Members of the Senate Judiciary Committee heard testimony from whistleblower Frank Foy and his attorney Victor Marshall in Santa Fe this afternoon.
Foy is the former chief investment officer for the state’s Educational Retirement Board who has lumped a host of pay-to-play allegations into a lawsuit he’s filed on behalf of the state.

I asked the governor’s office through an e-mail if it was going to release a statement responding to what was said at the hearing. Moments later, Deputy Chief of Staff Gilbert Gallegos responded with the same words someone participating in a New Mexico Independent liveblog of the hearing had just posted about the chances of a response from the governor — indicating that the governor’s office was paying attention to the hearing.
“The odds are so low that we’ll respond that it’s off the board,” Gallegos wrote in an e-mail.
