{"id":1403,"date":"2007-03-13T21:20:00","date_gmt":"2007-03-14T03:20:00","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/2007\/03\/senate-approves-campaign-contribution-limits\/"},"modified":"2007-03-13T21:20:00","modified_gmt":"2007-03-14T03:20:00","slug":"senate-approves-campaign-contribution-limits","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2007\/03\/senate-approves-campaign-contribution-limits\/","title":{"rendered":"Senate approves campaign contribution limits"},"content":{"rendered":"<p><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/3.bp.blogspot.com\/_IabUCQmoheQ\/RfdqPe6EkuI\/AAAAAAAABhw\/zz9f2lIN60I\/s1600-h\/Legislature.jpg\"><img decoding=\"async\" style=\"margin: 0pt 10px 10px 0pt; float: left; cursor: pointer;\" src=\"http:\/\/3.bp.blogspot.com\/_IabUCQmoheQ\/RfdqPe6EkuI\/AAAAAAAABhw\/zz9f2lIN60I\/s200\/Legislature.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5041615122091774690\" border=\"0\" \/><\/a>After a long and contentious debate earlier today, the Senate approved a bill that places limits on campaign contributions to candidates for state offices, but only after making several amendments that make it significantly different than the bill already approved by the House.  <\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">On a vote of 25-12, the Senate approved <a href=\"http:\/\/legis.state.nm.us\/lcs\/_session.asp?chamber=S&#038;type=++&amp;number=800&#038;year=07\" target=\"_blank\">Senate Bill 800<\/a>, sponsored by <a href=\"http:\/\/legis.state.nm.us\/lcs\/legdetails.asp?Name=259&amp;Submit=Search\" target=\"_blank\">Dede Feldman<\/a>, D-Albuquerque. It would create a number of new campaign finance reporting requirements for candidates and political action committees and would limit campaign contributions to candidates to $2,300 for state races during each election cycle. Primary and general elections are considered separate cycles under the proposal.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Midway through the debate, the bill appeared dead when an amendment sponsored by Sen. <a href=\"http:\/\/legis.state.nm.us\/lcs\/legdetails.asp?Name=281&#038;Submit=Search\" target=\"_blank\">Leonard Lee Rawson<\/a>, R-Las Cruces, was approved that stipulated that the bill would go into effect in the year 3007.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">After Feldman chastised those who voted for the amendment, senators voted to amend the bill\u2019s effective date back to Jan. 1, 2008.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cI think this is a serious public policy issue for <st1:state st=\"on\"><st1:place st=\"on\">New Mexico<\/st1:place><\/st1:state>,\u201d Feldman said, adding that she wanted the bill, if it was to die, to die on the \u201cissues\u201d and not an amendment \u201cthat makes fun of the issue.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\n<p class=\"MsoNormal\">The primary amendment that makes the bill different than the House version of the proposal makes it apply to contributions both to candidates and political action committees. The House version of the bill, <a href=\"http:\/\/legis.state.nm.us\/lcs\/_session.asp?year=07&amp;chamber=H&#038;number=821&amp;type=++\" target=\"_blank\">House Bill 821<\/a>, sponsored by Rep. <a href=\"http:\/\/legis.state.nm.us\/lcs\/legdetails.asp?Name=229&#038;Submit=Search\" target=\"_blank\">Mimi Stewart<\/a>, D-Albuquerque, only applies to contributions to candidates.<\/p>\n<p class=\"MsoNormal\">\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">In the Senate bill, the limit for contributions to PACs is $5,000.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Under the proposal, the limit for contributions to candidates would increase to keep pace with the federal limit, which is currently $2,300 and rises slightly every year. <\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\" target=\"_blank\">Sen. <a href=\"http:\/\/legis.state.nm.us\/lcs\/legdetails.asp?Name=270&amp;Submit=Search\" target=\"_blank\">Steve Komadina<\/a>, R-Corrales, opposed the bill. He asked for examples of special-interest money having too much influence on the Legislature.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Feldman cited polls that indicate the public supports campaign contribution limits but said she \u201ccan\u2019t think of any examples offhand.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cSenator, a lot of people perceive a lot of things,\u201d Komadina said. \u201c\u2026 I think perception and reality are totally different things.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">He added that he \u201cwould hate\u201d to pass the bill without facts.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Feldman said she is \u201cnot saying that <st1:state st=\"on\"><st1:place st=\"on\">New Mexico<\/st1:place><\/st1:state> public officials are corrupt,\u201d but her intent is \u201cto help us do our jobs with the confidence of the public, and I think this bill will help us do that.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cI think we are good people\u2026 trapped in a flawed system, and we\u2019re trying to do the best we can, and it\u2019s pretty difficult,\u201d Feldman said.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Komadina wasn\u2019t convinced.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cBy passing this we tend to, again, just give the public perception more fuel,\u201d Komadina said in arguing that he believes the perception is false. \u201c\u2026 This bill absolutely makes no sense to me at all and, again, I refuse to feed to public perceptions of the people of the state of <st1:state st=\"on\"><st1:place st=\"on\">New Mexico<\/st1:place><\/st1:state>.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p style=\"font-weight: bold;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">Senators debate role of PACs<\/span><\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">It was Sen. <a href=\"http:\/\/legis.state.nm.us\/lcs\/legdetails.asp?Name=264&#038;Submit=Search\" target=\"_blank\">Clinton Harden<\/a>, R-Clovis, who proposed the amendment that would expand the bill to place the limits on gifts to political action committees.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">He said the bill is \u201cclearly trying to level the playing field\u201d and prevent rich people from being able to \u201cbuy an election.\u201d He said the limits are more about equal influence than they are about stopping corruption.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cIt creates a level playing field for everybody who\u2019s running for office,\u201d he said. \u201cIf you\u2019re going to mass a lot of money, you\u2019re going to have to talk to a lot of people.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">But he said, without the amendments, massive contributions could be given to PACs who would \u201caffect campaigns,\u201d and the intent of the bill would be lost.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Feldman accepted the amendment as friendly.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">A second amendment that played off Harden\u2019s was defeated after a contentious debate. Sen. <a href=\"http:\/\/legis.state.nm.us\/lcs\/legdetails.asp?Name=249&amp;Submit=Search\" target=\"_blank\">Rod Adair<\/a>, R-Roswell, proposed amendment that would make the $2,300 limit apply to in-kind contributions of labor from political action committees. Feldman objected, saying in-kind gifts of labor \u201cencourage volunteerism.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cThis certainly would not encourage volunteerism,\u201d Feldman said of Adair\u2019s proposed amendment. \u201cRestricting volunteers, whether they be the NRA, unions\u2026 is bad public policy.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">But Adair argued that the proposal simply placed a value on volunteerism and other in-kind contributions and would help create \u201ca level playing field, which is supposed to be the intent of the bill.\u201d He said groups that contribute a number of hours to a campaign could influence a candidate as much as a large contribution from a wealthy donor.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Sen. <a href=\"http:\/\/legis.state.nm.us\/lcs\/legdetails.asp?Name=278&amp;Submit=Search\" target=\"_blank\">William Payne<\/a>, R-Albuquerque, said the bill, without the amendment, \u201cclearly benefits the majority party\u201d by hampering Republicans\u2019 ability to accept large contributions of money without also limiting Democrats\u2019 help from labor unions and other liberal lobby groups.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The proposed amendment was defeated on a vote of 18-18. Tie votes result in a failure of motions.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The Senate bill now goes to the House for consideration.
