(<a href=\"https:\/\/creativecommons.org\/licenses\/by-sa\/4.0\/\" target=\"_blank\">photo cc info<\/a>)<\/p><\/div>\n<p>Last week, a pro-<a href=\"https:\/\/www.publicintegrity.org\/2015\/04\/12\/17107\/12-things-know-about-hillary-clinton\" target=\"_blank\">Hillary Clinton<\/a>\u00a0<a href=\"https:\/\/www.publicintegrity.org\/2014\/03\/18\/14427\/merriam-webster-makes-super-pac-official\" target=\"_blank\">super PAC<\/a> sent campaign regulators a <a href=\"http:\/\/docquery.fec.gov\/dcdev\/fectxt\/1039113.txt\" target=\"_blank\">seemingly perfunctory letter,<\/a> all of 30 words long.<\/p>\n<p>\u201cThis letter serves to officially notify the Federal Election Commission that Priorities USA Action will file its reports on a monthly basis to the Commission as of January 1, 2016,\u201d it read.<\/p>\n<p>Sounds harmless enough. But that little note \u2014 and more just like it from other super PACs \u2014 allows top presidential bankrollers to remain hidden as the campaign grows white hot.<\/p>\n<aside class=\"module align-left half type-aside\">\n<h3>About this article<\/h3>\n<p>This story\u00a0is\u00a0from\u00a0<a href=\"http:\/\/www.publicintegrity.org\/\" target=\"_blank\">The Center for Public Integrity<\/a>, a nonprofit, nonpartisan investigative media organization in Washington, D.C.<\/p>\n<\/aside>\n<p>That\u2019s because, thanks to a quirk in federal law, such letters give those super PACs the power to withhold their January donors\u2019 names until well after the first-in-the-nation Iowa caucuses and New Hampshire primaries are conducted next month.<\/p>\n<p>Also secret: the potentially massive amounts of money the donors are contributing in order to affect the outcome of those crucial contests.<\/p>\n<p>Instead, the super PACs will file campaign finance disclosure reports that only include contributions they\u2019ve received through December.<\/p>\n<p>Beyond Priorities USA Action, 10 other presidential super PACs have so far taken advantage of this opportunity to withhold information about their January donors, a <a href=\"http:\/\/www.publicintegrity.org\/\" target=\"_blank\">Center for Public Integrity<\/a> review of federal records indicates.<\/p>\n<p>They include:<\/p>\n<ul>\n<li><a href=\"http:\/\/docquery.fec.gov\/pdf\/835\/201601089004443835\/201601089004443835.pdf\" target=\"_blank\">Right to Rise USA<\/a> (supporting former Florida Gov. <a href=\"https:\/\/www.publicintegrity.org\/2015\/06\/15\/17142\/12-things-know-about-jeb-bush\" target=\"_blank\">Jeb Bush<\/a>)<\/li>\n<li><a href=\"http:\/\/docquery.fec.gov\/pdf\/230\/201601070300009230\/201601070300009230.pdf\" target=\"_blank\">Concerned American Voters<\/a> (supporting U.S. Sen. <a href=\"https:\/\/www.publicintegrity.org\/2015\/04\/07\/17068\/12-things-know-about-rand-paul\" target=\"_blank\">Rand Paul<\/a> of Kentucky)<\/li>\n<li><a href=\"http:\/\/docquery.fec.gov\/pdf\/214\/201601089004444214\/201601089004444214.pdf\" target=\"_blank\">Pursuing America\u2019s Greatness<\/a> (supporting former Arkansas Gov. <a href=\"https:\/\/www.publicintegrity.org\/2015\/05\/05\/17180\/9-things-know-about-mike-huckabee\" target=\"_blank\">Mike Huckabee<\/a>)<\/li>\n<li><a href=\"http:\/\/docquery.fec.gov\/pdf\/826\/201601089004443826\/201601089004443826.pdf\" target=\"_blank\">America Leads<\/a> (supporting New Jersey Gov. <a href=\"https:\/\/www.publicintegrity.org\/2015\/06\/30\/17582\/9-things-know-about-chris-christie\" target=\"_blank\">Chris Christie<\/a>)<\/li>\n<li><a href=\"http:\/\/docquery.fec.gov\/pdf\/309\/201601049004428309\/201601049004428309.pdf\" target=\"_blank\">Conservative Solutions PAC<\/a> (supporting U.S. Sen. <a href=\"https:\/\/www.publicintegrity.org\/2015\/04\/13\/17058\/12-things-know-about-marco-rubio\" target=\"_blank\">Marco Rubio<\/a> of Florida)<\/li>\n<li><a href=\"http:\/\/docquery.fec.gov\/cgi-bin\/forms\/C00573154\/1039588\/\" target=\"_blank\">CARLY for America<\/a> (supporting businesswoman <a href=\"https:\/\/www.publicintegrity.org\/2015\/05\/04\/17278\/12-things-know-about-carly-fiorina\" target=\"_blank\">Carly Fiorina<\/a>)<\/li>\n<li>Four super PACs with <a href=\"http:\/\/docquery.fec.gov\/pdf\/149\/201601059004434149\/201601059004434149.pdf\" target=\"_blank\">variations<\/a> <a href=\"http:\/\/docquery.fec.gov\/pdf\/617\/201601059004435617\/201601059004435617.pdf\" target=\"_blank\">on<\/a> <a href=\"http:\/\/docquery.fec.gov\/pdf\/316\/201601120300009316\/201601120300009316.pdf\" target=\"_blank\">the<\/a> <a href=\"http:\/\/docquery.fec.gov\/pdf\/866\/201601059004433866\/201601059004433866.pdf\" target=\"_blank\">name<\/a> \u201cKeep the Promise\u201d (supporting U.S. Sen. <a href=\"https:\/\/www.publicintegrity.org\/2015\/03\/23\/16947\/ted-cruzs-presidential-cash-hunt-commences\" target=\"_blank\">Ted Cruz<\/a> of Texas)<\/li>\n<\/ul>\n<p>\u201cThe situation is really inappropriate \u2014 the whole point of disclosure is to provide information to voters when they need it,\u201d said <a href=\"https:\/\/www.publicintegrity.org\/2014\/12\/17\/16527\/new-fec-chief-dark-money-mission\" target=\"_blank\">Ann Ravel<\/a>, a Democratic member of the Federal Election Commission who served as the agency\u2019s chairwoman last year.<\/p>\n<p>Ravel, however, acknowledged there\u2019s little the FEC can do about it at this juncture, and current FEC Chairman Matthew Petersen concurred.<!--more--><\/p>\n<p><a href=\"https:\/\/www.publicintegrity.org\/news\/Lee-Goodman\" target=\"_blank\">Lee Goodman<\/a>, a Republican FEC commissioner, noted that political action committees commonly change their filing status during election years to put themselves on a predictable, monthly schedule. Otherwise, they\u2019d be forced to file campaign finance disclosures before every primary contest in which they participated \u2014 an onerous prospect.<\/p>\n<p>\u201cI don\u2019t think they\u2019re doing this for subterfuge, and I\u2019ve never heard of a voter who based his or her vote on the identity of a donor to a super PAC,\u201d Goodman said. \u201cBut this does, perhaps, leave a gap in disclosure, which is important and certainly something the commission could look at.\u201d<\/p>\n<p>Here\u2019s how the super PAC filing loophole works:<\/p>\n<p>Most major super PACs filed just one campaign finance disclosure report during 2015, as the law allows them to do.<\/p>\n<p>But this month, these \u201csemi-annual\u201d super PAC filers who\u2019ve spent money in the New Hampshire primary campaign race face a choice.<\/p>\n<p>They may choose to do nothing, maintain their current status and be required to submit a \u201cpre-primary\u201d report on Jan. 28 \u2014 12 days before New Hampshire\u2019s Feb. 9 primary.<\/p>\n<p>Such a pre-primary report would reveal everyone who\u2019s given a super PAC money \u2014 and how much \u2014 through Jan. 20.\u00a0 (Because of a\u00a0<a href=\"http:\/\/saos.nictusa.com\/aodocs\/1979-71.pdf\" target=\"_blank\">36-year-old FEC ruling<\/a>, presidential caucus contests such as the one Iowa conducts on Feb. 1 don\u2019t trigger such reports.)<\/p>\n<p>Or, as many super PACs already have, they may this month notify the FEC that they\u2019re switching to a monthly filing schedule.<\/p>\n<p>Doing so exempts a super PAC from filing Jan. 28 pre-primary reports, and therefore, revealing their income from Jan. 1 through Jan. 20.<\/p>\n<p>Instead, they\u2019ll file a report disclosing their 2015 fundraising on Jan. 31 and another report detailing their January fundraising on Feb. 20, per FEC rules.<\/p>\n<p>Some presidential race-focused super PACs\u00a0<a href=\"http:\/\/www.politico.com\/story\/2011\/12\/super-pacs-go-stealth-through-first-contests-070957\" target=\"_blank\">pulled a similar donor-hiding switcheroo<\/a>\u00a0ahead of the 2012 election, although this time around, super PACs are raising exponentially more money to promote their candidates of choice \u2014 or lambaste those they oppose.<\/p>\n<p>Technically, the FEC could deny such filing change requests. But the agency almost never does.<\/p>\n<p>Pro-Clinton\u00a0<a href=\"https:\/\/www.publicintegrity.org\/news\/Priorities-USA-Action\" target=\"_blank\">Priorities USA Action<\/a>\u00a0spokesman Justin Barasky declined to comment on the super PAC\u2019s switch, as did pro-Bush Right to Rise USA spokesman Paul Lindsay.<\/p>\n<p>None of the other presidential super PACs who\u2019ve switched their filing status responded to requests for comment from the Center for Public Integrity.<\/p>\n<p>One person who\u2019s steamed about the situation is Sen. Bernie Sanders of Vermont, who\u2019s emerged as Clinton\u2019s strong primary rival while disavowing all super PACs.<\/p>\n<p>\u201cI\u2019m shocked,\u201d Sanders spokesman Michael Briggs said when told of the pro-Clinton Priorities USA Action filing switch. \u201cYou\u2019ve got to ask the question, \u2018What are they afraid of?\u2019\u201d<\/p>\n<p>The Supreme Court\u2019s 2010 decision in\u00a0<em><a href=\"https:\/\/www.publicintegrity.org\/2012\/10\/18\/11527\/citizens-united-decision-and-why-it-matters\" target=\"_blank\">Citizens Untied v. Federal Election Commission<\/a><\/em>\u00a0helped lead to the initial creation of super PACs later that year.<\/p>\n<p>Super PACs \u2014 initially exotic political vehicles that sprung into existence following\u00a0<em>Citizens United\u00a0<\/em>\u2014 have this election cycle evolved to become conventional weapons of most presidential efforts.<\/p>\n<p>Unlike traditional PACs, which may only raise money in limited increments, super PACs may raise and spent unlimited amounts of money to advocate for or against political candidates \u2014 so long as they don\u2019t directly coordinate messaging with a candidate\u2019s campaign.<\/p>\n<p>Together, super PACs have\u00a0<a href=\"https:\/\/www.publicintegrity.org\/2015\/10\/16\/18631\/see-how-much-2016-presidential-candidates-have-raised-so-far\" target=\"_blank\">raised hundreds of millions of dollars<\/a>\u00a0to support White House hopefuls, and before Election Day in November, they\u2019ll assuredly raise hundreds of millions of dollars more.<\/p>\n<p><a href=\"http:\/\/www.nytimes.com\/interactive\/2016\/us\/elections\/top-presidential-donors-campaign-money.html?_r=0\" target=\"_blank\">Dozens of individuals<\/a>\u00a0had already given super PACs at least $1 million by June 30, when such groups were last require to report their income.<\/p>\n<p>University of New Hampshire political science professor Dante Scala says he doubts the revelation of some 11th-hour super PAC donor would sway most New Hampshire primary voters\u2019 votes.<\/p>\n<p>But there\u2019s always a chance of something surprising occurring \u2014 perhaps a major Democratic donor funding blanket attack ads on a Republican, or billionaires Charles and David Koch suddenly pumping cash into some effort after month remaining neutral.<\/p>\n<p>\u201cYou\u2019d like them to err on the side of transparency,\u201d Scala said.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Iowa, New Hampshire voters will be blind to last-minute bankrollers of big-spending groups.<\/p>\n","protected":false},"author":1,"featured_media":54908,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[11],"tags":[708,705,116],"class_list":["post-117925","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-news-and-analysis","tag-2016-election","tag-money-in-politics","tag-washington"],"_links":{"self":[{"href":"https:\/\/nmpolitics.net\/index\/wp-json\/wp\/v2\/posts\/117925","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/nmpolitics.net\/index\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/nmpolitics.net\/index\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/nmpolitics.net\/index\/wp-json\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/nmpolitics.net\/index\/wp-json\/wp\/v2\/comments?post=117925"}],"version-history":[{"count":0,"href":"https:\/\/nmpolitics.net\/index\/wp-json\/wp\/v2\/posts\/117925\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/nmpolitics.net\/index\/wp-json\/wp\/v2\/media\/54908"}],"wp:attachment":[{"href":"https:\/\/nmpolitics.net\/index\/wp-json\/wp\/v2\/media?parent=117925"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/nmpolitics.net\/index\/wp-json\/wp\/v2\/categories?post=117925"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/nmpolitics.net\/index\/wp-json\/wp\/v2\/tags?post=117925"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
