Schiff<\/span><\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The former president of the architect firm that designed the courthouse, <a href=\"http:\/\/www.dcsw.com\/\" target=\"_blank\">Design Collaborative Southwest<\/a>, has agreed to plead guilty to one felony count of conspiracy and one felony count of mail fraud.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The conspiracy charge carries a maximum prison sentence of 5 years and a $250,000 fine. The mail fraud charge carries a maximum prison sentence of 20 years and a $250,000 fine. Both could also result in restitution.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Schiff stated in his <a href=\"http:\/\/www.usdoj.gov\/usao\/nm\/pr\/plea_schiff.pdf\" target=\"_blank\">plea agreement<\/a> that the scheme began when his company\u2019s lobbyist, former Albuquerque Mayor Ken Schultz, wanted a cash bonus for securing the architect contract. As additional contracts were awarded \u2013 there were many \u2013 Schultz wanted additional cash bonuses. At some point, Schiff stated, he learned that Schultz was giving some of the cash to former Senate President Manny Aragon and former Metro Court Administrator Toby Martinez.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cI continued to make cash payments to Schultz because I feared that DCSW would be removed from the contract or sued if payments stopped,\u201d he stated in the agreement.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Schiff said <st1:city st=\"on\">Martinez<\/st1:City> instructed him to submit false invoices, and \u201cthe proceeds were then used to pay kickbacks to <st1:country-region st=\"on\">Aragon<\/st1:country-region> and <st1:city st=\"on\"><st1:place st=\"on\">Martinez<\/st1:place><\/st1:City>.\u201d He said he personally gave some of the money to <st1:country-region st=\"on\">Aragon<\/st1:country-region> \u2013 two payments of $10,000 each \u2013 and was also present when Schultz, at an <st1:city st=\"on\">Albuquerque<\/st1:City> restaurant, passed <st1:country-region st=\"on\"><st1:place st=\"on\">Aragon<\/st1:place><\/st1:country-region> an envelope containing $30,000.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The estimated loss to the state as a result of Schiff\u2019s criminal activity is between $400,000 and $1 million, the plea agreement states.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p style=\"font-weight: bold;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">Ken Schultz<\/span><\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Schultz has agreed to plead guilty to the same charges and faces the same potential penalties. He admitted in his <a href=\"http:\/\/www.usdoj.gov\/usao\/nm\/pr\/plea_schultz.pdf\" target=\"_blank\">plea agreement<\/a> to taking cash payments from Schiff, keeping some for himself and giving some to <st1:city st=\"on\"><st1:place st=\"on\">Martinez<\/st1:place><\/st1:City>. He stated that he \u201cwas also aware\u201d that <st1:country-region st=\"on\"><st1:place st=\"on\">Aragon<\/st1:place><\/st1:country-region> was receiving payments, but does not admit to making such payments.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The estimated loss as a result of Schultz\u2019s criminal activity is between $40,000 and $70,000. The plea agreement estimates his personal gain at $50,000, for which he may be asked to pay restitution.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p style=\"font-weight: bold;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">Manuel Guara<\/span><\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Guara has also agreed to plead guilty to the same charges and faces the same potential penalties. He stated in his <a href=\"http:\/\/www.usdoj.gov\/usao\/nm\/pr\/plea_guara.pdf\" target=\"_blank\">plea agreement<\/a> that he was recruited by Raul Parra, the contractor hired to do the audio and video wiring for the courthouse and a defendant in the case, to be a subcontractor. When he was preparing invoices for the work, Parra, \u201ctold me how much to mark up the invoices,\u201d he stated in the agreement, calling the amounts \u201csubstantial.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Guara received the mark-up money in payments for the work, and it totaled about $3 million, he stated.
