{"id":1996,"date":"2007-07-19T10:53:00","date_gmt":"2007-07-19T16:53:00","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/2007\/07\/judge-in-foley-case-is-pushing-ethical-limits\/"},"modified":"2007-07-19T10:53:00","modified_gmt":"2007-07-19T16:53:00","slug":"judge-in-foley-case-is-pushing-ethical-limits","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2007\/07\/judge-in-foley-case-is-pushing-ethical-limits\/","title":{"rendered":"Judge in Foley case is pushing ethical limits"},"content":{"rendered":"<p><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/1.bp.blogspot.com\/_IabUCQmoheQ\/Rp-XH1-gZtI\/AAAAAAAAC4A\/HzOx5rPp-G0\/s1600-h\/Foley,+Dan.jpg\"><img decoding=\"async\" style=\"margin: 0pt 0pt 10px 10px; float: right; cursor: pointer;\" src=\"http:\/\/1.bp.blogspot.com\/_IabUCQmoheQ\/Rp-XH1-gZtI\/AAAAAAAAC4A\/HzOx5rPp-G0\/s200\/Foley,+Dan.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5088952264956077778\" border=\"0\" \/><\/a>The attorney for <a href=\"http:\/\/legis.state.nm.us\/lcs\/legdetails.asp?Name=190&#038;Submit=Search\" target=\"_blank\">Dan Foley<\/a>, the GOP state representative from <st1:city st=\"on\"><st1:place st=\"on\">Roswell<\/st1:place><\/st1:city> who is facing charges of disorderly conduct, obstructing an officer and resisting arrest, has requested a postponement of his Aug. 2 trial date, the <a href=\"http:\/\/www.roswell-record.com\/main.asp?SectionID=49&amp;SubSectionID=112&#038;ArticleID=14231&amp;TM=72006.25\" target=\"_blank\">Roswell Daily Record<\/a> is reporting.  <\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Municipal Judge Clyde McKee told the newspaper on Tuesday he hadn\u2019t seen the request for a continuance but would most likely approve it.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cI have no reason not to,\u201d the newspaper quoted him as saying, adding that such requests are \u201cnormal procedure\u201d and \u201cusually not refused\u201d when they\u2019re reasonable. Foley\u2019s attorney said he has about 50 witnesses to interview and needs more time.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Foley ran onto a basketball court in <st1:city st=\"on\"><st1:place st=\"on\">Roswell<\/st1:place><\/st1:city> last month after his son was knocked over by the opposing coach during a fight between two teens. Police say Foley pushed his way past one officer and spit tobacco on him before having to be forcibly taken to the ground by two others. Foley says he remained calm throughout the incident and does not chew tobacco.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Foley has pleaded not guilty. He faces a maximum fine of $784 and 20 days in jail.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Here\u2019s where things get sticky: McKee, <a href=\"http:\/\/haussamen.blogspot.com\/2007\/07\/judge-in-foley-case-gave-50-to-his.html\">you might recall<\/a>, in the past gave $50 to one of Foley\u2019s campaigns. In addition, his son is a close friend of Foley and a financial backer. So the judge is already facing some pressure to recuse himself from the case. His newest statement seems to indicate he doesn\u2019t plan to do that.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The biggest problem is that the judge told a newspaper how he will likely rule on a motion that, at the time, he hadn\u2019t seen. He says such requests are \u201cusually not refused\u201d when they\u2019re reasonable, but he didn\u2019t know at the time whether this one is reasonable. He revealed a bias by giving an opinion to a reporter without having firsthand information about the request.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">There\u2019s a good chance his statement to the newspaper will be investigated as a possible violation of judicial ethics. It gives further ammunition to those who believe the judge won\u2019t be objective in the Foley case.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">When I wrote about this last week, I said the judge needed to carefully weigh the issues before deciding whether to stay on the case, but I didn\u2019t give an opinion on what he should decide. Because of his newest statement, it would be best, at this point, for McKee to recuse himself and let a proxy judge hear the case.
