{"id":109496,"date":"2015-12-16T11:28:42","date_gmt":"2015-12-16T18:28:42","guid":{"rendered":"http:\/\/nmpolitics.net\/index\/?p=109496"},"modified":"2015-12-16T15:12:42","modified_gmt":"2015-12-16T22:12:42","slug":"duran-accepts-judges-sentence-must-report-to-jail-friday","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2015\/12\/duran-accepts-judges-sentence-must-report-to-jail-friday\/","title":{"rendered":"Duran accepts judge&#8217;s sentence, must report to jail Friday"},"content":{"rendered":"<p>Former Secretary of State Dianna Duran won&#8217;t back out of a plea agreement that led to a <a href=\"http:\/\/nmpolitics.net\/index\/2015\/12\/duran-sentenced-to-30-days-in-jail-but-could-fight-incarceration\/\" target=\"_blank\">30-day jail sentence<\/a>, which means she&#8217;ll be incarcerated beginning Friday.<\/p>\n<div id=\"attachment_55834\"  class=\"wp-caption module image alignleft\" style=\"max-width: 336px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-55834\" src=\"http:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/05\/Duran-Dianna-336x232.jpg\" alt=\"Dianna Duran\" width=\"336\" height=\"232\" srcset=\"https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/05\/Duran-Dianna-336x232.jpg 336w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/05\/Duran-Dianna.jpg 518w\" sizes=\"auto, (max-width: 336px) 100vw, 336px\" \/><\/a><p class=\"wp-media-credit\">Courtesy photo<\/p><p class=\"wp-caption-text\">Dianna Duran<\/p><\/div>\n<p>&#8220;With the same resolve with which Ms. Duran swiftly accepted responsibility, she will accept the sentence of the court,&#8221; Duran&#8217;s attorney, Erlinda Ocampo Johnson, told NMPolitics.net.<u><\/u><\/p>\n<p>Duran, who\u00a0illegally used campaign funds to keep her personal bank account in the black while gambling at New Mexico casinos, had until noon Wednesday to decide whether to accept the sentence or reject the plea agreement and proceed to trial.<\/p>\n<p>Duran pleaded guilty <a href=\"http:\/\/nmpolitics.net\/index\/2015\/10\/dianna-duran-has-resigned\/\" target=\"_blank\">in October<\/a>\u00a0to six of 65 charges she faced, including embezzlement and money laundering. Two of the charges to which Duran admitted are felonies. The other four are misdemeanors. As part of her plea agreement, she also resigned from her position as secretary of state.<\/p>\n<p>District\u00a0Judge T. Glenn Ellington on Monday sentenced Duran to 30 days in jail and rejected a request that her incarceration begin after Christmas.<!--more--><\/p>\n<p>As part of her sentence, Ellington ordered\u00a0Duran to pay $14,000 in fines and an additional $13,866 in restitution to her campaign contributors \u2014 the victims in the case. She must continue counseling for a gambling addiction. She must stay out of all gambling establishments for a period of 2-3 years, with GPS monitoring confirming that she does.<\/p>\n<p>Duran\u00a0must also complete 2,000 hours of community service over the next five years that doesn\u2019t involve raising funds or managing finances for any charitable organization. She must write letters of apology to her campaign contributors\u00a0and the State of New Mexico.
