{"id":153281,"date":"2016-05-25T11:07:07","date_gmt":"2016-05-25T17:07:07","guid":{"rendered":"http:\/\/nmpolitics.net\/index\/?p=153281"},"modified":"2016-06-04T20:34:42","modified_gmt":"2016-06-05T02:34:42","slug":"ethics-complaints-filed-in-dona-ana-county-democratic-da-primary","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2016\/05\/ethics-complaints-filed-in-dona-ana-county-democratic-da-primary\/","title":{"rendered":"Ethics complaints filed in Do\u00f1a Ana County Democratic DA primary"},"content":{"rendered":"<p>The Secretary of State&#8217;s Office is investigating two complaints filed in the Do\u00f1a Ana County Democratic primary race for district attorney, which has, thus far, largely been characterized by mudslinging.<\/p>\n<div id=\"attachment_153030\"  class=\"wp-caption module image alignleft\" style=\"max-width: 336px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-153030\" src=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/05\/3rdDistrictCourt2-336x233.jpg\" alt=\"The Third Judicial District Courthouse in Las Cruces.\" width=\"336\" height=\"233\" srcset=\"https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/05\/3rdDistrictCourt2-336x233.jpg 336w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/05\/3rdDistrictCourt2-768x532.jpg 768w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/05\/3rdDistrictCourt2-771x534.jpg 771w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/05\/3rdDistrictCourt2-1170x811.jpg 1170w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/05\/3rdDistrictCourt2.jpg 1449w\" sizes=\"auto, (max-width: 336px) 100vw, 336px\" \/><p class=\"wp-media-credit\">Heath Haussamen \/ NMPolitics.net<\/p><p class=\"wp-caption-text\">The Third Judicial District Courthouse in Las Cruces.<\/p><\/div>\n<p>We told you about one situation when we profiled the race <a href=\"http:\/\/nmpolitics.net\/index\/2016\/05\/digging-through-mud-in-dona-ana-countys-democratic-da-primary\/\" target=\"_blank\">on Monday<\/a>: James Dickens, who is challenging incumbent Mark D&#8217;Antonio in the Democratic primary, used his access as a prosecutor in the 12th Judicial District based in Alamogordo\u00a0to compile statistics from an internal case management system.<\/p>\n<p>Now he&#8217;s using those statistics in his campaign for\u00a0Third Judicial DA in Do\u00f1a Ana county.<\/p>\n<p>D&#8217;Antonio, who has already alleged that Dickens&#8217; actions might be illegal, filed <a href=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/05\/5.19.16.DAntonioComplaintJamesDickens.pdf\" target=\"_blank\">an ethics complaint<\/a> with the SOS on Friday.<\/p>\n<p>&#8220;I was outraged to find that Mr. James Dickens is guilty of a serious ethical violation and I demand that the matter be investigated and that he be held accountable for his actions,&#8221; D&#8217;Antonio&#8217;s complaint states.<\/p>\n<p>The case management system &#8220;contains information that is not public record \u2013 like the names of people accused but not charged, methods on how certain cases are prosecuted, contact information for victims and medical records for defendants who have to undergo certain evaluations to determine if they\u2019re competent or not,&#8221; D&#8217;Antonio wrote. And, he said, a policy of the state&#8217;s Administrative Office of the District Attorneys (AODA), the government agency that maintains the\u00a0case management system, prohibits employees from using information in the system that&#8217;s not available to the public for any private interest.<\/p>\n<p>D&#8217;Antonio had already filed <a href=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/05\/5.5.16.DAntonioLetter.pdf\" target=\"_blank\">a complaint<\/a> with Dickens&#8217; boss, 12th Judicial DA David Ceballes, but his complaint to the SOS states that Ceballes has &#8220;ignored&#8221; it.<\/p>\n<p>Dickens has told NMPolitics.net that\u00a0the information is public record and he is confident he did nothing wrong. And he accused D\u2019Antonio of attacking a whistleblower who is exposing \u201chis office\u2019s abysmal record.\u201d<\/p>\n<p>\u201cThis is the typical bureaucrat\u2019s tactic when their malfeasance has been laid bare to public scrutiny,\u201d Dickens told us.<\/p>\n<p>Ken Ortiz, SOS chief of staff, said the matter is under review.<\/p>\n<h3>Anonymous flier attacks Dickens<\/h3>\n<p>The <a href=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/05\/3.28.16.MonicaGomez-Complaint.pdf\" target=\"_blank\">second complaint<\/a>, filed with the SOS on March 28 by Las Crucen Monica Gomez, relates to a flier\u00a0attacking Dickens that was handed out and placed on vehicles at a dinner hosted by the Democratic Party of Do\u00f1a Ana County on Feb. 26. The flyer doesn&#8217;t identify who paid for it &#8212; even though state law requires disclosure.<\/p>\n<p>The flier, which is included with Gomez&#8217;s complaint, aims to tie Dickens to D&#8217;Antonio&#8217;s Republican predecessors in the DA&#8217;s office &#8212; Amy Orlando and Susana Martinez. It includes photos of Dickens with both former DAs and calls Dickens a &#8220;faithful Republican.&#8221;<!--more--><\/p>\n<p>Gomez&#8217;s complaint states that the same images used in the flier &#8220;can be found on the Facebook page of Mark D&#8217;Antonio&#8217;s mother.&#8221;<\/p>\n<p>A <a href=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/05\/5.12.16.DAntonioResponse.pdf\" target=\"_blank\">follow-up letter<\/a> from Gomez dated May 12 states that the same flier had been posted on a Facebook page belonging to D&#8217;Antonio&#8217;s sister but &#8220;has since been deleted.&#8221;<\/p>\n<p>&#8220;If Mr. D\u2019Antonio was not involved in its distribution I would like to know who was due to the illegal printing and distribution of the flyer without political disclosure statements,&#8221; Gomez wrote.<\/p>\n<p>The SOS requested a response from D&#8217;Antonio <a href=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/05\/4.13.16.LettertoDAntonio.pdf\" target=\"_blank\">on April 13<\/a>\u00a0&#8212; sending the letter to the DA&#8217;s office, not D&#8217;Antonio&#8217;s campaign. D&#8217;Antonio complained to the SOS in his <a href=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/05\/4.27.16.DAntonioResponse.pdf\" target=\"_blank\">April 27 response<\/a>\u00a0about the letter being sent to the government office.<\/p>\n<p>&#8220;It is this kind of blurring the lines between candidates and public officials that may lead to a lack of public confidence in the election process,&#8221; D&#8217;Antonio wrote.<\/p>\n<p>As for the flier, D&#8217;Antonio wrote that it was not distributed by him or anyone with his campaign. &#8220;I did not authorize anyone with my campaign to display the &#8216;flyer&#8217; or make it available to the public,&#8221; D&#8217;Antonio wrote. He said it had already been circulated widely before it was posted on Facebook.<\/p>\n<p>Like the other complaint, this one is under review, Ortiz said.<\/p>\n<p>The winner of the June 7 Democratic primary will face a Republican Brad Cates, a former state and federal prosecutor and state representative, in November.
