Councilor <a href=\"http:\/\/www.las-cruces.org\/council\/district6.shtm\" target=\"_blank\">Ken Miyagishima<\/a> asked near the start of tonight\u2019s meeting that Mayor <a href=\"http:\/\/www.las-cruces.org\/council\/mayor.shtm\" target=\"_blank\">Bill Mattiace<\/a> hold a vote of the council to determine whether Jones would be allowed to vote on the development later tonight.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">City Attorney Fermin Rubio said councilors can only stop one of their peers from voting, according to the city charter, if they have a direct or indirect financial interest in an item on the agenda. When Jones said he has no personal financial interest, Mattiace said he wouldn\u2019t call for a vote of the council, and would leave it up to Jones to decide whether to vote or abstain.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cSince the law of the charter does not require a vote, I don\u2019t think I should jump out of the charter\u2019s parameters,\u201d Mattiace said.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Jones plans to vote.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cThere is no private financial interest, neither direct nor indirect,\u201d Jones said.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Las Cruces City Councilor Gil Jones will be allowed to vote tonight on annexation and master plan approval of The Vistas at Presidio.
