{"id":101440,"date":"2015-11-17T12:59:14","date_gmt":"2015-11-17T19:59:14","guid":{"rendered":"http:\/\/www.nmpolitics.net\/index\/?p=101440"},"modified":"2015-11-18T06:59:56","modified_gmt":"2015-11-18T13:59:56","slug":"inconsistent-reporting-hurts-efforts-to-follow-political-money-in-nm","status":"publish","type":"post","link":"https:\/\/nmpolitics.net\/index\/2015\/11\/inconsistent-reporting-hurts-efforts-to-follow-political-money-in-nm\/","title":{"rendered":"Inconsistent reporting hurts efforts to follow political money in NM"},"content":{"rendered":"<p>In response to <a href=\"http:\/\/www.kob.com\/article\/stories\/S3965300.shtml\" target=\"_blank\">an investigation<\/a> by a TV news organization, which found discrepancies in how candidates and lobbyists are reporting campaign contributions, some legislative leaders are asking for better rules that will\u00a0improve transparency.<\/p>\n<div id=\"attachment_56542\"  class=\"wp-caption module image alignleft\" style=\"max-width: 336px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-56542\" src=\"http:\/\/www.nmpolitics.net\/index\/wp-content\/uploads\/2015\/06\/Kids-at-Roundhouse-336x220.jpg\" alt=\"A statue outside the Roundhouse in Santa Fe.\" width=\"336\" height=\"220\" srcset=\"https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/06\/Kids-at-Roundhouse-336x220.jpg 336w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/06\/Kids-at-Roundhouse-768x502.jpg 768w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/06\/Kids-at-Roundhouse-771x504.jpg 771w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/06\/Kids-at-Roundhouse-1170x764.jpg 1170w, https:\/\/nmpolitics.net\/index\/wp-content\/uploads\/2015\/06\/Kids-at-Roundhouse.jpg 1500w\" sizes=\"auto, (max-width: 336px) 100vw, 336px\" \/><\/a><p class=\"wp-media-credit\">Heath Haussamen \/ NMPolitics.net<\/p><p class=\"wp-caption-text\">A statue outside the Roundhouse in Santa Fe.<\/p><\/div>\n<p>&#8220;We know that you share our desire to promote transparency in campaign finance and would appreciate your assistance in this regard,&#8221; Senate President Pro Tem Mary Kay Papen and House Majority Leader Nate Gentry wrote in <a href=\"http:\/\/www.kob.com\/kobtvimages\/repository\/cs\/files\/Gentry%20Papen%20letter.pdf\" target=\"_blank\">a recent letter<\/a> to acting Secretary of State Mary Quintana.<\/p>\n<p>They&#8217;re asking Quintana&#8217;s\u00a0office to create rules clarifying how lobbyists should report campaign contributions they or their clients make to candidates.<\/p>\n<p>The recent <a href=\"http:\/\/www.nmpolitics.net\/index\/2015\/10\/dianna-duran-has-resigned\/\" target=\"_blank\">criminal case<\/a> against\u00a0former Secretary of State Dianna Duran revealed that\u00a0lobbyists reported contributions to Duran&#8217;s campaigns she never reported receiving &#8212; apparently because she instead\u00a0used the money to keep her personal bank account in the black while she was gambling at New Mexico casinos.<\/p>\n<p>Other candidates&#8217; finance reports have been <a href=\"http:\/\/www.nmpolitics.net\/index\/2015\/10\/flawed-nm-campaign-reporting-system-needs-reform-many-say\/\" target=\"_blank\">under scrutiny<\/a> since then. KOB-TV decided to <a href=\"http:\/\/www.kob.com\/article\/stories\/S3965300.shtml\" target=\"_blank\">cross-check<\/a> the finance reports of 10 legislative leaders &#8212; five Democrats and five Republicans &#8212; with\u00a0what lobbyists reported donating to their campaigns.<\/p>\n<p>KOB found the task nearly impossible. In their letter to Quintana, Papen, D-Las Cruces, and Gentry, R-Albuquerque, explained three problems that led to discrepancies:<\/p>\n<ul>\n<li>Lobbyists sometimes\u00a0report donations\u00a0as coming from themselves instead of their employers. Meanwhile, the checks come from their employers, so candidates record donations as coming from the employers, not their lobbyists.<\/li>\n<li>Some lobbyists are reporting multiple donations as one contribution, while the candidates are reporting each individually.<\/li>\n<li>When an organization has more than one lobbyist, sometimes multiple lobbyists are each reporting the same donation, making it appear that there were multiple contributions when there was only one.<\/li>\n<\/ul>\n<p>The result is that news organizations like KOB and members of the public can&#8217;t accurately track money flowing from\u00a0lobbyists and the organizations they represent to candidates &#8212; even if the lobbyists and candidates are reporting donations as the law requires.<!--more--><\/p>\n<p>The state&#8217;s campaign finance and lobbyist reporting systems &#8220;apply inconsistent rules that cause confusion,&#8221; House Minority Leader Brian Egolf, D-Santa Fe, was quoted <a href=\"http:\/\/www.kob.com\/kobtvimages\/repository\/cs\/files\/Egolf%20response.pdf\" target=\"_blank\">by KOB<\/a> as saying.
