But some members of the Rules Committee \u2013 led by the chair, Albuquerque Democrat Linda Lopez \u2013 have been asking for more time for years.<\/p>\n<p>This is an attempt to make it look like they\u2019re trying to create a commission while they actually stand in its way.<\/p>\n<p>That\u2019s evidenced by the fact that Lopez, who sponsored legislation to create an ethics commission in <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legislation.aspx?chamber=S&amp;legtype=B&amp;legno=557&amp;year=09\" target=\"_blank\">2009<\/a>, <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legislation.aspx?chamber=S&amp;legtype=B&amp;legno=43&amp;year=10\" target=\"_blank\">2010<\/a>, <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legislation.aspx?chamber=S&amp;legtype=B&amp;legno=164&amp;year=11\" target=\"_blank\">2011<\/a>, and <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legislation.aspx?chamber=S&amp;legtype=B&amp;legno=124&amp;year=16\" target=\"_blank\">this year<\/a>, seems thoroughly perplexed about the need for such an agency. <a href=\"http:\/\/www.abqjournal.com\/725618\/abqnewsseeker\/senators-push-back-against-ethics-commission-criticism.html\" target=\"_blank\">At a news conference last week<\/a> she said a commission wouldn\u2019t prevent corruption and \u201cis not going to make anyone more honest.\u201d<\/p>\n<p>Creating an agency that sets ethical standards in government and helps police violations is a nationally accepted best practice. Some <a href=\"http:\/\/www.ncsl.org\/research\/ethics\/state-ethics-commissions.aspx\" target=\"_blank\">42 states<\/a> have ethics commissions. So does New Mexico\u2019s judicial branch. There\u2019s <a href=\"http:\/\/www.abqjournal.com\/67748\/news\/notable-judicial-standards-cases.html\" target=\"_blank\">demonstrable evidence<\/a> that our <a href=\"http:\/\/nmjsc.org\/\" target=\"_blank\">Judicial Standards Commission<\/a> has raised the ethical bar and helped oust judges who shouldn\u2019t have been in office.<\/p>\n<p>New Mexico has no ethics commission for our executive and legislative branches.<\/p>\n<p>This year, the legislation with the best chance of becoming law came from Rep. Jim Dines, R-Albuquerque. He proposed <a href=\"http:\/\/www.nmlegis.gov\/lcs\/legislation.aspx?chamber=H&amp;legtype=JR&amp;legno=5&amp;year=16\" target=\"_blank\">a constitutional amendment<\/a> that needed approval from the House and Senate but not the governor. It then would have gone to voters in November. Polling has shown <a href=\"http:\/\/www.commoncause.org\/states\/new-mexico\/press\/press-releases\/statewide-poll-results-show.html?referrer=https:\/\/www.google.com\/\" target=\"_blank\">widespread support<\/a> for an independent ethics commission.<\/p>\n<p>Meanwhile, Lopez\u2019s bill needed \u2013 and didn\u2019t get \u2013 Gov. Susana Martinez\u2019s permission to be considered in the session that just ended. Martinez has <a href=\"http:\/\/nmpolitics.net\/index\/2011\/01\/what-about-misdeeds-that-aren%E2%80%99t-crimes-guv\/\" target=\"_blank\">expressed opposition to an ethics commission<\/a> in the past, which is disappointing.<!--more--><\/p>\n<p>The House approved Dines\u2019 legislation on a vote of 50-10. But Dines <a href=\"http:\/\/nmpolitics.net\/index\/2016\/02\/with-senate-committee-about-to-make-it-toothless-dines-withdraws-ethics-commission-bill\/\" target=\"_blank\">withdrew the bill<\/a> during a hearing in the Senate Rules Committee because its members, led by Daniel Ivey-Soto, D-Albuquerque, appeared\u00a0poised to strip the commission of transparency and make other bad changes.<\/p>\n<p>Senate Minority Leader Stuart Ingle, R-Portales, is afraid of being <a href=\"http:\/\/www.abqjournal.com\/725618\/abqnewsseeker\/senators-push-back-against-ethics-commission-criticism.html\" target=\"_blank\">unfairly accused of wrongdoing<\/a>. He said the Senate \u201ccan govern itself and it has, in my years here, very ethically and very fairly\u201d \u2013 which is <a href=\"http:\/\/nmpolitics.net\/index\/2012\/03\/jennings-actions-prove-need-for-ethics-commission\/\" target=\"_blank\">simply<\/a> <a href=\"http:\/\/nmpolitics.net\/index\/2008\/05\/more-officials-prove-need-for-an-ethics-commission\/\" target=\"_blank\">not<\/a> <a href=\"http:\/\/nmpolitics.net\/index\/2008\/10\/rawsons-abuse-of-the-pork-barrel-is-a-serious-issue\/\" target=\"_blank\">true<\/a>. And Sen. Jerry Ortiz y Pino, D-Albuquerque, said there\u2019s \u201c<a href=\"http:\/\/nmindepth.com\/2016\/02\/16\/senate-committee-kills-ethics-and-transparency-reform-measures\/\" target=\"_blank\">almost a paranoia<\/a> about an ethics commission being used to embarrass or damage someone with false accusations.\u201d<\/p>\n<p>Some expressed similar fears about webcasting of legislative hearings years ago. Now most accept webcasting. Many even appreciate it.<\/p>\n<p>Still, I\u2019m willing to consider the senators\u2019 concerns. The Judicial Standards Commission keeps complaints secret while investigating. Only if the agency asks the N.M. Supreme Court to discipline or remove a judge does a complaint become public.<\/p>\n<p>That commission has succeeded in correcting behavior or helping oust judges whose misconduct included <a href=\"http:\/\/www.abqjournal.com\/news\/metro\/194606metro07-08-04.htm\" target=\"_blank\">drug use<\/a>, <a href=\"http:\/\/nmpolitics.net\/index\/2011\/05\/dwi-conviction-ends-robles%E2%80%99-judicial-career\/\" target=\"_blank\">drunk driving<\/a>, and <a href=\"http:\/\/nmpolitics.net\/index\/2006\/07\/galvan-though-barred-from-office-not-found-by-high-court-to-have-violated-judicial-ethics\/\" target=\"_blank\">serious<\/a> <a href=\"http:\/\/nmpolitics.net\/index\/2006\/08\/magistrate-judge-susana-chaparro-resigned\/\" target=\"_blank\">abuses<\/a> <a href=\"http:\/\/nmpolitics.net\/index\/2006\/08\/district-judge-larry-ramirez-resigned\/\" target=\"_blank\">of power<\/a>.<\/p>\n<p>While I always prefer sunshine, a well-structured ethics commission \u2013 with or without transparency in the investigative phase \u2013 would be an improvement.<\/p>\n<p>It\u2019s been a decade since a bipartisan task force <a href=\"http:\/\/dspace.unm.edu\/bitstream\/handle\/1928\/2544\/ECFR%20FINAL%2010-2-06.pdf\" target=\"_blank\">recommended creating an ethics commission<\/a>. The Senate Rules Committee\u2019s charade is over. It\u2019s time that New Mexico\u2019s policymakers create such a commission.
