2016\/10\/state-auditor-finds-no-violations-in-hobbs-but-criticizes-city-policy\/\" target=\"_blank\">official findings<\/a> align with my concerns.<\/p>\n<p>In July, I filed <a href=\"http:\/\/nmpolitics.net\/index\/2016\/09\/resident-alleges-less-than-arms-length-city-contracts-in-hobbs\/\" target=\"_blank\">a complaint<\/a> with the State Auditor\u2019s Office asking for the probe into two contracts championed by Hobbs\u2019 City Manager, J.J. Murphy. These two contracts were awarded to the Medico Consulting Group, LLC, a waste and recycling consultant, and Pennsylvania attorney Alan Wohlstetter, a $475-per-hour-consultant retained for legal services related to the police department\u2019s video surveillance network.<\/p>\n<div id=\"attachment_200378\"  class=\"wp-caption module image alignleft\" style=\"max-width: 336px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-200378\" src=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/10\/Maxwell-Nick-336x233.jpg\" alt=\"Nick Maxwell\" width=\"336\" height=\"233\" srcset=\"https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/10\/Maxwell-Nick-336x233.jpg 336w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/10\/Maxwell-Nick-768x532.jpg 768w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/10\/Maxwell-Nick-771x534.jpg 771w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/10\/Maxwell-Nick-1170x811.jpg 1170w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/10\/Maxwell-Nick.jpg 1470w\" sizes=\"auto, (max-width: 336px) 100vw, 336px\" \/><p class=\"wp-media-credit\">Courtesy photo<\/p><p class=\"wp-caption-text\">Nick Maxwell<\/p><\/div>\n<p>After conducting a fact-finding investigation, the office mailed <a href=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/10\/OSA-Letter-to-City-of-Hobbs-10-17-16-1.pdf\" target=\"_blank\">a letter<\/a> dated Oct.\u00a017 to the City of Hobbs stating that these two contracts \u201cwere handled in a manner that raises significant uncertainty as to whether the City received competitive prices. Additionally, the fact that both firms are from Pennsylvania and have connections to the City Manager\u2019s prior employer raises the appearance that the contracts may not have been at arm\u2019s length.\u201d<\/p>\n<p>The investigation revealed that \u201cprice was not part of the evaluation criteria for the proposal\u201d submitted by the Medico Consulting Group, LLC in 2014. The office reminded the City of Hobbs that \u201cwe believe it is crucial to consider price in the evaluation process to ensure a fair and reasonable price is obtained.\u201d<\/p>\n<p>The office discovered that \u201cthe City did not seek any additional proposals or quotes from any other firms\u201d before approving Alan Wohlstetter\u2019s contract in 2014. The office explained to the City of Hobbs that the state\u2019s \u201cprocurement regulations relating to small purchases of professional services (1.4.1.52 NMAC), which are incorporated into the City\u2019s procurement policy by reference, encourage agencies to contact at least three businesses for written offers before selecting a contractor.\u201d<\/p>\n<p>The office further explained, \u201cthese provisions require [the City of Hobbs] to &#8216;negotiate a contract for the required services at a fair and reasonable price\u2026&#8217;\u201d The office noted in their findings, \u201cNothing in the supporting documentation reviewed by the OSA indicates the City took any steps to negotiate the law firm\u2019s contract, and the lack of other quotes makes it difficult to assess whether the $475\/hour billing rate was reasonable.\u201d<\/p>\n<p>$475\/hour was not reasonable. To compare, in 2014 the City of Hobbs approved <a href=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/10\/Hobbs-Tara-Wood-contract.pdf\" target=\"_blank\">a contract<\/a> valued at $100\/hour with local attorney Tara Wood for professional legal services on an as-needed basis.<\/p>\n<p>Although the State Auditor&#8217;s Office\u00a0recognized \u201cthat Hobbs does not have to follow the state procurement code in these matters,\u201d the office asserted their recommendation to the City of Hobbs \u201cthat a &#8216;home-rule&#8217; entity\u2019s procurement code should meet or exceed the basic protections provided for in state law and regulations for ensuring that the costs entities incur are reasonable and that the process is fair.\u201d<!--more--><\/p>\n<p>The office concluded that \u201cit would be in the best interest of the City to review its procurement code and operating procedures, and make any changes that may be necessary, to avoid these types of situations going forward.\u201d<\/p>\n<p>Did these \u201ctypes of situations\u201d pass the reasonable person&#8217;s litmus test for ethical behavior?<\/p>\n<p>In early August, Byron Marshall uncovered the city&#8217;s questionable agreements approved by J.J. Murphy in an investigative column published on wethefourth.org, <a href=\"http:\/\/wethefourth.org\/hobbs-funny-business.html\" target=\"_blank\">\u201cFunny Business: contracts under Murphy too strange to ignore.&#8221;<\/a> Marshall\u2019s column gives an accurate rundown of what these contracts are all about.<\/p>\n<p>At the very least, the state auditor&#8217;s findings affirm our City Commission&#8217;s decision during the Oct.\u00a03 public meeting to <a href=\"http:\/\/nmpolitics.net\/index\/2016\/10\/hobbs-commissioners-reject-severance-agreement-with-city-manager\/\" target=\"_blank\">reject a questionable contract proposal<\/a> for J.J. Murphy.<\/p>\n<p>The latest proposal for Murphy would have benefited him with large and fancy legal perks at the expense of Hobbs taxpayers: indemnification and litigation expenses, in addition to the standard D&amp;O insurance policy he already enjoys. Our city commission nearly bestowed upon Murphy a frightening amount of legal immunity from accountability for his official dealings, and that only scratches the surface of the undiscussed contract changes.<\/p>\n<p>The city\u2019s <a href=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/10\/10.21.16-Hobbs-news-release.pdf\" target=\"_blank\">official press release<\/a> regarding the state auditor\u2019s findings was a study in misdirection and flimflammery, showing yet again the arrogance of the city administration and its disdain for any spirit of accountability or transparency, much less any institutional regard for the sanctity of taxpayer dollars.<\/p>\n<p>Cronyism and conflicts of interest in the public trust carry a hefty price. The official findings of the State Auditor\u2019s Office reveal that contracts approved under Murphy\u2019s tenure \u201cmay not have been at arm\u2019s length.\u201d Is it any wonder that\u00a0Murphy is demanding additional legal benefits as he expedites his departure from Hobbs?<\/p>\n<p><em>Nick Maxwell is a Hobbs-born and based technology consultant, writer and analyst.
