As a result, she\u2019s proposing her own legislation.  <\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"><a href=\"http:\/\/legis.state.nm.us\/lcs\/_session.asp?w=com&#038;year=07&#038;chamber=S&#038;type=++&#038;number=1043\" target=\"_blank\">Senate Bill 1,043<\/a> would create a state whistleblower law designed to encourage employees to report illegal activity.<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201cI thoroughly expected the governor\u2019s task force to address protection for public employees,\u201d Beffort said in a news release. \u201cIt did not protect them, so I am protecting them with the Whistleblower Protection Act.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\">\u201c<st1:state st=\"on\"><st1:place st=\"on\">New Mexico<\/st1:place><\/st1:state> has experienced serious ethical breaches,\u201d she said. \u201c\u2026 I believe other unethical breaches will be uncovered if public employees are given protection to come forward.\u201d<\/p>\n<p class=\"MsoNormal\"><o:p> <\/o:p><\/p>\n<p class=\"MsoNormal\"> Under the bill, a grievance procedure will be implemented that will include a hearing with the Department of Labor\u2019s Human Rights Commission. An employee could seek a trial in district court instead of a hearing with the commission.<\/p>\n<p class=\"MsoNormal\">\n<p class=\"MsoNormal\">If retaliation is proven, the court may award actual damages, punitive damages and attorney fees.<\/p>\n<p class=\"MsoNormal\">\n<p class=\"MsoNormal\">\u201cWe need to protect employees and make them feel free to come forth with information they know about in their public offices. They will feel protected if they know there is a fair grievance in place to protect them,\u201d Beffort said.<\/p>\n<p class=\"MsoNormal\">\n<p class=\"MsoNormal\">It would be a misdemeanor, punishable by a fine up to $1,000 and a year in prison, for a person involved in the grievance procedure to make public any of the information from the grievance procedure.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Sen.
