Can Texas secede from the United States?<\/strong><\/p>\n<p dir=\"ltr\">In the wake of Britain\u2019s historic vote to leave the European Union \u2014 nicknamed the &#8220;Brexit&#8221; \u2014 speculation of a Texit on the horizon has cropped up once again. The secessionist movement has a long history in the<strong>\u00a0<\/strong>Lone Star State. Delegates for the Texas Republican Party even recently debated\u00a0<a href=\"https:\/\/www.texastribune.org\/2016\/05\/14\/texas-republicans-call-new-bathroom-law-avert-sece\/\" target=\"_blank\">adding secessionist language to the party&#8217;s platform<\/a>. But\u00a0is it actually legal for Texas to leave the United States?<\/p>\n<div id=\"attachment_164060\"  class=\"wp-caption module image alignleft\" style=\"max-width: 336px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-164060\" src=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/06\/103109_txsecession001_jv_png_800x1000_q100-336x226.png\" alt=\"Texas\" width=\"336\" height=\"226\" srcset=\"https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/06\/103109_txsecession001_jv_png_800x1000_q100-336x226.png 336w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/06\/103109_txsecession001_jv_png_800x1000_q100.png 550w\" sizes=\"auto, (max-width: 336px) 100vw, 336px\" \/><p class=\"wp-media-credit\">Jacob Villanueva \/ The Texas Tribune<\/p><p class=\"wp-caption-text\">\u201cIf there was any constitutional issue resolved by the Civil War, it is that there is no right to secede.\u201d &#8212; Antonin Scalia, late Supreme Court Justice<\/p><\/div>\n<p>Simply put, the answer is no. Historical and legal precedents make it clear that Texas could not pull off a Texit \u2014 at least not legally.<\/p>\n<p>\u201cThe legality of seceding is problematic,\u201d said Eric McDaniel, associate professor of government at the University of Texas at Austin. \u201cThe Civil War played a very big role in establishing the power of the federal government and cementing that the federal government has the final say in these issues.\u201d<\/p>\n<p>Many historians believe\u00a0that when the Confederacy surrendered at Appomattox in 1865, the idea of secession was also defeated, according to McDaniel. The Union\u2019s victory set a precedent that states could not legally secede.<\/p>\n<p>It is also important to note that the European Union is a loose association of compound states with pre-existing protocols for a nation to exit. In contrast, the U.S. Constitution contains procedures for admitting new states into the nation, but none for a state to leave.<\/p>\n<p>Yet the myth that Texas can easily<strong>\u00a0<\/strong>secede persists, in part, because of the state\u2019s history of independence.<\/p>\n<aside class=\"module align-left half type-aside\">\n<h3>About this article<\/h3>\n<p>This article originally appeared in <a href=\"https:\/\/www.texastribune.org\/2016\/06\/24\/can-texas-legally-secede-united-states\/\" target=\"_blank\">The Texas Tribune<\/a>,\u00a0a nonpartisan, nonprofit media organization that informs Texans and engages with them about public policy, politics, government and statewide issues.<\/p>\n<\/aside>\n<p>Texas declared independence from Mexico in 1836 and spent the next nine years as its own nation. While<strong>\u00a0<\/strong>the young country&#8217;s leaders\u00a0first expressed interest in becoming a state in 1836, the Republic of Texas did not join the United States until 1845, when Congress approved the\u00a0<a href=\"https:\/\/www.tsl.texas.gov\/ref\/abouttx\/annexation\/march1845.html\" target=\"_blank\">Joint Resolution for Annexing Texas to the United States<\/a>.<\/p>\n<p>This resolution, which stipulated that Texas could, in the future, choose to divide itself into &#8220;New States of convenient size not exceeding four in number, in addition to said State of Texas&#8221;\u00a0is often a cause of confusion about the state\u2019s ability to secede. But the language of the resolution is clear: Texas can split itself into five new states. It says nothing of splitting apart from the United States.<\/p>\n<p>In the years after Texas joined the union, tensions over slavery and states\u2019 rights mounted.\u00a0A state convention in 1861 voted 166 to 8 in favor of secession \u2014 a measure that was then ratified by a popular vote, making Texas the seventh state to secede from the Union.<\/p>\n<p>After the Civil War, Texas was readmitted to the Union in 1870.<\/p>\n<p>Yet even before Texas formally rejoined the nation, the U.S. Supreme Court declared that secession was not legal, and thus, even during the rebellion, Texas continued to be a state. In the 1869 case <a href=\"https:\/\/scholar.google.com\/scholar_case?case=1134912565671891096&amp;hl=en&amp;as_sdt=6&amp;as_vis=1&amp;oi=scholarr\" target=\"_blank\">Texas v. White<\/a>, the Court held that individual states could not unilaterally secede from the Union and that the acts of the insurgent Texas Legislature \u2014 even if ratified by a majority of Texans \u2014 were &#8220;absolutely null.&#8221;<!--more--><\/p>\n<p>If there were any doubt remaining after that, late Supreme Court Justice Antonin Scalia set it to rest more than a century later\u00a0with his <a href=\"http:\/\/blogs.wsj.com\/law\/2010\/02\/17\/justice-scalias-thoughts-on-state-secession-penned-to-one-man\/\" target=\"_blank\">response to a letter from a screenwriter\u00a0in 2006<\/a>\u00a0asking if there is a legal basis for secession.<\/p>\n<p>\u201cThe answer is clear,\u201d Scalia wrote. \u201cIf there was any constitutional issue resolved by the Civil War, it is that there is no right to secede.
