{"id":1335,"date":"2007-03-01T17:24:00","date_gmt":"2007-03-01T23:24:00","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/2007\/03\/subpoenas-issued-in-u-s-attorney-investigation-as-domenici-and-wilson-continue-to-dodge-questions\/"},"modified":"2007-03-01T17:24:00","modified_gmt":"2007-03-01T23:24:00","slug":"subpoenas-issued-in-u-s-attorney-investigation-as-domenici-and-wilson-continue-to-dodge-questions","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2007\/03\/subpoenas-issued-in-u-s-attorney-investigation-as-domenici-and-wilson-continue-to-dodge-questions\/","title":{"rendered":"Subpoenas issued in U.S. attorney investigation as Domenici and Wilson continue to dodge questions"},"content":{"rendered":"<p><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/1.bp.blogspot.com\/_IabUCQmoheQ\/RedhHhjtAXI\/AAAAAAAABRk\/5QZAlfhKgZ0\/s1600-h\/Domenici,+Pete.jpg\"><img decoding=\"async\" style=\"margin: 0pt 10px 10px 0pt; float: left; cursor: pointer;\" src=\"http:\/\/1.bp.blogspot.com\/_IabUCQmoheQ\/RedhHhjtAXI\/AAAAAAAABRk\/5QZAlfhKgZ0\/s200\/Domenici,+Pete.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5037101490132287858\" border=\"0\" \/><\/a>U.S. Sen. <a href=\"http:\/\/domenici.senate.gov\/\" target=\"_blank\">Pete Domenici<\/a> and Rep. <a href=\"http:\/\/wilson.house.gov\/\" target=\"_blank\">Heather Wilson<\/a>, R-N.M., are still refusing to talk about whether they had a hand in forcing out former U.S. Attorney David Iglesias, even as a House subcommittee is issuing subpoenas in an attempt to find the truth.  <\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Meanwhile, the spokesman for a congresswoman leading the House investigation says any House members who pressured Iglesias to issue indictments in a public corruption scandal in order to affect the November 2006 elections might have committed ethics violations.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Iglesias claims he was forced from his job by the Bush Administration because he refused pressure in October from two members of <st1:state st=\"on\">New Mexico<\/st1:state>\u2019s congressional delegation to speed indictments in an ongoing investigation of alleged kickbacks related to the construction of government buildings in <st1:place st=\"on\"><st1:placename st=\"on\">Bernalillo<\/st1:placename> <st1:placetype st=\"on\">County<\/st1:placetype><\/st1:place>.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/2.bp.blogspot.com\/_IabUCQmoheQ\/RedhNxjtAYI\/AAAAAAAABRs\/NcuaabQGQs8\/s1600-h\/Wilson,+Heather.jpg\"><img decoding=\"async\" style=\"margin: 0pt 0pt 10px 10px; float: right; cursor: pointer;\" src=\"http:\/\/2.bp.blogspot.com\/_IabUCQmoheQ\/RedhNxjtAYI\/AAAAAAAABRs\/NcuaabQGQs8\/s200\/Wilson,+Heather.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5037101597506470274\" border=\"0\" \/><\/a>Though he has refused to name the members, three of the five \u2013 Democratic Sen. <a href=\"http:\/\/bingaman.senate.gov\/\" target=\"_blank\">Jeff Bingaman<\/a> and Rep. <a href=\"http:\/\/tomudall.house.gov\/\" target=\"_blank\">Tom Udall<\/a> and Republican Rep. <a href=\"http:\/\/pearce.house.gov\/\" target=\"_blank\">Steve Pearce<\/a> \u2013 were quick on Wednesday to say they didn\u2019t do it.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Domenici and Wilson, on the other hand, aren\u2019t talking.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cWe just have no comment on anything dealing with the <st1:country-region st=\"on\"><st1:place st=\"on\">U.S.<\/st1:place><\/st1:country-region> attorney\u2019s office,\u201d Domenici spokesman Chris Gallegos told me. \u201cIf that changes, we\u2019ll let you know.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Tracked down today by the <a href=\"http:\/\/www.freenewmexican.com\/news\/57752.html\" target=\"_blank\">Associated Press<\/a>, Domenici and Wilson refused to comment.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cI don\u2019t have any comment,\u201d the news service quoted Domenici as saying. \u201cI have no idea what he\u2019s talking about.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cYou should contact the Department of Justice on that personnel matter,\u201d the news service quoted <st1:city st=\"on\"><st1:place st=\"on\">Wilson<\/st1:place><\/st1:city> as saying.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><st1:city st=\"on\"><st1:place st=\"on\">Wilson<\/st1:place><\/st1:city> was in a brutal, unpredictable fight for re-election last year. Indictments in the courthouse scandal would have likely involved Democrats in her district and might have boosted her re-election bid.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">The Justice Department contends that Iglesias, whose last day was Wednesday, was let go for poor performance.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">In the meantime, Bingaman confirmed today for the <a href=\"http:\/\/www.abqtrib.com\/news\/2007\/mar\/01\/vigils-lawyer-short-list-us-attorney\/\" target=\"_blank\">Albuquerque Tribune<\/a> what I first reported <a href=\"http:\/\/haussamen.blogspot.com\/2007\/02\/vigil-defense-lawyer-could-be-next-us.html\">Wednesday<\/a>: that Jason Bowles, a defense attorney for former state Treasurer Robert Vigil, is under consideration to replace Iglesias. Larry Gomez, an attorney in the office, is running the show on an interim basis.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Vigil was convicted on one count of attempted bribery last year but acquitted on 23 other felony counts, and his handling of that situation earned Iglesias the disdain of many fellow Republicans. Bowles is currently appealing Vigil\u2019s conviction.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p style=\"font-weight: bold;\" class=\"MsoNormal\"><span style=\"font-size:130%;\">\u2018It could be an ethics violation\u2019<\/span><\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">But it\u2019s the scandal over the alleged involvement of Domenici and Wilson, and the larger question of why the Bush Administration let go of eight U.S. attorneys two years before the end of Bush\u2019s term, that has the attention of Washington.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Members of the House Judiciary Subcommittee on Commercial and Administrative Law voted today to subpoena Iglesias and some of the other fired attorneys to testify under oath and publicly about the situation. Some worry the attorneys were removed so the Bush Administration could use a previously little-known provision in the Patriot Act that allows interim U.S. attorneys to serve indefinitely without Senate confirmation.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">That essentially allows the Bush Administration to sidestep the confirmation process, should it opt to go that route, which it has already done in at least one instance. Gallegos has previously told me Domenici expects Iglesias\u2019 replacement to go through the confirmation process.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">A spokesman for Rep. <a href=\"http:\/\/lindasanchez.house.gov\/\" target=\"_blank\">Linda Lopez<\/a>, D-Calif. and the subcommittee\u2019s chairwoman, said it\u2019s early in the investigation, and the committee simply wants to know more about the circumstances of the firings.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cWe\u2019re not prejudging anything,\u201d spokesman Jim Dau told me.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Still, he said, he is aware of Iglesias\u2019 allegations, and said the subcommittee has considered the fact that the investigation could include members of Congress. If House members pressured Iglesias, he said, \u201cthose members could be violating the ex-parte communications provision of the House ethics manual.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cIt could be an ethics violation,\u201d Dau said.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">I\u2019ve been unable to determine whether the Senate has a similar rule, but a Senate committee is also investigating and will likely issue subpoenas in the coming days.<\/p>\n<p class=\"MsoNormal\">\n<p style=\"font-weight: bold; font-style: italic;\" class=\"MsoNormal\">Update, 5:40 p.m.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><a onblur=\"try {parent.deselectBloggerImageGracefully();} catch(e) {}\" href=\"http:\/\/1.bp.blogspot.com\/_IabUCQmoheQ\/RedxuhjtAdI\/AAAAAAAABSs\/Szwyz_JiGP4\/s1600-h\/Iglesias,+David.jpg\"><img decoding=\"async\" style=\"margin: 0pt 0pt 10px 10px; float: right; cursor: pointer;\" src=\"http:\/\/1.bp.blogspot.com\/_IabUCQmoheQ\/RedxuhjtAdI\/AAAAAAAABSs\/Szwyz_JiGP4\/s200\/Iglesias,+David.jpg\" alt=\"\" id=\"BLOGGER_PHOTO_ID_5037119752333230546\" border=\"0\" \/><\/a>Iglesias is scheduled to testify before the House subcommittee Tuesday at <st1:place st=\"on\"><st1:placename st=\"on\">noon<\/st1:placename>  <st1:placetype st=\"on\">Mountain<\/st1:placetype><\/st1:place> Standard Time.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">In an interview with <a href=\"http:\/\/www.npr.org\/\" target=\"_blank\">National Public Radio<\/a> this evening, he again refused to name the two members of Congress he said pressured him on the indictments, but said he may do so on Tuesday.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cIf directed to do so, I will publicly announce who called me on what days,\u201d Iglesias told NPR.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">In revealing details about the two phone calls, Iglesias made reference, without naming <st1:city st=\"on\"><st1:place st=\"on\">Wilson<\/st1:place><\/st1:city>, to the \u201ctough race going on here\u201d at the time of the phone calls. There was no tougher race in <st1:state st=\"on\">New Mexico<\/st1:state> than <st1:city st=\"on\"><st1:place st=\"on\">Wilson<\/st1:place><\/st1:city>\u2019s bloody contest with Democrat Patricia Madrid.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Iglesias revealed that one member of Congress called him in mid-October and asked whether there were any sealed indictments in the case. He said \u201cred flags went up,\u201d because the member should not have made such an inquiry, but he responded by saying sealed indictments were only used in cases involving juveniles.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Iglesias told NPR he was \u201cevasive\u201d of the member\u2019s questions, and \u201cthe call was ended rather abruptly.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">He said a second member of Congress called him about a week and a half later and asked when indictments would be handed down in the case. He said that phone call was somewhat contentious when he refused to answer questions.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">Asked why he didn\u2019t report the calls to supervisors as required by Department of Justice rules, Iglesias said he was \u201cstunned\u201d and decided to let the incidents slide, saying he \u201chad never had anything like that happen before.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cLooking back, I think I was drastically wrong about that,\u201d he said about his decision to not report the calls.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>U.S. Sen.
