{"id":1346,"date":"2007-03-05T08:31:00","date_gmt":"2007-03-05T14:31:00","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/2007\/03\/bill-to-protect-surface-owners-heads-to-governor\/"},"modified":"2007-03-05T08:31:00","modified_gmt":"2007-03-05T14:31:00","slug":"bill-to-protect-surface-owners-heads-to-governor","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2007\/03\/bill-to-protect-surface-owners-heads-to-governor\/","title":{"rendered":"Bill to protect surface owners heads to governor"},"content":{"rendered":"<p><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/4.bp.blogspot.com\/_IabUCQmoheQ\/Rewp1SgwN1I\/AAAAAAAABU0\/WlJCpMh0Gl0\/s1600-h\/Legislature.jpg\"><img decoding=\"async\" style=\"margin: 0pt 10px 10px 0pt; float: left; cursor: pointer;\" src=\"http:\/\/4.bp.blogspot.com\/_IabUCQmoheQ\/Rewp1SgwN1I\/AAAAAAAABU0\/WlJCpMh0Gl0\/s200\/Legislature.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5038448078599763794\" border=\"0\" \/><\/a>A bill that would require oil and gas companies to pay landowners for damage to their property caused by drilling became this weekend the first House bill of the session to head to the governor for a signature.  <\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><a href=\"http:\/\/legis.state.nm.us\/lcs\/_session.asp?w=com&#038;year=07&#038;chamber=H&#038;type=++&#038;number=827\" target=\"_blank\">House Bill 827<\/a>, sponsored by Rep. <a href=\"http:\/\/legis.state.nm.us\/lcs\/legdetails.asp?Name=213&#038;Submit=Search\" target=\"_blank\">Andy Nu\u00f1ez<\/a>, D-Hatch, was approved Saturday by the Senate on a vote of 25-0.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The bill was approved Wednesday by the House on a vote of 62-5, and moved through two Senate committees and the full Senate in three days.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The proposal has been contentious for years, but compromises this year have earned it the endorsements of the oil and gas industry and ranchers.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/4.bp.blogspot.com\/_IabUCQmoheQ\/Rewp6SgwN2I\/AAAAAAAABU8\/46BZbQ4TgIE\/s1600-h\/Nunez,+Andy.jpg\"><img decoding=\"async\" style=\"margin: 0pt 0pt 10px 10px; float: right; cursor: pointer;\" src=\"http:\/\/4.bp.blogspot.com\/_IabUCQmoheQ\/Rewp6SgwN2I\/AAAAAAAABU8\/46BZbQ4TgIE\/s200\/Nunez,+Andy.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5038448164499109730\" border=\"0\" \/><\/a>Under the compromise, the bill would protect landowners who don\u2019t own the mineral rights below their land, which is common in <st1:state st=\"on\"><st1:place st=\"on\">New Mexico<\/st1:place><\/st1:state>. The bill would require the oil and gas industry to notify landowners 30 days prior to any oil and gas operations, to describe the operations, and to propose a surface use and compensation agreement.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The landowner then has 20 days to accept, negotiate or reject the offer.
