{"id":140885,"date":"2016-04-01T11:51:19","date_gmt":"2016-04-01T17:51:19","guid":{"rendered":"http:\/\/nmpolitics.net\/index\/?p=140885"},"modified":"2016-04-03T10:51:32","modified_gmt":"2016-04-03T16:51:32","slug":"da-drops-most-serious-charge-against-county-jail-director","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2016\/04\/da-drops-most-serious-charge-against-county-jail-director\/","title":{"rendered":"DA drops most serious charges against county jail director"},"content":{"rendered":"<p>The most serious criminal charges against Chris Barela, the director of the Do\u00f1a Ana County Detention Center, have\u00a0been dropped, at least for now.<\/p>\n<div id=\"attachment_107299\"  class=\"wp-caption module image alignleft\" style=\"max-width: 336px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-107299\" src=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/12\/Barela-Chris-336x252.jpg\" alt=\"Chris Barela\" width=\"336\" height=\"252\" srcset=\"https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/12\/Barela-Chris-336x252.jpg 336w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/12\/Barela-Chris.jpg 550w\" sizes=\"auto, (max-width: 336px) 100vw, 336px\" \/><p class=\"wp-media-credit\">Courtesy photo<\/p><p class=\"wp-caption-text\">Chris Barela<\/p><\/div>\n<p>The office of District Attorney Mark D&#8217;Antonio filed <a href=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2016\/04\/BarelaNoticeToDismiss.pdf\" target=\"_blank\">a notice<\/a>\u00a0in court Friday that it&#8217;s dismissing a second-degree felony charge of fraud over $20,000 or, in the alternative, embezzlement over $20,000.<\/p>\n<p>D&#8217;Antonio&#8217;s office left open the possibility of refiling the fraud and\/or embezzlement charges &#8220;pending further investigation,&#8221; the notice states.<\/p>\n<p>But for now,\u00a0&#8220;as it relates to those charges, there is not sufficient evidence to take to the grand jury or present at a preliminary hearing,&#8221; said Patrick Hayes, a spokesman for the DA&#8217;s office. &#8220;They&#8217;re being dropped now because going to a grand jury or preliminary hearing is imminent.&#8221;<\/p>\n<p>Hayes said he couldn&#8217;t comment on the likelihood of refiling the fraud or embezzlement charges but said &#8220;the option is there. It\u00a0depends on the investigating agency and if it wants to continue its investigation.&#8221;<\/p>\n<p>In December, Sheriff Enrique \u201cKiki\u201d Vigil filed <a href=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/12\/BarelaChrisCriminalComplaint.pdf\" target=\"_blank\">a criminal complaint<\/a> against Barela, <a href=\"http:\/\/nmpolitics.net\/index\/2015\/12\/sheriff-takes-control-of-county-jail-arrests-administrator\/\" target=\"_blank\">had him arrested<\/a>, and <a href=\"http:\/\/nmpolitics.net\/index\/2015\/12\/county-releases-video-photos-of-sheriff-taking-over-jail\/\" target=\"_blank\">briefly took control of the jail<\/a>. The other charges Vigil alleged in the complaint &#8212;\u00a0bringing contraband into the jail and willful neglect of duty &#8212; remain.<\/p>\n<p>The contraband charge is\u00a0a fourth-degree felony that carries a maximum prison sentence of 18 months. The charge relates to Barela carrying a semi-automatic rifle into a room where an inmate who had taken another inmate\u00a0hostage was being held.\u00a0Willful neglect of duty is a misdemeanor that carries a maximum sentence of one year.<\/p>\n<p>The charges D&#8217;Antonio dismissed carried a maximum prison sentence of nine years.<!--more--><\/p>\n<p>As NMPolitics.net reported <a href=\"http:\/\/nmpolitics.net\/index\/2015\/12\/jail-director-is-accused-of-misusing-funds-not-pocketing-them\/\" target=\"_blank\">in December<\/a>, the fraud or embezzlement charge centered on allegations that Barela\u00a0spent money earmarked\u00a0for\u00a0the \u201chealth and morale\u201d of inmates on other jail-related expenses \u2014 such as\u00a0clothing, bedding, toiletries,\u00a0paying inmates to work,\u00a0and meals for jail employees.\u00a0In addition, Barela donated inmates\u2019 gym equipment to the Police Athletic League, where he was a boxing coach.<\/p>\n<p>Barela\u00a0was accused of misusing funds, not pocketing them,\u00a0and some questioned why the sheriff\u00a0believed the situation amounted to\u00a0more than an audit finding.<\/p>\n<p>Barela&#8217;s attorney filed notice in March of the jail director&#8217;s intent to <a href=\"http:\/\/www.lcsun-news.com\/story\/news\/local\/2016\/03\/03\/detention-center-director-may-sue-do-ana-county\/81276396\/\" target=\"_blank\">sue the county<\/a>.
