{"id":16681,"date":"2010-04-29T16:55:21","date_gmt":"2010-04-29T22:55:21","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/?p=16681"},"modified":"2010-04-29T16:55:22","modified_gmt":"2010-04-29T22:55:22","slug":"bingaman-wants-review-of-how-arizona-law-will-affect-new-mexicans","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2010\/04\/bingaman-wants-review-of-how-arizona-law-will-affect-new-mexicans\/","title":{"rendered":"Bingaman wants review of how Arizona law will affect New Mexicans"},"content":{"rendered":"<div id=\"attachment_7972\"  class=\"wp-caption module image alignleft\" style=\"max-width: 120px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-7972\" title=\"Bingaman, Jeff\" src=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2009\/10\/Bingaman-Jeff.jpg\" alt=\"\" width=\"120\" height=\"160\" \/><\/a><p class=\"wp-caption-text\">Jeff Bingaman<\/p><\/div>\n<p>U.S. Sen. <a href=\"http:\/\/bingaman.senate.gov\/\">Jeff Bingaman<\/a>, D-N.M., has asked Attorney General <a href=\"http:\/\/en.wikipedia.org\/wiki\/Eric_Holder\">Eric Holder<\/a> to examine how Arizona\u2019s new immigration law will affect New Mexicans traveling through that state.<\/p>\n<p>The law requires police officers in Arizona to verify the immigration status of people with whom they come in contact if they have \u201creasonable suspicion\u201d that someone is in the United States illegally.<\/p>\n<p>The problem for New Mexicans? The law states that a person can demonstrate legal status by providing an Arizona-issued license, a tribal identification card or a federal, state, or local government identification card \u2013 if the entity requires proof that the person is in the United States legally before using the ID card.<\/p>\n<p>New Mexico is one of several states that don\u2019t require people to prove they are in the United States legally to obtain a driver\u2019s license or identification card.<\/p>\n<p>\u201cResidents of states that do not require individuals to demonstrate legal status, such as New Mexico, could be detained by police while their citizenship or immigration status is verified,\u201d Bingaman wrote to Holder, according to a news release.<\/p>\n<p><!--more--><\/p>\n<p>\u201cFor New Mexicans, and the residents of similarly situated states, the detention and investigation required to check a person\u2019s status would likely be much more than a brief check of a driver\u2019s license during a traffic stop,\u201d Bingaman wrote. \u201cThis could result in the detention of U.S. citizens based on a suspicion standard which has been interpreted as articulable facts that amount to little more than a hunch.\u201d<\/p>\n<p>Bingaman wrote that it would be \u201ctroubling\u201d if New Mexicans and residents of other states in a similar situation \u2013 such as Hawaii, Utah, Washington and Maryland \u2013 had to carry U.S. passports or other proof of citizenship to travel through or visit Arizona.<\/p>\n<p>The U.S. Department of Justice is currently reviewing the legality of the controversial new Arizona law.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>U.S. Sen.
