Tim Jennings (Photo by Heath Haussamen)<\/p><\/div>\n<p>New Mexicans have suffered through a year of sordid allegations that politics and campaign donations improperly influenced how the state invested billions of dollars. Ultimately, State Investment Officer Gary Bland <a href=\"http:\/\/www.nmpolitics.net\/index\/2009\/10\/state-investment-officer-resigns-amid-scandal\/\">resigned<\/a>. The state is now on the defensive, paying high-priced lawyers to defend numerous public officials and employees against the stigma of alleged improprieties (real or imagined).<\/p>\n<p>The State Investment Council and the Educational Retirement Board lost hundreds of millions of dollars on dubious investments. The former chief investment officer for the teachers\u2019\u00a0pension fund, Frank Foy, has filed <a href=\"http:\/\/www.nmpolitics.net\/index\/2009\/06\/foy-files-expanded-pay-to-play-complaint\/\">a whistleblower lawsuit<\/a> to try to get the money back for the state.<\/p>\n<p>Shouldn\u2019t the state of New Mexico \u2013 the SIC &#8212; be doing the same thing? Shouldn\u2019t they all be trying to recover the state\u2019s lost investments?<\/p>\n<p>Meanwhile, the state &#8212; with state dollars &#8212; is defending the current and former state employees, including Mr. Bland, who are under a cloud of suspicion.\u00a0The legal bill so far is more than $438,000 to defend or represent various individuals in federal investigations and Foy\u2019s whistleblower lawsuit.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-10204\" title=\"Guest column\" src=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2009\/12\/Guest-column2.jpg\" alt=\"\" width=\"120\" height=\"60\" \/><\/a><\/p>\n<p>This makes little sense because Foy is technically suing on\u00a0behalf\u00a0of\u00a0New Mexico\u00a0taxpayers, so as the state hires lawyers to deal with this problem, it is essentially spending public money to defend itself from&#8230;\u00a0itself. It is spending no money whatsoever to recover lost investment dollars.<\/p>\n<p>The State Investment Council, formerly under the supervision of Bland, has spent huge amounts of money responding to federal subpoenas and to ensure that the council\u2019s employees and board members have the opportunity to be legally represented.<\/p>\n<p>The SIC years ago entered into a $30,000\u00a0professional services contract\u00a0with the\u00a0<a href=\"http:\/\/www.paulhastings.com\/\">Paul Hastings\u00a0Janofsky\u00a0Walker<\/a> law firm from\u00a0San Francisco\u00a0for review of investment documents, but that contract has steadily expanded to $5.8 million as the firm\u2019s lawyers, some of whom are paid up to $950 per hour, began responding to the federal subpoenas and conducting an internal review that apparently led to\u00a0Bland\u2019s\u00a0resignation.<\/p>\n<p>I have asked the state attorney general to formally review the legality of expanding this small, $30,000 contract to $5.8 million without a competitive bid process.<\/p>\n<p>Recently, the SIC signed contracts with seven additional law firms for a total of $320,000 to represent individual staff members of the SIC, prompting the SIC to ask for emergency supplemental funding while state funding is being cut everywhere else.\u00a0Essentially, we are again spending scarce state dollars defending ourselves from ourselves.<\/p>\n<h3>Why must the state rely on whistleblowers and investigators?<\/h3>\n<p>This situation doesn\u2019t make sense. The public and the\u00a0Legislature\u00a0need to know exactly what all these lawyers are doing. While every individual is entitled to a vigorous defense and legal counsel, the people of the State of New Mexico are equally entitled to their own advocate throughout this process. The state should be spending more energy and resources working to recover the investments we have lost.<\/p>\n<p>Why must the state rely on whistleblowers and federal investigators to defend the interests of taxpayers? Perhaps because the state\u2019s top\u00a0financial regulator, Securities Division Director Bruce Kohl, was <a href=\"http:\/\/www.santafenewmexican.com\/Story\/Dozens-of-exempt-jobs-end-Jan--8\">laid off<\/a> by the governor in response to the state\u2019s\u00a0budget crisis.<\/p>\n<p>Did the governor really believe that Kohl\u2019s position was less essential than the jobs of some of the political employees who kept their jobs? We may never know, as the governor has said virtually nothing about who he decided to lay off.<\/p>\n<p>With the state\u2019s top investment watchdog out of the picture, the state must now take extraordinary steps to protect the integrity of the state investment process. The state should be spending more time, energy and money to recover the lost funds caused by the possible lack of\u00a0due diligence\u00a0of a few people.<\/p>\n<p>Hopefully, the size of the recoveries will outweigh the tremendous costs incurred as a result of these alleged improprieties and return much-needed revenues to New Mexico taxpayers.<\/p>\n<p>Finally, I want to assure you that the\u00a0New Mexico State Senate\u00a0is committed to protecting the citizens of New Mexico from the loss of monies that could better spent on education and programs that protect our most vulnerable and needy citizens.<\/p>\n<p><a href=\"http:\/\/www.nmlegis.gov\/lcs\/legdetails.aspx?SPONCODE=SJENT\"><em>Jennings<\/em><\/a><em>, a Roswell Democrat, is the president pro tem of the New Mexico Senate.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Instead of trying to recover lost money, the State Investment Council has spent huge amounts to respond to subpoenas and pay for employees\u2019 and council members\u2019 attorneys.
