{"id":1372,"date":"2007-03-08T17:54:00","date_gmt":"2007-03-08T23:54:00","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/2007\/03\/richardson-signs-surface-owners-protection-act\/"},"modified":"2007-03-08T17:54:00","modified_gmt":"2007-03-08T23:54:00","slug":"richardson-signs-surface-owners-protection-act","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2007\/03\/richardson-signs-surface-owners-protection-act\/","title":{"rendered":"Richardson signs surface owners protection act"},"content":{"rendered":"<p><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/1.bp.blogspot.com\/_IabUCQmoheQ\/RfCiWBXOvEI\/AAAAAAAABbE\/ZL3LSVVF8gI\/s1600-h\/Legislature.jpg\"><img decoding=\"async\" style=\"margin: 0pt 0pt 10px 10px; float: right; cursor: pointer;\" src=\"http:\/\/1.bp.blogspot.com\/_IabUCQmoheQ\/RfCiWBXOvEI\/AAAAAAAABbE\/ZL3LSVVF8gI\/s200\/Legislature.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5039706482234276930\" border=\"0\" \/><\/a>Gov. <a href=\"http:\/\/governor.state.nm.us\/\" target=\"_blank\">Bill Richardson<\/a> signed today a bill that would require oil and gas companies to pay landowners for damage to their property caused by drilling.  <\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><a href=\"http:\/\/legis.state.nm.us\/lcs\/_session.asp?w=com&#038;year=07&#038;chamber=H&#038;type=++&#038;number=827\" target=\"_blank\">House Bill 827<\/a>, sponsored by Rep. <a href=\"http:\/\/legis.state.nm.us\/lcs\/legdetails.asp?Name=213&#038;Submit=Search\" target=\"_blank\">Andy Nu\u00f1ez<\/a>, D-Hatch, is a compromise on an issue that has been contentious for years but, in the end, actually had the endorsement of the oil and gas industry and ranchers.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Under the compromise, the bill protects landowners who don\u2019t own the mineral rights below their land, which is common in <st1:state st=\"on\"><st1:place st=\"on\">New Mexico<\/st1:place><\/st1:state>. It requires the oil and gas industry to notify landowners 30 days prior to any oil and gas operations, to describe the operations, and to propose a surface use and compensation agreement.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/3.bp.blogspot.com\/_IabUCQmoheQ\/RfCiQhXOvDI\/AAAAAAAABa8\/b4CTgCkP41Q\/s1600-h\/Richardson,+Bill.jpg\"><img decoding=\"async\" style=\"margin: 0pt 10px 10px 0pt; float: left; cursor: pointer;\" src=\"http:\/\/3.bp.blogspot.com\/_IabUCQmoheQ\/RfCiQhXOvDI\/AAAAAAAABa8\/b4CTgCkP41Q\/s200\/Richardson,+Bill.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5039706387744996402\" border=\"0\" \/><\/a>The landowner then has 20 days to accept, negotiate or reject the offer. If no agreement is reached between the landowner and company, a bond must be posted before operations begin.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Lt. Gov. <a href=\"http:\/\/www.ltgovernor.state.nm.us\/\" target=\"_blank\">Diane Denish<\/a> praised Nu\u00f1ez.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cAs someone who grew up in the \u2018oil patch\u2019 down in <st1:place st=\"on\"><st1:city st=\"on\">Hobbs<\/st1:city>, <st1:state st=\"on\">N.M.<\/st1:state><\/st1:place>, I applaud Rep. Andy Nu\u00f1ez for carrying House Bill 827, the House and Senate for passing the legislation and Governor Bill Richardson for signing it into law,\u201d she said. \u201cI want to acknowledge <st1:state st=\"on\"><st1:place st=\"on\">New   Mexico<\/st1:place><\/st1:state>\u2019s oil and gas industry for joining with ranchers, landowners and legislators to craft sensible, sorely needed legislation to provide broad protections for surface owners.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Attorney General <a href=\"http:\/\/www.ago.state.nm.us\/\" target=\"_blank\">Gary King<\/a> agreed.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cFor years, <st1:state st=\"on\"><st1:place st=\"on\">New   Mexico<\/st1:place><\/st1:state> has faced the challenge of balancing the needs of our thriving energy industry and respecting the rights of private land owners,\u201d King said. \u201cThis bill brings all interests closer to that goal.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gov.
