{"id":18749,"date":"2010-06-25T07:34:31","date_gmt":"2010-06-25T13:34:31","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/?p=18749"},"modified":"2010-06-28T08:10:43","modified_gmt":"2010-06-28T14:10:43","slug":"city-manager-won%e2%80%99t-face-criminal-charges","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2010\/06\/city-manager-won%e2%80%99t-face-criminal-charges\/","title":{"rendered":"City manager won\u2019t face criminal charges"},"content":{"rendered":"<div id=\"attachment_11668\"  class=\"wp-caption module image alignright\" style=\"max-width: 270px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-11668 \" title=\"Moore, Terrence 2\" src=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2010\/01\/Moore-Terrence-2.jpg\" alt=\"\" width=\"270\" height=\"236\" \/><\/a><p class=\"wp-caption-text\">Las Cruces City Manager Terrence Moore (Photo by Heath Haussamen)<\/p><\/div>\n<p>Las Cruces City Manager <a href=\"http:\/\/las-cruces.org\/manager\/\">Terrence Moore<\/a> won\u2019t be charged in a probe into two incidents involving him and his ex-wife, the <a href=\"http:\/\/www.lcsun-news.com\/las_cruces-news\/ci_15373796\">Las Cruces Sun-News<\/a> is reporting.<\/p>\n<p>The district attorney\u2019s office confirmed for the newspaper that it had completed a review of <a href=\"http:\/\/www.nmpolitics.net\/index\/2010\/03\/sheriff-takes-over-case-involving-las-cruces-city-manager\/\">the investigation<\/a> by the Do\u00f1a Ana County Sheriff\u2019s Department into injuries Moore\u2019s then-wife suffered in late 2008 and questions surrounding a police report the city manager filed over a prescription-drug incident in January 2009.<\/p>\n<p>\u201cThere was insufficient evidence to proceed,\u201d Deputy District Attorney Nelson Goodin was quoted by the newspaper as saying. \u201cWhat our case would be based on is hearsay.\u201d<\/p>\n<p>That\u2019s because, according to sheriff\u2019s investigator Robyn Gojkovich, Moore\u2019s ex-wife refused to cooperate with the probe.<\/p>\n<p>\u201cIf you don\u2019t have a victim, you don\u2019t have a crime,\u201d the Sun-News quoted Gojkovich as saying.<\/p>\n<p>Earlier this year, the sheriff\u2019s department <a href=\"http:\/\/www.nmpolitics.net\/index\/2010\/03\/sheriff-takes-over-case-involving-las-cruces-city-manager\/\">took over<\/a> what was originally an Las Cruces Police Department probe after the district attorney raised concerns about LCPD investigating a case involving its own boss and urged the transfer. Moore oversees the police chief and, by extension, the police department.<!--more--><\/p>\n<p>Last year, Las Cruces police closed the case without filing charges. Former Interim Police Chief Pete Bradley said earlier this year that the case was dropped because no one, including Moore\u2019s ex-wife, alleged a crime, and police didn\u2019t have probable cause to proceed.<\/p>\n<p>But LCPD never interviewed Moore, which the sheriff\u2019s department did in its investigation. The result, apparently, was the same: No victim, no crime.<\/p>\n<p>Moore called the investigation nothing more than \u201ca witch hunt \u2013 an attempt to discredit me.\u201d The Sun-News quoted him as saying there was \u201cabsolutely nothing there.\u201d<\/p>\n<p>The city manager, who has been dogged in recent months by the law enforcement probe and media and city council scrutiny of other situations, announced last week that he <a href=\"http:\/\/www.nmpolitics.net\/index\/2010\/06\/cruces-city-manager-resigning-in-december\/\">will resign<\/a> at the end of the year.
