The media tells us that all children born here with non-citizen parents are\u00a0anchor babies, and further that it\u2019s a pejorative expression used solely by conservative Americans (because don\u2019t you know all conservatives are prejudiced and ignorant).<\/p>\n<p>Sigh. It\u2019s a term used by <a href=\"http:\/\/wemeantwell.com\/blog\/2015\/08\/26\/explainer-anchor-babies-and-the-law\/\" target=\"_blank\">American consular officers<\/a>\u00a0\u2014 the people who issue visas to immigrants and visitors \u2014 from the U.S. Department of State. And it\u2019s used whenever an officer suspects that a mother entered the United States with the express intent of giving birth, does so, and then immediately returns home with the child and his U.S. birth certificate all for the express purpose of immigrating the whole family two decades later.<\/p>\n<p>Still not unlawful (really), but it\u2019s a term describing a subset of children born to foreign nationals in the United States, not a blanket term for any child born to someone visiting or residing without lawful status\u00a0within the country.<\/p>\n<p>It is true though, that consular officers are frustrated by citizenship earned in this manner. It does seem wrong doesn\u2019t it? Maybe ethically it\u2019s a shady practice, but it\u2019s perfectly lawful per the <a href=\"http:\/\/www.uscis.gov\/laws\/immigration-and-nationality-act\" target=\"_blank\">Immigration and Naturalization Act<\/a> (INA \u2013 the law that governs immigration). There is no law barring a woman from obtaining a tourist visa or asking for permission to enter the U.S. (two different things involving two different agencies \u2014 who says we don\u2019t suffer from too much government?) with the intent of giving birth since giving birth in the U.S. isn\u2019t unlawful.<\/p>\n<p><a href=\"http:\/\/www.rollingstone.com\/politics\/news\/welcome-to-maternity-hotel-california-20150819?utm_content=bufferec500&amp;utm_medium=social&amp;utm_source=twitter.com&amp;utm_campaign=buffer\" target=\"_blank\">Birth tourism<\/a>? The INA says nothing about it. Using Medicaid or other forms of prenatal care at the state\u2019s cost equally does not trigger the <a href=\"http:\/\/www.uscis.gov\/news\/fact-sheets\/public-charge-fact-sheet\" target=\"_blank\">public charge section<\/a> of the INA.<!--more--><\/p>\n<p>When this hit the news, was your Facebook feed full of people calling for the\u00a0<a href=\"http:\/\/www.fas.org\/sgp\/crs\/misc\/RL33079.pdf\" target=\"_blank\">14th\u00a0Amendment<\/a> to be revoked to end the practice of <em>jus soli<\/em> (right of soil \u2013 citizenship obtained via birth within the United States)? Please tell understand\u00a0that if they persist in that nonsense, they are actually also advocating damaging the <a href=\"https:\/\/www.loc.gov\/rr\/program\/bib\/ourdocs\/14thamendment.html\" target=\"_blank\">citizenship rights<\/a> of <a href=\"http:\/\/teachinghistory.org\/history-content\/ask-a-historian\/23652\" target=\"_blank\">black people and women<\/a>. Or that there is case law that uses the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Fourteenth_Amendment_to_the_United_States_Constitution#Citizenship\" target=\"_blank\">14th\u00a0Amendment<\/a> to support the <a href=\"http:\/\/law2.umkc.edu\/faculty\/projects\/ftrials\/conlaw\/rightofprivacy.html\" target=\"_blank\">privacy interpretations<\/a>\u00a0of the 1st, 2nd, 3rd, 4th<sup>\u00a0<\/sup>and 9th\u00a0Amendments. So really? You just want to toss that out the window? See the above paragraph.<\/p>\n<p>If you have issues with immigration, it\u2019s the INA you want to attack, not our Constitution \u00a0\u2014 the very thing that doesn\u2019t just govern us through our consent, but also is what defines America and makes us the envy of the world.<\/p>\n<p>As for transmitting citizenship, take a look at Germany or most Persian Gulf countries before attacking <em>jus soli<\/em>. The <em>jus sanguinis<\/em> (right of blood \u2013 citizenship is obtained via the parents\u2019 citizenship status) model that sounds so reasonable leads to the very problem the 14th\u00a0Amendment is meant to address. The Gulf countries are full of \u201c<a href=\"http:\/\/ngm.nationalgeographic.com\/2014\/01\/guest-workers\/gorney-text\" target=\"_blank\">guest workers<\/a>\u201d who\u2019ve lived their entire life in, say Dubai, and had children there, but none are citizens and if the parents lose their job, they must return to their own country complete with their children who don\u2019t speak the language of a country they\u2019ve never seen. Sound familiar?<\/p>\n<p><em>Jus sanguinis<\/em> in Germany created an <a href=\"http:\/\/www.familysecuritymatters.org\/publications\/detail\/turks-in-germany-are-a-time-bomb\" target=\"_blank\">entire population of Turks<\/a> who are German in name and language, but not in terms of belonging, and <a href=\"http:\/\/www.nytimes.com\/2013\/04\/16\/world\/europe\/16iht-letter16.html?_r=0\" target=\"_blank\">until recently<\/a>, <a href=\"https:\/\/www.foreignaffairs.com\/articles\/europe\/2011-10-28\/what-integration-means-germanys-guest-workers\" target=\"_blank\">not in terms of citizenship either<\/a>. What happens when you make an entire group second class members of society? Please tell me you know the answer to that.<\/p>\n<p>Interestingly, <em>jus sanguinis<\/em> in Germany has also fostered birth tourism via a falsified birth certificate. Turkish-German women will return to Turkey to bring young children with <a href=\"https:\/\/muslimstatistics.wordpress.com\/2015\/03\/19\/germany-80-percent-of-turkish-muslim-settlers-claim-welfare-payments\/\" target=\"_blank\">fake birth certificates<\/a> saying it\u2019s their child and thus obtaining German citizenship for that child. But isn\u2019t revoking the practice of <em>jus soli<\/em>\u00a0supposed to solve America\u2019s immigration problem? You mean all forms of citizenship transmission create issues for the host country? Who would have thought?!<\/p>\n<p>It turns out we have a falsified birth certificate problem too. Along the United States \u2013 Mexican border, there are birthing clinics and obstetricians who will provide real state birth certificates with fake information to parents who can pay. I suspect that\u2019s what\u2019s behind reports of the Texas Vital Statistics Unit refusing to issue birth certificates to children whose parents do not have the required forms of identification. Texas knows it has a high fraud rate problem.<\/p>\n<p>The <a href=\"http:\/\/www.cbsnews.com\/news\/illegal-immigrants-denied-birth-certificates-for-u-s-born-children\/\" target=\"_blank\">news reports<\/a> imply racism, prejudice, and so on (<em>hey thanks media bias!<\/em>) since this is affecting mostly those in the U.S. without lawful status who are\u00a0from Mexico. While I don\u2019t mean to imply that making a child stateless is a good thing, the falsified Texas birth certificate is a real problem. And it\u2019s an extremely sad problem when a child who believed his\u00a0entire life that he was born in El Paso, but instead finds at age 25 that his parents lied to him, as his petition to bring in his\u00a0wife into the U.S. is denied, and the State Department revokes his U.S. passport.<\/p>\n<p>Whatever your view of immigration, those present without lawful status, and citizenship transmission, when it comes to those issues being debated vociferously and righteously, it bears considering all that you <em>aren\u2019t<\/em>\u00a0being told if the basis of your opinion is drawn solely from the media.
