Cruces council candidate also wanted for DWI in Virginia

Ryan Dailey

Las Cruces City Council District 4 candidate Ryan Matthew Dailey, who was arrested Sunday on drunken driving charges in Las Cruces, is also wanted on a federal warrant for DWI in Virginia.

Until a federal magistrate in Las Cruces decides whether to extradite Dailey to Virginia or release him and order him to appear for court in that state, Dailey is being held at the Doña Ana County Detention Center.

Ben Segotta, the public information officer for the U.S. Marshals Service in New Mexico, said Dailey is wanted for DWI in Norfolk, Virginia. The charge is federal because Dailey was allegedly driving under the influence on a Naval base there.

Dailey spent two years in the Navy. Because he’s in jail, NMPolitics.net has not been able to reach him to ask if he’s staying in the city council race.

His Sunday arrest in Las Cruces resulted in charges of aggravated drunken driving, improper lane usage and lack of due care.

In addition, the Las Cruces Sun-News reported Tuesday on another incident involving Dailey:

“Last year, he was asked not to return to the Mesilla Reserve Deputy Marshals program after an incident at El Patio Bar & Cantina, current Mesilla Marshal Jeff Gray said Tuesday.

“‘There was a scene of some sort and he was asked to leave the bar,’ Gray said. ‘Our officers went there to find out what the ruckus was about. He was outside and asked to leave and given a ride home.’

“Gray said the responding officer, who is no longer with the Marshals, did not make a report on the incident, but that Dailey was allegedly intoxicated. Several weeks later, then-Marshal Marcel Jojola asked Dailey not to return, Gray said.”

Dailey has been running for the seat currently held by Nathan Small. Aaron Henry Diaz has also entered the District 4 race. The election is Nov. 8.

Update, Sept. 8, 2:40 p.m.

Dailey faces two misdemeanor charges in Virginia. According to a filing by the U.S. attorney’s office there, he faces one count of driving under the influence and one count for carrying a 10-inch knife hidden in his vehicle on Naval Station Norfolk on Feb. 14, 2009.

A federal judge issued the arrest warrant on March 6, 2009 after Dailey failed to show up for his initial appearance in court.
