He faces a misdemeanor charge of driving while intoxicated. He was released from jail Monday after posting a $200 bond.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Galvan has two prior DWI convictions in <st1:state st=\"on\"><st1:place st=\"on\">New Mexico<\/st1:place><\/st1:state> from 1983 and 1990.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Galvan resigned from the bench in 2005 while battling allegations that he raped and solicited a bribe from a <st1:city st=\"on\"><st1:place st=\"on\">Las Cruces<\/st1:place><\/st1:city> woman a year earlier. Prosecutors dropped the charges after two criminal trials ended with hung juries. Galvan has contended all along that the sex was consensual.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">But he\u2019s being sued by his accuser in that case. The civil lawsuit is scheduled to go to trial Sept. 17 in <st1:place st=\"on\"><st1:city st=\"on\">Albuquerque<\/st1:city><\/st1:place>.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The <a href=\"http:\/\/www.generalservices.state.nm.us\/rmd\/\" target=\"_blank\">New Mexico Risk Management Division<\/a> doesn\u2019t want to pay to defend Galvan, and has asked the court to declare that he was acting outside the scope of his duties on the night in question and, therefore, it has no duty to defend him or pay if there\u2019s a judgment against him.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Former Do\u00f1a Ana County Magistrate Judge Reuben Galvan has been charged with drunken driving.
