{"id":15124,"date":"2010-03-30T06:42:11","date_gmt":"2010-03-30T12:42:11","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/?p=15124"},"modified":"2010-03-31T06:10:05","modified_gmt":"2010-03-31T12:10:05","slug":"secretary-of-state-relents-releases-un-redacted-e-mails","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2010\/03\/secretary-of-state-relents-releases-un-redacted-e-mails\/","title":{"rendered":"Secretary of state releases un-redacted e-mails"},"content":{"rendered":"<div id=\"attachment_14127\"  class=\"wp-caption module image alignright\" style=\"max-width: 250px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-14127\" title=\"Herrera, Mary\" src=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2010\/03\/Herrera-Mary.jpg\" alt=\"\" width=\"250\" height=\"232\" \/><\/a><p class=\"wp-caption-text\">Secretary of State Mary Herrera<\/p><\/div>\n<h4>This time, Herrera\u2019s office may have released too much information, news outlets report<\/h4>\n<p>Secretary of State\u00a0<a href=\"http:\/\/www.sos.state.nm.us\/sos-SecBio.html\">Mary Herrera\u2019s<\/a> office is once again shifting gears and releasing public information it had originally refused to provide.<\/p>\n<p>This time, the Secretary of State\u2019s Office relented and released hundreds of pages of e-mails to media outlets without most of the redactions that were included when the documents were first released earlier this month.<\/p>\n<p>Deputy Secretary of State <a href=\"http:\/\/www.sos.state.nm.us\/sos-DepSec.html\">Don Francisco Trujillo<\/a> was quoted by <a href=\"http:\/\/www.santafenewmexican.com\/Local%20News\/Secretary-of-State-s-Office-E-mails-reveal-tension-leading-up-t\">The Santa Fe New Mexican<\/a> as writing, in a cover letter accompanying the new, less-redacted records, that \u201cSome of the privilege reductions in the first disclosure were inadvertently overbroad.\u201d<\/p>\n<p>The New Mexican and KOB-TV in Albuquerque did their own digging <a href=\"http:\/\/www.nmpolitics.net\/index\/2010\/03\/herrera%E2%80%99s-office-is-playing-fast-and-loose-with-public-records\/\">last week<\/a> into the original, heavily redacted e-mail release and found that many of the redactions hid routine communications including a discussion about a bill being considered during the legislative session and a request from a county clerk for more Spanish-language voter registration forms.<\/p>\n<p>Herrera ditched a previously scheduled interview with KOB on Monday, instead making Trujillo available for the interview. Trujillo told KOB that Herrera had \u201csome other obligations,\u201d then went on to provide KOB with the newly un-redacted e-mails.<\/p>\n<p>\u201cWe were following our best understanding of the law,\u201d Trujillo told KOB about the initial redactions in a report you can watch <a href=\"http:\/\/www.kob.com\/article\/stories\/s1490077.shtml?cat=504\">here<\/a>, \u201cand to avoid that appearance of not wanting to be transparent, the secretary of state \u2013 here\u2019s your copy, here\u2019s an explanation, which explains basically the fact that it was just a massive amount of work to produce in a short period of time.\u201d<\/p>\n<p>This is the second time the Secretary of State\u2019s Office has relented after initially refusing to release information that is public under the <a href=\"http:\/\/www.nmag.gov\/pdf\/AGO%20IPRA%20Guide.pdf\">New Mexico Inspection of Public Records Act<\/a>. Trujillo\u00a0<a href=\"http:\/\/www.nmpolitics.net\/index\/2010\/03\/sos-refuses-to-release-salazar%e2%80%99s-resignation-letter\/\">initially denied<\/a> media requests for a copy former Election Director A.J. Salazar\u2019s resignation letter \u2013 a letter that was damaging to Herrera because it made\u00a0<a href=\"http:\/\/www.nmpolitics.net\/index\/2010\/03\/herrera-runs-%e2%80%98a-crooked-organization%e2%80%99-former-elections-head-claims\/\">a number of allegations<\/a> of violations of state law and unethical behavior.<\/p>\n<p>After the New Mexico Foundation for Open Government said the letter was a public record \u2013 and the Rio Grande Sun released\u00a0<a href=\"http:\/\/www.nmpolitics.net\/index\/2010\/03\/salazar%E2%80%99s-resignation-letter-is-now-available-online\/\">an un-redacted version of it<\/a> \u2013 the office shifted gears and released\u00a0<a href=\"http:\/\/www.nmpolitics.net\/index\/2010\/03\/sos-releases-redacted-version-of-salazar%e2%80%99s-resignation-letter\/\">a redacted version<\/a>.<\/p>\n<h3>Did Herrera release too much information?<\/h3>\n<p>But there\u2019s a new controversy over information that\u2019s un-redacted in the most recent e-mail release. The Internet version of KOB\u2019s report states that \u201cthat too much information may have been released,\u201d which may violate federal law regarding the release of medical records.<\/p>\n<p>In some of the newly released e-mails, Salazar \u201cspecifically asks that his medical conditions relating to his time served in Iraq not be made public.\u201d But in some of the released e-mails, \u201cthe secretary of state\u2019s office released at least three unredacted emails having to do with his medical condition, and one that referenced a member of Salazar\u2019s family and their medical condition,\u201d according to KOB.<\/p>\n<p>The New Mexican\u2019s article makes reference to the same thing:<\/p>\n<blockquote><p>\u201cWhile in the previous batch of documents released, the secretary of state went overboard in blacking out information, in the latest batch the office might have gone too far the other way.
