{"id":14930,"date":"2010-03-23T12:23:50","date_gmt":"2010-03-23T18:23:50","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/?p=14930"},"modified":"2010-03-23T19:07:54","modified_gmt":"2010-03-24T01:07:54","slug":"probe-involving-city-manager-isn%e2%80%99t-finished-da-says","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2010\/03\/probe-involving-city-manager-isn%e2%80%99t-finished-da-says\/","title":{"rendered":"Probe involving city manager isn\u2019t finished, district attorney says"},"content":{"rendered":"<div id=\"attachment_11668\"  class=\"wp-caption module image alignright\" style=\"max-width: 270px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-11668 \" title=\"Moore, Terrence 2\" src=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2010\/01\/Moore-Terrence-2.jpg\" alt=\"\" width=\"270\" height=\"236\" \/><\/a><p class=\"wp-caption-text\">Las Cruces City Manager Terrence Moore (Photo by Heath Haussamen)<\/p><\/div>\n<p>The district attorney says her office is still reviewing part of a probe involving Las Cruces City Manager\u00a0<a href=\"http:\/\/las-cruces.org\/manager\/\">Terrence Moore<\/a>, and the sheriff\u2019s department is still investigating other, related allegations.<\/p>\n<p>\u201cWe have not made a decision in the case and we will not make a decision until the entire investigation is complete,\u201d Do\u00f1a Ana County District Attorney <a href=\"http:\/\/www.da.state.nm.us\/districts\/third\/index.html\">Susana Martinez<\/a> said today.<\/p>\n<p>She declined to specify what is still under investigation, but said it is \u201csomehow related to this situation and\/or Terrence Moore.\u201d Martinez also said it\u2019s \u201cimpossible to tell at this point\u201d how long the investigation will take.<\/p>\n<p>Martinez\u2019s comments differ from those <a href=\"http:\/\/www.nmpolitics.net\/index\/2010\/03\/results-of-probe-involving-city-manager-could-be-released-today\/\">made Thursday<\/a> by Do\u00f1a Ana County Sheriff\u2019s Department Sgt. Joe Reynaud, who said the department\u2019s investigation into two incidents involving Moore and his ex-wife was complete and had been forwarded to the DA for review. He also said he hoped the DA review would be complete that same day.<\/p>\n<p>But Martinez said it would be improper to make a final decision and publicly release the results of part of an investigation while other, related matters are pending, \u201cbecause the second phase of the investigation may reveal something that is relevant to the first phase of the investigation, and that may take you back to having to follow up some more on the first part.\u201d<\/p>\n<p>Martinez declined to specify whether what\u2019s pending involves the situation with Moore and his ex-wife or whether the investigation has been expended to include other allegations that don\u2019t involve Moore\u2019s ex-wife. Moore has been under scrutiny lately for two other issues:<\/p>\n<p>\u2022 Moore recently reimbursed the city for some costs associated with\u00a0<a href=\"http:\/\/www.nmpolitics.net\/index\/2010\/01\/cruces-manager-reimburses-city-for-travel-costs\/\">two business trips<\/a> he took last year \u2013 after a complaint was filed over one trip and an attorney requested documentation about the other.<\/p>\n<p>\u2022 He also had his administrative assistant\u00a0<a href=\"http:\/\/www.nmpolitics.net\/index\/2010\/01\/las-cruces-manager-had-city-staffer-babysit-kids\/\">babysit his children<\/a> on Dec. 21 \u2013 while she was on the clock and being paid with public money \u2013 so he could attend a city council meeting.<\/p>\n<h3>The history<\/h3>\n<p>The sheriff\u2019s department has been\u00a0<a href=\"http:\/\/www.nmpolitics.net\/index\/2010\/03\/sheriff-takes-over-case-involving-las-cruces-city-manager\/\">investigating two incidents<\/a> involving Moore and his ex-wife. The department took over what was originally an LCPD probe after the district attorney raised concerns about LCPD investigating a case involving its own boss and urged the transfer.<\/p>\n<p>Moore oversees the police chief and, by extension, the police department.<\/p>\n<p>Last year, Las Cruces police looked into injuries Moore\u2019s then-wife suffered in late 2008 and questions surrounding a police report the city manager filed over a prescription-drug incident in January 2009, treating the two incidents as a single case. Las Cruces police closed the case last year without filing charges.<\/p>\n<p>Interim Police Chief Pete Bradley has said the case was dropped because no one, including Moore\u2019s ex-wife, alleged a crime, and police didn\u2019t have probable cause to proceed. Moore has pointed out that no one has alleged \u201cthat I\u2019ve done anything wrong.\u201d<\/p>\n<p>LCPD never interviewed Moore. The district attorney has said that should have been done, and that\u2019s one of the reasons she urged a new probe by the sheriff.
