A\u00a0judge would set a contradictory precedent if he dismissed a lawsuit seeking release of Las Cruces city manager applications or ruled against it.<\/p>\n<div id=\"attachment_71632\"  class=\"wp-caption module image alignleft\" style=\"max-width: 336px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-71632\" src=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/08\/LasCrucesCityHall1-336x186.jpg\" alt=\"Las Cruces City Hall\" width=\"336\" height=\"186\" srcset=\"https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/08\/LasCrucesCityHall1-336x186.jpg 336w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/08\/LasCrucesCityHall1-768x426.jpg 768w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/08\/LasCrucesCityHall1-771x428.jpg 771w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/08\/LasCrucesCityHall1-1170x649.jpg 1170w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/08\/LasCrucesCityHall1.jpg 1500w\" sizes=\"auto, (max-width: 336px) 100vw, 336px\" \/><p class=\"wp-media-credit\">Heath Haussamen \/ NMPolitics.net<\/p><p class=\"wp-caption-text\">Las Cruces City Hall<\/p><\/div>\n<p>That&#8217;s what NMPolitics.net&#8217;s attorney wrote <a href=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/07\/7.14.16.NMPolitics.netResponse.pdf\" target=\"_blank\">in response<\/a> to the City of Las Cruces&#8217; <a href=\"http:\/\/nmpolitics.net\/index\/2016\/06\/city-wants-nmpolitics-nets-public-records-lawsuit-dismissed\/\" target=\"_blank\">motion<\/a> seeking dismissal of or summary judgement against the news organization&#8217;s lawsuit.<\/p>\n<p>&#8220;If the court sides with Defendants in this case, it will encourage state government to hide public records in the hands of private entities, which is not what the New Mexico Legislature intended,&#8221; wrote\u00a0the attorney, C.J. McElhinney of Las Cruces.<\/p>\n<p>He was referring to the Legislature&#8217;s passage of the N.M.\u00a0<a href=\"http:\/\/www.nmag.gov\/uploads\/files\/Publications\/ComplianceGuides\/Inspection%20of%20Public%20Records%20Compliance%20Guide%202015.pdf\" target=\"_blank\">Inspection of Public Records Act<\/a> (IPRA), which states that all people &#8220;are entitled to the greatest possible information regarding the affairs of government and the official acts of public officers and employees.&#8221;<\/p>\n<p>NMPolitics.net&#8217;s response to the city&#8217;s motion to dismiss or rule against the lawsuit <a href=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/07\/7.14.16.NMPolitics.netResponse.pdf\" target=\"_blank\">was filed Thursday<\/a>. The case is assigned to Third Judicial District Judge James T. Martin.\u00a0The city has <a href=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/06\/6.29.16-CLC-Request-for-hearing.pdf\" target=\"_blank\">requested a hearing<\/a>\u00a0before Martin on its motion.<\/p>\n<p>Las Cruces has released\u00a0<a href=\"http:\/\/nmpolitics.net\/index\/2016\/05\/las-cruces-releases-some-city-manager-applications-withholds-dozens-more\/\" target=\"_blank\">11 city manager applications<\/a> it received from The Mercer Group, the private company it hired to run its open city manager search. But the city\u00a0has refused to release dozens more, arguing that the private contractor, not the city, has possession of them so they don\u2019t have to be released.<\/p>\n<p>NMPolitics.net argues in <a href=\"http:\/\/nmpolitics.net\/index\/2016\/05\/nmpolitics-net-sues-for-release-of-city-manager-applications\/\" target=\"_blank\">its lawsuit<\/a>\u00a0&#8212; which it filed against the city and The Mercer Group &#8212; that the city can\u2019t avoid transparency law\u00a0by outsourcing government services.<!--more--><\/p>\n<p>In response, the city <a href=\"http:\/\/nmpolitics.net\/index\/2016\/06\/city-wants-nmpolitics-nets-public-records-lawsuit-dismissed\/\" target=\"_blank\">dug in its heels<\/a> on its assertion that the public doesn\u2019t have a right to see\u00a0city manager applications\u00a0that are in the hands of a private\u00a0company running the\u00a0job search.<\/p>\n<p>\u201cThe City has no legal mechanism under IPRA to compel the divulging of private information held by an independent contractor,\u201d Deputy City Attorney Robert G. Cates wrote in <a href=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/06\/6.29.16-CLC-Motion-to-dismiss.pdf\" target=\"_blank\">the city\u2019s motion<\/a> seeking dismissal of the lawsuit or a summary judgement ruling against it.<\/p>\n<p>The Mercer Group has\u00a0<a href=\"http:\/\/nmpolitics.net\/index\/2016\/07\/city-manager-search-firm-also-seeks-dismissal-of-nmpolitics-nets-lawsuit\/\" target=\"_blank\">also sought dismissal<\/a> of NMPolitics.net&#8217;s lawsuit, arguing that its\u00a0contract with the city doesn\u2019t require it to provide the records. And it says IPRA doesn\u2019t apply to the company.<\/p>\n<p>The Mercer Group\u00a0provided the 11 applications to the city that \u201cmost closely matched the selection criteria for the City Manager position,\u201d the filing states. \u201cMercer was not required to provide or disclose to the City any information about applicants who were not included. \u2026 The City does not have access to this information under the Agreement or any other arrangement.\u201d<\/p>\n<p>In its response to such arguments, NMPolitics.net states that\u00a0the N.M. Court of Appeals has ruled that city manager applications <a href=\"http:\/\/nmpolitics.net\/index\/2016\/05\/las-cruces-doesnt-want-to-release-names-of-city-manager-applicants\/\" target=\"_blank\">are public record<\/a>. And the Court\u00a0has created a test for when documents held by a private contractor are subject to IPRA and when they are not.<\/p>\n<p>NMPolitics.net argues that the city manager applications meet enough of the factors in the so-called <em>Toomey<\/em> test &#8212; named for the 2012 court case <em><a href=\"http:\/\/nmfog.org\/wp-content\/uploads\/2014\/06\/CourtofAppealsOpinion72012.pdf\" target=\"_blank\">Toomey v. City of Truth or Consequences<\/a><\/em> &#8212; to require disclosure.<\/p>\n<p>For example, NMPolitics.net points out\u00a0in its response, The Mercer Group&#8217;s contract with the city is funded by public money. It appears that some of The Mercer Group&#8217;s\u00a0work has\u00a0been done on city property. The work of the search firm is integral to the city&#8217;s decision-making process. The firm is doing work the city would otherwise perform. The city has direct involvement\u00a0in\u00a0and consultation with the firm on its work. And the firm is doing its work on behalf of the city.<\/p>\n<p>In the response it filed in court last week, NMPolitics.net also made a request to conduct discovery to gather evidence related to the <em>Toomey<\/em> test.<\/p>\n<p>But the court need not apply the Toomey test to reject the city&#8217;s request for\u00a0summary judgement against NMPolitics.net, McElhinney wrote. The Mercer Group &#8220;completely assumed a government function otherwise reserved exclusively for the Las Cruces City Council,&#8221; he wrote. He referred to a 1997 case in Florida where a court\u00a0ruled that because a private entity completely assumed a government function, all documents held by that private entity related to the government function were public.<\/p>\n<p>The same &#8220;delegation of function&#8221; test that applied in the Florida\u00a0case applies in the case against the City of Las Cruces, McElhinney argued.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>State law says all people are entitled to the greatest information possible about their government.
