The statement came a day after the developers hinted that they would take the issue to District Court if the council didn\u2019t vote today.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">In between those statements, the state attorney general issued an opinion interpreting the state statute on annexations to mean the council can\u2019t legally vote on the annexation until at least May 16.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cLogos Development does not agree with today\u2019s AG decision, but the applicant stands ready to go forward on Monday, April 23, 2007,\u201d Friday\u2019s statement reads. \u201cIt is the city\u2019s choice whether to conduct the hearing then or to continue in accordance with the AG\u2019s new opinion. We stand ready to move forward.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">City Manager <a href=\"http:\/\/www.las-cruces.org\/manager\/\" target=\"_blank\">Terrence Moore<\/a> said Friday the council will likely hold off on the vote, but Mayor <a href=\"http:\/\/www.las-cruces.org\/council\/mayor.shtm\" target=\"_blank\">Bill Mattiace<\/a> told the <a href=\"http:\/\/www.lcsun-news.com\/news\/ci_5724320\" target=\"_blank\">Las Cruces Sun-News<\/a> this weekend that he doesn\u2019t know whether the council will vote today or not. <\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Though the AG says the council can\u2019t legally act on the 4,200-acre portion of the development today because of the annexation statute, the master plan for the 1,700-acre portion of the development that\u2019s already in the city could still be voted on by the council, because it doesn\u2019t involve an annexation.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Or, the council could opt to delay votes on the entire project.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The meeting begins at 5 p.m. To read the agenda, click <a href=\"http:\/\/www.las-cruces.org\/legal\/city_clerk\/City%20Council%20Agendas%20Minutes%20&#038;%20Notices\/2007%20Agendas%20&amp;%20Packets\/04-23-2007AGENDA-LandUse.rtf\" target=\"_blank\">here<\/a>.
