{"id":171534,"date":"2016-07-26T12:11:49","date_gmt":"2016-07-26T18:11:49","guid":{"rendered":"http:\/\/nmpolitics.net\/index\/?p=171534"},"modified":"2016-07-26T14:57:28","modified_gmt":"2016-07-26T20:57:28","slug":"legislative-budget-committees-should-let-in-the-public","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2016\/07\/legislative-budget-committees-should-let-in-the-public\/","title":{"rendered":"Legislative budget committees should let in the public"},"content":{"rendered":"<p><strong>COMMENTARY:\u00a0<\/strong>New Mexico\u2019s state lawmakers scrambled to <a href=\"http:\/\/nmpolitics.net\/index\/2016\/02\/new-budget-proposal-utilizes-unspent-money-trims-higher-education\/\" target=\"_blank\">rewrite the budget<\/a> earlier this year when revenue estimates worsened in the middle of their session. During <a href=\"http:\/\/nmpolitics.net\/index\/2016\/02\/open-government-group-questions-secret-budget-talks\/\" target=\"_blank\">closed-door meetings<\/a>, a group of legislators decided to place much of the burden on public universities by cutting their funding.<\/p>\n<div id=\"attachment_55852\"  class=\"wp-caption module image alignleft\" style=\"max-width: 336px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-55852\" src=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/05\/Haussamen-Heath1-336x222.jpg\" alt=\"Heath Haussamen\" width=\"336\" height=\"222\" srcset=\"https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/05\/Haussamen-Heath1-336x222.jpg 336w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/05\/Haussamen-Heath1-768x508.jpg 768w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/05\/Haussamen-Heath1-771x510.jpg 771w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/05\/Haussamen-Heath1-1170x773.jpg 1170w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/05\/Haussamen-Heath1.jpg 1262w\" sizes=\"auto, (max-width: 336px) 100vw, 336px\" \/><p class=\"wp-caption-text\">Heath Haussamen<\/p><\/div>\n<p>They did so without real opportunity for public input or scrutiny. Which gives us a good illustration of why keeping the public out of budget discussions is wrong.<\/p>\n<p>Most state universities, including the University of New Mexico, <a href=\"http:\/\/www.abqjournal.com\/744766\/unm-regents-ok-25-tuition-hike.html\" target=\"_blank\">raised tuition<\/a> to cover their resulting budget shortfalls. New Mexico State University has instead been <a href=\"http:\/\/nmpolitics.net\/index\/2016\/07\/nmsu-cuts-on-campus-employee-health-services-equestrian-team-surveying-engineering-program\/\" target=\"_blank\">making cuts<\/a>, including eliminating jobs, to cover an estimated $12.1 million shortfall. To be fair, NMSU\u2019s problems were created by a combination of factors including state cuts and declining enrollment \u2013 not entirely caused by policymakers in Santa Fe.<\/p>\n<p>How did lawmakers make the decision to shift burden for the state\u2019s budget woes onto the backs of college students and employees? We don\u2019t know. Was the Legislature\u2019s decision correct? We didn\u2019t get a genuine chance to weigh in.<\/p>\n<p>Budget committees don\u2019t only shut the public out. They often close the doors on other lawmakers. Some legislators view that as an intentional attempt to control the outcome.<\/p>\n<p>That\u2019s not good government. And it\u2019s inconsistent with the <a href=\"http:\/\/www.nmag.gov\/uploads\/files\/Publications\/ComplianceGuides\/Open%20Meetings%20Act%20Compliance%20Guide%202015.pdf\" target=\"_blank\">N.M. Open Meetings Act<\/a> (OMA), which recognizes that public scrutiny and debate helps our legislators and local governing bodies make better decisions.<\/p>\n<p>\u201cIn recognition of the fact that a representative government is dependent upon an informed electorate, it is declared to be public policy of this state that all persons are entitled to the greatest possible information regarding the affairs of government and the official acts of those officers and employees who represent them,\u201d OMA states.<!--more--><\/p>\n<p>Such transparency is so important as the state grapples with the effects of lower oil and gas prices. Our state government ended the last fiscal year on June 30 <a href=\"http:\/\/nmpolitics.net\/index\/2016\/07\/states-fiscal-outlook-worsens-some-call-for-a-special-session\/\" target=\"_blank\">in the red<\/a>. We\u2019re facing a shortfall in the current, 2017, fiscal year that some say could be <a href=\"http:\/\/krqe.com\/2016\/07\/21\/lawmakers-new-mexico-facing-budget-shortfall-calls-for-special-session\/\" target=\"_blank\">as high as $500 million<\/a>. The Legislative Finance Committee predicts another <a href=\"http:\/\/nmpolitics.net\/index\/2016\/07\/states-fiscal-outlook-worsens-some-call-for-a-special-session\/\" target=\"_blank\">\u201cgloomy\u201d fiscal situation<\/a> during the 2018 budget year.<\/p>\n<p>I don\u2019t understand why some lawmakers \u2013 Democrats and Republicans \u2013 view transparency as something to work around, rather than a tool that helps them make better decisions.<\/p>\n<p>These are tough times. We need the Legislature at its best.<\/p>\n<p>The N.M. Foundation for Open Government (FOG) has been <a href=\"http:\/\/nmfog.org\/2016\/06\/fog-sends-letter-to-lawmakers-urging-transparency-in-the-state-budget-process\/\" target=\"_blank\">pushing<\/a> the House Appropriations and Finance Committee and the Senate Finance Committee to do their work in full view of the public. Past closed-door meetings violate OMA, according to FOG.<\/p>\n<p>Budget decisions, FOG Executive Director Susan Boe told me, \u201ctouch on every area of state and local government \u2013 from schools to art museums.\u201d<\/p>\n<p>\u201cThe public needs to hear how our elected leaders are making the hard decisions dividing up the pie,\u201d she said. \u201cWhat competing factors are being considered?\u00a0What trade-offs are being made?\u201d<\/p>\n<p>\u201cIt makes no sense that the public is being shut out of the most critical problem facing the state \u2013 the economy,\u201d Boe said.<\/p>\n<p>New Mexico is at or near the bottom of <a href=\"http:\/\/nmpolitics.net\/index\/2016\/06\/new-mexico-doesnt-have-to-stay-at-49th-for-child-well-being\/\" target=\"_blank\">too many important lists<\/a>. Our budget woes threaten to worsen the situation. All New Mexicans have a right and responsibility to be involved in finding solutions.<\/p>\n<p>We must demand that policymakers give us a seat at the table so we\u2019re there to remind them who gave them their seats.
