Following <st1:state st=\"on\">Madrid<\/st1:state>\u2019s gains in the polls throughout September, on Oct. 4 the first of three polls by national companies found that <st1:state st=\"on\"><st1:place st=\"on\">Madrid<\/st1:place><\/st1:state> had taken the lead in the race. The third came out on Oct. 17.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">That\u2019s about the same time former U.S. Attorney David Iglesias says a member of Congress he hasn\u2019t named, but <a href=\"http:\/\/www.realcities.com\/mld\/krwashington\/16813951.htm\" target=\"_blank\">most believe<\/a> to be <st1:place st=\"on\"><st1:city st=\"on\">Wilson<\/st1:city><\/st1:place>, called him. A week and a half later, most likely only days after an <a href=\"http:\/\/haussamen.blogspot.com\/2006\/10\/journal-polls-reveal-tightest-races-in.html\">Albuquerque Journal poll<\/a> became the fourth to give <st1:state st=\"on\"><st1:place st=\"on\">Madrid<\/st1:place><\/st1:state> the lead, Iglesias claims a second member of Congress called. Most believe that was Sen. <a href=\"http:\/\/domenici.senate.gov\/\" target=\"_blank\">Pete Domenici<\/a>, R-N.M.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/2.bp.blogspot.com\/_IabUCQmoheQ\/Rei8oWde5-I\/AAAAAAAABT4\/2w1OPgPO4e8\/s1600-h\/Wilson,+Heather.jpg\"><img decoding=\"async\" style=\"margin: 0pt 0pt 10px 10px; float: right; cursor: pointer;\" src=\"http:\/\/2.bp.blogspot.com\/_IabUCQmoheQ\/Rei8oWde5-I\/AAAAAAAABT4\/2w1OPgPO4e8\/s200\/Wilson,+Heather.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5037483584623929314\" border=\"0\" \/><\/a>The intent of both callers, Iglesias claims, was to pressure him to issue indictments in a massive public corruption investigation involving the construction of government buildings in <st1:place st=\"on\"><st1:placename st=\"on\">Bernalillo<\/st1:placename> <st1:placetype st=\"on\">County<\/st1:placetype><\/st1:place> in time to sway voters in the November election.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">His allegations about the phone calls have led to the subpoenas of Iglesias and three of the other seven <st1:country-region st=\"on\"><st1:place st=\"on\">U.S.<\/st1:place><\/st1:country-region> attorneys the Bush Administration fired a month after the November election. The Justice Department says seven of the eight, including Iglesias, were fired over performance issues; Iglesias disputes that, but says he\u2019s afraid of retaliation and won\u2019t name the members of Congress except under oath.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">In an exclusive interview, <st1:state st=\"on\"><st1:place st=\"on\">Madrid<\/st1:place><\/st1:state> said she wouldn\u2019t be surprised if Iglesias is telling the truth, because she believes Domenici and Wilson may have had a hand in another massive public corruption scandal prosecuted by his office.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/1.bp.blogspot.com\/_IabUCQmoheQ\/Rei8lGde59I\/AAAAAAAABTw\/pdteJtYxjpM\/s1600-h\/Domenici,+Pete.jpg\"><img decoding=\"async\" style=\"margin: 0pt 10px 10px 0pt; float: left; cursor: pointer;\" src=\"http:\/\/1.bp.blogspot.com\/_IabUCQmoheQ\/Rei8lGde59I\/AAAAAAAABTw\/pdteJtYxjpM\/s200\/Domenici,+Pete.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5037483528789354450\" border=\"0\" \/><\/a>She said Iglesias, a Republican, kept her office from having any involvement in prosecution of the state treasurer scandal. She believes that was \u201cprobably\u201d done at the urging of Republican operatives and designed to give <st1:city st=\"on\">Wilson<\/st1:city> fuel to attack <st1:state st=\"on\"><st1:place st=\"on\">Madrid<\/st1:place><\/st1:state> for doing nothing about the scandal.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">It worked, <st1:state st=\"on\">Madrid<\/st1:state> pointed out: <st1:place st=\"on\"><st1:city st=\"on\">Wilson<\/st1:city><\/st1:place> won by 861 votes out of more than 211,000.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><st1:state st=\"on\"><st1:place st=\"on\">Madrid<\/st1:place><\/st1:state> said the allegations call into question the independence of decisions made by Iglesias in the Vigil case and courthouse investigation, in which indictments could come later this month.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cHeather Wilson and Domenici acted unethically if they placed those calls,\u201d <st1:state st=\"on\"><st1:place st=\"on\">Madrid<\/st1:place><\/st1:state> said. \u201cI think these questions should be answered.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Spokesmen for Domenici and Wilson did not return phone calls seeking comment for this article, and both have repeatedly refused to comment on Iglesias\u2019 allegations. Iglesias could not be reached for comment, but told <a href=\"http:\/\/www.npr.org\/templates\/story\/story.php?storyId=7673301\" target=\"_blank\">National Public Radio<\/a> on Thursday that the October phone calls were the first he ever received from members of Congress attempting to influence an investigation.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p style=\"font-weight: bold;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">Stonewalled on treasurer investigation<\/span><\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><st1:state st=\"on\"><st1:place st=\"on\">Madrid<\/st1:place><\/st1:state> said her office was involved in 2005 in the early stages of the investigation of the treasurer scandal, along with the state\u2019s Taxation and Revenue Department, but the FBI stepped in, took control of the investigation and ordered her to stay away.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><st1:state st=\"on\">Madrid<\/st1:state> contends that was likely done at the urging of Republicans, who may have been preparing to fight what, at the time, was only a potential <st1:state st=\"on\">Madrid<\/st1:state> campaign against <st1:city st=\"on\"><st1:place st=\"on\">Wilson<\/st1:place><\/st1:city>. The congresswoman repeatedly attacked <st1:state st=\"on\"><st1:place st=\"on\">Madrid<\/st1:place><\/st1:state> during the campaign for doing nothing about the corruption in the treasurer\u2019s office.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\n<p class=\"MsoNormal\">\u201cWe were deliberately kept out by the Justice Department, the <st1:country-region st=\"on\">U.S.<\/st1:country-region> attorney and the FBI,\u201d <st1:place st=\"on\"><st1:state st=\"on\">Madrid<\/st1:state><\/st1:place> said, adding that she believes it is likely that Iglesias, Domenici, Wilson and Bush political adviser <a href=\"http:\/\/en.wikipedia.org\/wiki\/Karl_Rove\" target=\"_blank\">Karl Rove<\/a> \u201chad these prosecutions so intertwined with this campaign.\u201d<\/p>\n<p class=\"MsoNormal\">\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">In the end, former Treasurer Michael Montoya and three others, all Democrats, pleaded guilty in exchange for their testimony against former Treasurer Robert Vigil, whose first trial ended in a hung jury in May. On the second try in September, Vigil was convicted on one felony count of attempted bribery but acquitted on 23 other counts.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Vigil was sentenced to 37 months in prison, but is appealing the conviction.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><st1:state st=\"on\"><st1:place st=\"on\">Madrid<\/st1:place><\/st1:state> said Iglesias\u2019 office handled the case \u201cincompetently\u201d from the start. She said Vigil was \u201cthe least culpable\u201d of all the defendants, and yet the others received plea bargains in an attempt to take him down. She said she was distressed that Iglesias was letting the others off \u201ctoo easily,\u201d and believes there may have been political pressure to go after Vigil because he was a Democrat who was still in office when the scandal broke.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">In response, <st1:state st=\"on\"><st1:place st=\"on\">Madrid<\/st1:place><\/st1:state> indicted in June the four who testified against Vigil in the first federal trial, basing the state charges on their testimony against Vigil. When those defendants cried foul, saying they had immunity, it became clear that federal prosecutors had promised federal immunity, but never sought or received a pledge of state immunity from <st1:state st=\"on\"><st1:place st=\"on\">Madrid<\/st1:place><\/st1:state>.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Iglesias accused <st1:state st=\"on\">Madrid<\/st1:state> of indicting for political reasons and interfering with his case, which <st1:place st=\"on\"><st1:state st=\"on\">Madrid<\/st1:state><\/st1:place> disputes. The state cases are pending.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><st1:state st=\"on\">Madrid<\/st1:state> said she believes federal prosecutors never sought a pledge of immunity from her in all likelihood because doing so would have meant involving her office in the case, which would have hampered <st1:city st=\"on\"><st1:place st=\"on\">Wilson<\/st1:place><\/st1:city>\u2019s ability to attack her for doing nothing.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">In addition, she said the prosecution of Vigil may be evidence that Iglesias was being pressured. Prosecutors are trained to take cases before juries only when they have the evidence to make strong arguments, but, she said, in the case of Vigil, \u201cthey went to court with apparently weak evidence.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p style=\"font-weight: bold;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">The stakes were high<\/span><\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">As for her assertion that Rove may have been involved, <st1:state st=\"on\"><st1:place st=\"on\">Madrid<\/st1:place><\/st1:state> pointed out that hers was one of the most hotly contested races in the nation, and Rove was responsible for ensuring that Republicans kept control of the House. He visited the state twice during the 2006 election season, and one of those times flew to New Mexico on Air Force one with Wilson and President Bush for a Wilson fundraiser.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\n<p class=\"MsoNormal\">Bringing the situation back to the larger controversy surrounding the eight fired <st1:country-region st=\"on\">U.S.<\/st1:country-region> attorneys, <st1:state st=\"on\"><st1:place st=\"on\">Madrid<\/st1:place><\/st1:state> also pointed out that the Justice Department has admitted that former Arkansas U.S. Attorney H.E. \u201cBud\u201d Cummins was sent packing in December to make room for former Rove political adviser Tim Griffin.<\/p>\n<p class=\"MsoNormal\">\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Political pressure has forced the Bush Administration to back off <st1:city st=\"on\"><st1:place st=\"on\">Griffin<\/st1:place><\/st1:city>\u2019s appointment.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Madrid says this all adds up to the scenario she believes is \u201cprobably\u201d true: Domenici, Wilson and Rove attempted to influence Iglesias\u2019 prosecution in the Vigil and courthouse cases, but his inaction on the courthouse indictments, coupled with his incompetence in the Vigil case, angered them and cost him his job.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">State government was plagued by Democratic scandals in 2006, but Republicans failed to capitalize on it with election victories. A more definite conviction of Vigil or indictments in the courthouse scandal, which could include former Senate President Manny Aragon, might have had an effect.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">For the GOP, either would have been welcome news. In addition to <st1:city st=\"on\">Wilson<\/st1:city>\u2019s slip in the polls, the news was bad for Republicans across the nation as the war in <st1:place st=\"on\"><st1:country-region st=\"on\">Iraq<\/st1:country-region><\/st1:place>, the page scandal involving former Rep. <a href=\"http:\/\/en.wikipedia.org\/wiki\/Mark_Foley\" target=\"_blank\">Mark Foley<\/a> and other issues took a toll.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">So the stakes were high. They still are: The members of Congress who allegedly pressured Iglesias could face ethics charges. Iglesias will likely be asked under oath to name them when he testifies before a House subcommittee on Tuesday, and he has said he will do so if required.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Iglesias admits he should have notified superiors when the members of Congress called, as department procedure requires. He calls not doing so a mistake. <st1:state st=\"on\"><st1:place st=\"on\">Madrid<\/st1:place><\/st1:state> said it\u2019s further evidence that \u201che was playing ball with them\u201d until he was fired.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p style=\"font-weight: bold;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">Will it influence the 2008 election?<\/span><\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Noting that she won last year by only a few hundred votes, some have speculated that the scandal might weaken <st1:place st=\"on\"><st1:city st=\"on\">Wilson<\/st1:city><\/st1:place> to the point that she would lose a re-election bid in 2008. In addition, <st1:city st=\"on\"><st1:place st=\"on\">Wilson<\/st1:place><\/st1:city> is considered to be Domenici\u2019s hand-picked successor when he steps down, but some speculate the scandal could end her hopes of becoming a senator.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><st1:state st=\"on\"><st1:place st=\"on\">Madrid<\/st1:place><\/st1:state>, who has said she might run for Domenici\u2019s seat in 2008 or governor in 2010, said she isn\u2019t so sure about that.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cI don\u2019t know if it\u2019s enough to take her out of office,\u201d <st1:state st=\"on\"><st1:place st=\"on\">Madrid<\/st1:place><\/st1:state> said. \u201cAll I can tell you is it\u2019s unethical, and they claim to be so ethical.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><st1:state st=\"on\"><st1:place st=\"on\">Madrid<\/st1:place><\/st1:state> said she is still undecided on her future plans. She\u2019s recovering from a campaign that was one of the bloodiest the state has ever seen.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cI\u2019m not ready,\u201d she said.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>October 2006 was a rough month for U.S. Rep.
